Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 ADDITIONAL COMMENTS The facility is a closed construction and demolition (C&D) landfill. The C&D landfill, consisting of Cells 1 through 8, stopped receiving waste in December 2006, and closure certification was completed in January 2012. 1. Matt Einsmann, Republic Services contacted Liz Patterson, Environmental Senior Specialist with NCDEQ, Division of Waste Management on Tuesday, March 1, 2016 to self-report an area of erosion and soil discoloration in the northwestern section of Cell 7 near the perimeter stormwater ditch. A release of a leachate-like material may have occurred and was first noticed on Tuesday, March 1, 2016. 2. The C&DLF is secured by a gate and fence around the perimeter to prevent trespassing. 3. Edge-of-Waste markers have been installed around all cells and are being maintained. 4. Semiannual groundwater and surface water monitoring records were not reviewed during the inspection. 5. Water monitoring wells were observed and were in good repair. The wells were locked and labeled and are accessible. 6. Access roads were in good condition, allowing for sufficient access to closed cells and monitoring wells on the site. Vegetation on the access roads has been mowed and is scheduled to continue to be mowed twice a year. 7. The landfill caps are covered with native grasses. The cover was in good condition for all units at the time of the inspection; no bald spots were observed. A weather station with soil probes and 4 tree test plot areas are located on the South Lateral Expansion of Cell 7. Weather station data is being downloaded on a monthly basis by Mr. Einsmann. Data from the weather station, soil probes, and quarterly inspections of the test plot areas by a Registered Forester, are submitted to the Solid Waste Section on an annual basis. Based on the location of the discoloration relative to the ditch, it appears that a release of leachate may have occurred. This soil can be placed on the top of the landfill. Sample the soil and surface water according to the method listed below: • Submit a sampling plan for Solid Waste Section review within 45 days and approval prior to conducting the sampling activities. Submit plan to Jaclynne Drummond, 1646 Mail Service Center, Raleigh, NC 27699-1664. • The sampling plan should include sampling methodology and a figure depicting the sampling locations. • A summary report (in electronic format) containing the results of the assessment should be submitted to the Solid Waste Section within 30 days of receiving the analytical results from the NC certified laboratory. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 4 Soil Sampling • Guidelines for soil sampling are located at: http://portal.ncdenr.org/c/document_library/get_file?uuid=d28d4f91-4b6d-4c9d-afd9- 47c9ee93615f&groupId=38361. • Conduct subsurface soil sampling to evaluate the extent of the potential environmental impacts from the release(s) at the facility. Discrete soil samples should be collected between one to two feet below ground surface. Composite soil samples will not be accepted. A background subsurface soil sample should also be collected. • Analyze subsurface soil samples for the Appendix I of 40 CFR Part 258 list of constituents consisting of both VOCs and metals. Please also analyze for pH. • The results should be compared to the Preliminary Soil Remediation Goal Table. Both the health based and the protection of groundwater soil goals must be met. A background surface water sample should also be collected. • Analyze surface water samples for the Appendix I of 40 CFR Part 258 list of constituents consisting of both VOCs and metals. Please also analyze for the field parameters pH, specific conductance, ORP, dissolved oxygen, and turbidity. • The results should be compared to the 2B Surface Water Standards.
