This is a violation of Rule .0838(a)(2) that states “Access roads or paths crossing or leading to the disposal area shall be posted “NO TRESPASSING” and a legible sign of at least two feet by two feet stating “SEPTAGE LAND APPLICATION SITE” shall be maintained at each entrance to the land application area.” 2) Noted heavy application of septage in field prohibiting crop growth. This is a violation of Rule .0838(a)(18) that states “Approved nutrient management plans shall be followed.” SEE BACK PAGE FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 Missing signs Pile of thatch Very little Bermuda grass Heavy application The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Repaired road does not have “No Trespassing” sign or “Septage Land Application Site” sign of proper size posted. This is a violation of Rule .0838(a)(2). The appropriate signs listed under the rule need to be posted 2 – Repaired road is adequate 3 – Markers are up and appear to be accurate 4 – Septage discharges all appear to be within permitted boundaries 5 – Several areas of heavy applications were noted in a limited area of the field along with a large thatch pile. Crop growth was prohibited in above pictures. This is a violation of Rule .038(a)(18). In the nutrient management plan, the entire field is to be used and with rates that do not prohibit growth. After harvest, areas of heavy thatch will prohibit growth and therefore should be removed from the field 6 – Very little Bermuda grass can be seen in the above pictures.
