Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. This facility consists of one 1,000-gallon tank and one 20,000-gallon tank with a total capacity of 21,000 gallons for the storage of untreated and treated septage. Liquid and solid waste generated at this facility shall be disposed of in a manner consistent with the approved application and submitted authorizations. 2. The tanks appeared to not have been used for some time. 3. No objectionable odors were observed outside of the facility. 4. It appeared that the setback requirements were being maintained. 5. The permitted tanks appeared to be structurally sound and no leaks were observed. 6. No spills were observed. 7. A “Notice of Ceased Operation of a Septage Detention and Treatment Facility” was received by the Division on May 3, 2018 with a final date of September 1, 2018; however, the solid waste permit expires the day before which is August 31, 2018. August 31, 2018 should be the final date of operation.
