OBSERVED VIOLATIONS:
1. .0838(a)(18) Approved nutrient management plans shall be followed. Permit Condition 2 – The site shall be
operated and maintained in accordance with the nutrient management plan.
It is May and the rye has not been cut & removed on Field 1 in accordance with the field rotation in the
nutrient management plan (rye will be cut/baled in March/April). The rye is currently very tall which can
shade out the bermuda. Cut hay is on Field 2 – so that field cannot be used for application until the hay is
removed. It appears that Field 1 is currently being used, if so then another 30 days is required before it can
be cut which will leave the rye on that field into June. Remove the cut hay from field 2 so that it can be used
for land application. Cut & remove the hay from Field 1 in accordance with the 30 day waiting period.
Follow the field rotation as per the approved nutrient management plan.

ADDITIONAL COMMENTS
1. The access road is severely eroded in some areas and needs maintenance/grading at this time. Repair the access
road as needed.
2. Cropstand appears adequate but weed control is needed. Contact Georgia Love, regional agronomist, for advice.
3. The required signs are posted.
4. Field markers appear accurate but vegetation needs to be removed from around some of the markers along
the woodline. Maintain the 10’ setback along the woodline. This was discussed during the last site visit on
10/26/2017.
5. No sign of land application outside the permitted boundaries. It appears that the approved setbacks are being
met. No sign of heavy or recent application. No odors noted.
6. Soil samples will be taken by the permit holder this fall.

enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
