OBSERVED VIOLATIONS:
1. 15A NCAC 13B 0838(a)(18) states: “Approved nutrient management plans shall be followed.”
2. Permit condition 2 states: “This site shall be operated in accordance with the nutrient management plan submitted
by Trent Rhea and approved by the Division of Waste Management.” 3. Permit Condition 7 states: “Monthly septage application rates shall not exceed the monthly relative application
rates given in the approved nutrient management plan.”
4. 15A NCAC 13B .0832(a)(6) states: “All conditions for permits issued in accordance with this Section shall be followed.”
Upon review of the land application logs submitted by Rhea’s Septic Tank Service on April 20, 2018, it was noted that the monthly applications rate was exceeded during October 2017. The month of October has a “low” application
rate of 5,000 gallons as per the approved nutrient management plan.

In order to resolve this issue, Rhea’s Septic Tank Service must take the following action:
a. Discharge events shall be monitored by the operator throughout the month to ensure that monthly application rates are not exceeded., particularly during “low” months as per the approved nutrient management plan.
ADDITIONAL COMMENTS
1. The Septage Land Application Site consists of one field totaling approximately 2.0 acres.
2. The site is permitted for land application of domestic septage and portable toilet waste. 3. The site is located on Beaver Creek Road (SR# 1325) and has accessible all-weather roads to the septage land
application field covered under the permit. 4. The signage displayed at the entrance to the field was faded or covered with vegetation (see below). The
signs must be maintained by replacement and/or maintenance.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

5. Disposal area boundaries were delineated with permanent markers.
6. All septage discharges appear to have been made within the disposal area boundary
7. There is no evidence of standing liquid or pooled waste. The waste appeared to be evenly distributed
throughout the field. There is an area with dormant or dead vegetation that needs to be repaired (see below). The Nutrient Management Plan requires areas that develop with less than 80% groundcover by
fescue be reseeded with fescue.
8. No objectionable odors were observed.
9. Weed control is in progress. 10. The land application logs were reviewed. The nutrient management plan (NMP) has a limitation of
5,000 gallons for the month of October; however, the log indicates that 10,000 gallons were land applied during the month of October 2017.
