Box 8 Bolivia, NC 28422 SUBJECT: Notice of Deficiency Compliance Inspection Report S & B Maintenance LLC SLAS-10-21 Brunswick County Dear Mrs. Cook: On April 26, 2018, Mr. John Farnell, representing the State of North Carolina, Division of Waste Management Solid Waste Section, performed a routine audit inspection of SLAS-10-21 for compliance with North Carolina solid waste statutes and rules. The following violation(s) were noted: A. 15A NCAC 13B .0838(a)(2) states “Access roads or paths crossing or leading to the disposal area shall be posted “NO TRESPASSING” and a legible sign of at least two feet by two feet stating “SEPTAGE LAND APPLICATION SITE” shall be maintained at each entrance to the land application area.” Upon entering the land application site by way of the newly repaired road, there were no appropriate signs posted. B. 15A NCAC 13B .0838(a)(18) states “Approved nutrient management plans shall be followed.” Inspection of the septage land application field showed several areas of heavy applications prohibiting crop growth. The above violations may have or can compromise the facility’s ability to ensure protection of the public health and the environment and thus require remedial action on behalf of the facility in order to maintain compliance with 15A NCAC 13B .0838(a)(2) and .0838(a)(18). In order to S & B Maintenance LLC Notice of Deficiency Page 2 of 2 May 11, 2018 resolve these issues, S & B Maintenance LLC must take the following actions within the next 30 days: 1. Improve application to evenly spread septage across the entire permitted field and removal of thatch to promote crop growth 2. Reseed entire land application site with appropriate crop 3. Post the appropriate signs at the entrance way to the land application site S & B Maintenance shall provide a written certification with supporting documentation on company letterhead confirming the noted compliance schedule has been completed. Include in this certification any actions taken to prevent these violations from occurring in the future. Mail this certification to Mr. John Farnell at 127 Cardinal Drive Extension, Wilmington, NC 28405 by the noted compliance time frame. The violation(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Please keep me informed of your progress in this matter. Solid Waste Section staff will conduct a follow-up inspection(s) to verify that the facility has completed the requirements of this Notice of Violation.
