Subject: Summary of Corrective Actions – Bishop Road Transfer StationDear Mr. Patrone:On March 27th, 2018 an inspection was performed at the Bishop Road Transfer Station resulting in aNotice of Violation issuance pertaining to a collapsed area within the transfer station concrete floor. Thishole was observed by facility personnel approximately two weeks prior at a significantly smaller size. Atthat time concrete blocks were placed around the location and a repair estimate was pursued. Due tothird party operator error this barricade was removed and substantially greater damage was caused tothe area over a short period of time. This error was reported to the third party operator and changes instaffing and operational practices were made to ensure that this would not occur again. In response tothe deficiencies cited in the Notice of Violation issued on April 5th, 2018 to the Bishop Road TransferStation Republic Services of North Carolina, LLC (Republic Services) submits the following as resolutionsfor your consideration:1.Immediately ensure that the collapsed tipping floor/hole is free of visible MSW andleachate/liquid. The area shall be effectively cordoned off to prevent MSW andleachate/liquid from further accumulating in the collapsed area/hole.Resolution: As observed during the NCDEQ facility inspection on April 11th: “The collapsed tippingfloor/hole has been cordoned off with large concrete blocks and covered with plastic liner.”2.The soil exposed in the area of the collapsed tipping floor/hole shall be tested for 40 CFR 258,Appendix 1 metals and organics constituents and BOD, COD, phosphates, nitrates, sulfates, andpH. Lab results shall be submitted to the Section for review and any exceedance of thestandards may result in excavation and disposal of contaminated soils. Submit a sampling plan inelectronic format sent via email for Section approval prior to sampling. Conduct subsurface soilsampling at specific locations including a background soil location to evaluate the extent of thepotential environmental impacts from the release at the facility. Discrete subsurface soilsamples should be collected between one to two feet below ground surface. Please include theproposed sampling methodology and a map depicting the proposed sampling locations.

Resolution: Soil sampling was conducted by Hart & Hickman on April 3rd. Samples were collectedvia hand auger at depths of 1’ and 3’. Analytical tests performed by Prism Laboratories, Inc.(attached):

BOD and COD were not analyzed as neither Republic Services, nor Hart and Hickman areaware of a testing methodology for these criteria in soil media.A summary of analytical results compared against NCDEQ Inactive Hazardous Sites Branch (IHSB)Preliminary Soil Remediation Goals (PSRGs) as well as range and mean background values forNorth Carolina and/or Southeast soils (Elements in North American Soils, Dragun and Chekiri,2005) as follows, and provided in detail in Table 1 (attached):
8260B – All volatiles were below reporting limits. No exceedances.
9056A – Nitrate was substantially below IHSB PSRGs (Groundwater, Residential, andIndustrial). No PSRG values exist for sulfate.
9045D – No PSRG values exist for pH.
SM450-P F – No PSRG values exist for phosphorus. Results are on the low end ofbackground values.
6020B – Detection range on arsenic (<1.7 mg/kg) was above the residential PSRG butbelow groundwater and industrial PSRGs as well as below background range and meanvalues.Chromium value in the 1’ sample was 7.1 mg/kg. The 3’ sample value was 6.4 mg/kg.These values are total chromium as discrete composition (Cr III v. Cr VI) is not part of the6020B standard testing protocol. PSRG numbers used for comparison are for hexavalentchromium (Cr VI), the more conservative value applicable to site soils, and it is unlikelythat the detection was entirely composed of hexavalent chromium. With thatunderstanding the total chromium value in the 1’ sample was above PSRG values for allthree categories while the 3’ sample was above on groundwater and residential but belowindustrial (6.5 mg/kg). Both results were in line with the lowest end of background rangevalues (7.0 – 300) and well below mean values (65). As a result no further segregation hasbeen requested as the sample conforms with native soil composition and meets applicablesoil concentrations for the industrial facility without discrete analysis.Cobalt results in both 1’ and 3’ sample were above protection of groundwater andresidential PSRG. Both results were below industrial PSRG. Both results were in line withthe lowest end of background range data and less than half the established meanbackground data.All other inorganics meet groundwater, residential, and industrial PSRG values.As this is an industrial facility located within the boundaries of a former construction anddemolition materials landfill it is the belief of Republic Services that industrial standards forprotection would be applicable to this site.

Detections of chromium and cobalt are consistent and on the lower range of established soilbackground concentrations for the region.The location of these samples is within the vadose zone of subsurface soil. As this is also atopographic high relative to surrounding ground surface it would exist consistently above thecapillary fringe. When coupled with a concrete slab and roofed structure there is no demonstrablepathway for percolation into and impact ofgroundwater.Based on this information Republic Services believes the conditions requested have been met andthat all results indicate no environmental impact to subsurface soils occurred.3.The collapsed tipping floor shall be repaired as soon as possible after a determination on the soilshas been completed. A North Carolina certified engineer shall approve, to include his/herengineer’s seal, the repair plans and as‐built repairs and shall submit those as‐builts to the Section to be included in the facility public record. Based on conversations between Section managementand Republic Services of North Carolina, LLC, a temporary fix without PE certification would beallowed if plans are to be submitted for replacement of the entire tipping floor system within 60days of receipt of this NOV.Resolution: The collapsed area was repaired on April 20th. The repair was done per the originaldesign specifications for jointed concrete slabs within the original engineering design for thefacility (Arp Engineering, June 2004). This consisted of:
Saw cut and removal of concrete material to provide clean boundaries
Remove suface soils and underlay with clean stone
Dowel into existing concrete slab
Tie in #5 rebar 1’ on center reinforcement mat
Pour replacement concrete 12” thick at 5000 psi strengthIt is anticipated that the replacement area will be sufficiently cured for use either on the date ofthis submittal (April 23rd) or the following day.Photographs of the repair are attached.4.Provide a written plan to ensure this type of violation does not occur in the future. The planshould include routine inspection of the transfer station tipping floor, daily cleaning of the tippingfloor, and weekly or monthlywashing of the tipping floor.Resolution: Republic Services standard operating procedure for transfer stations includes routinefacility inspections and requires the transfer station floor to be clean at the end of each day.Washing of the facility is included as part of the facility Operations Plan and documentation foreach washing event is to be retained on-site and provided at all future inspections. In addition aweekly log of transfer station inspections will be maintained as part of this record. The logemployed will be the attached Weekly Transfer Station Inspection Log or a form providingcomparable function.

5.A timeline for the completion of numbers 2 through 4 shall be submitted to the Section by April23, 2018.Resolution: See above for completion of specifictasks.
6.Notify Mr. Patrone when item number 1 is complete. An inspection to ensure compliance will beconducted.Resolution: This was completed as part of the inspection on April 11, 2018.

Both Bobby Needham, the facility Ops. Manager, and Dennis Moriarity, the facility General Manager will receive
Transfer Station operator training this year. Dennis already has his training in Virginia but as I’m unsure if that is
comparable to the NC SWANA training he’ll get the NC specific training as well.
I just emailed you the revised Summary, I removed Jason and Deborah from that email as the revision weighs in at about
10 MB and my habit is to avoid bombing people’s email if I can help it. Jason and Deborah, if you would like me to send
this to you directly let me know and I will do so.

Based on my review of the report below are my comments:
Page 2 states: “6020B – Detection range on arsenic (<1.7 mg/kg) was above the residential PSRG but above
groundwater and industrial PSRGs as well as above background range and mean values.”
I believe they meant to say that the detection range of arsenic was above the residential PSRG but BELOW
groundwater and industrial PSRG. Do not know about background. The detection range was 1.7 mg/kg and
the industrial standard for arsenic 3mg/kg and POG is 5.8 mg/kg
Page 2 states: “Chromium value in the 1’ sample was 7.1 mg/kg, above all three categories of PSRGs. 3’sample
was 6.4 mg/kg, above groundwater and residential PSRB, below industrial (6.5 mg/kg).”
Chromium is unlikely to be above the industrial standard. The total chromium standard of 6.5 mg/kg that they
used assumes that all chromium detected is chromium 6. That is probably unlikely as there would be some
chromium 3 present and the industrial standard for Chromium 3 is 350,000 mg/kg. Additional tests would be
need to determine how much of the total chromium is chrome 6 and how much is chrome 3.
Other than maybe a brief revision to discuss or incorporate the above comments, I would conclude that the analytical
results for soils meet the standards for the intended use of the site. If you would like to discuss further just let me know.

I have not comment on the tipping floor restoration because Republic said in the report that the repairmen of the
concrete was based on the original design generated by a third party (Arp Engineer, 2004) which I can’t locate
the original design at all in the Laserfiche. The descriptions of the steps/procedures of the repair are reasonable
but the attached photos do not provide the details of rebar/dowel connection between the new and existing floor
portions. The last photo in Attachment 2 is not really giving me good confidence of the strength of the
foundation. But the job does not required by the permit action and if the floor fails again, Republic will be hit
by another NOV down the road.
