STATUS OF PERMIT:
A Permit to Construct a Scrap Tire Collection and Processing Facility along with a Permit to Operate a Tire Collection
Facility with Conditional Approval to Operate a Processing Facility were issued to Ben Bryant and new River Tire
Recycling, LLC on March 20, 2014. The permit will expire at close of business on December 20, 2016.

None
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The facility is a Scrap Tire collection and Processing Facility for the collection and processing of scrap tires.
2. The facility is permitted to receive scrap tires from all counties in North Carolina, Virginia, Tennessee and South
Carolina.
3. The facility had proper signage.
4. Gates were provided at both entrances to the facility to prevent unauthorized access.
5. The permit and operations plan were verified. Both documents were available upon request.
6. An emergency preparedness manual is provided in Appendix L of the approved facility application.
7. Tonnage records for August 17, 2015 through February 19, 2016 were verified. Records showed that a total of
720.59 tons of stockpiled and processed scrap tires were on site. This total would be equal to 72,059 tires (720.59
X 100 tires/ton). This number of tires is below the permissible limit of 130,000 tires.
8. A chain-length fence had been constructed around the facility since the previous inspection. The fence extends to
the woodline that borders the facility on the south side. Mr. Bryant explained that plans are to extend the fence in
the near future to completely encircle the facility boundary.
9. The facility experienced a significant fire on January 12, 2016. Mr. James Hiatt provided verbal notification to the
Solid Waste Section on January 12th. A Solid Waste Management Facility Fire Occurrence Notification was
received by the Solid Waste Section on February 2, 2016.
x The cause of the fire was being investigated as arson by the local police, Fire Marshal, and State Bureau of
Investigation subsequent to submittal of the notification form.
10. The facility was accepting and storing tires at the time of inspection. However, tires were not being processed as
the facility was without power. The office and scales were being operated by gas generator.
11. During the inspection, a large stockpile of ground tire material with metal shavings was observed on the south side
of the facility footprint. Mr. Bryant explained that this material was being hauled to the Carroll-Grayson-Galax
Solid Waste Authority landfill facility in Hillsville, Virginia.
12. During the inspection, all remaining burned residues were observed staged within the footprint of the facility
building in the shipping area. Mr. Bryant explained that this material was also in the process of being removed to
the Carroll-Grayson-Galax Solid Waste Authority landfill facility in Hillsville, Virginia.
13. On January 25, 2016, the facility was inspected by Doug Jones, Surry County Fire Marshal and Brandon Hawks,
Surry County Inspections Director. Both individuals found the facility structure to be deemed unsafe and power was
shut off. Subsequent letters were issued to Mr. Ben Bryant on January 28, 2016
x Mr. Jones and Mr. Hawks notified Mr. Bryant of corrective actions that must be completed in order for
electrical power to be reestablished to the facility and in order for the Certificate of Occupancy to be re-
issued. However it is the Section’s understanding that an official stop work order was not issued.
14. Mr. Bryant explained that facility staff were in the process of addressing Mr. Jones’ and Mr. Hawks’ concerns.
15. The roof observed over the shipping area had been removed since the last inspection.
16. Staff were in the process of removing a portion of the roof on the west side of the building at the time of inspection.
17. Please continue efforts to address all concerns expressed by the Fire Marshal and Inspections Director detailed in
their letters issued on January 28, 2016.
18. During the inspection, some demolition debris (primarily painted and unpainted concrete block) was observed
staged on the south side of the property beyond the building footprint. Some of this material was staged within the
vegetated area on the south side of the building. Please ensure that any demolition waste generated as a result of
facility cleanup efforts or building construction is removed from the site within the 30-days of generation to a
facility permitted to accept such waste.
19. Please notify the Solid Waste Section upon completion of corrective actions required by the Surry County Fire
Marshal and Inspections Director.
20. During the inspection standing water was observed on the concrete pad within the area designated as “Tire Storage”
on Appendix K of the approved facility application. As cleanup efforts progress, please ensure that steps are taken
to ensure that drainage is effective to prevent standing water on site.

21. Inspection found that storm drains along the access route around the south side of the building were covered with
soil. Mr. Bryant explained that these drains were covered immediately after notification of the fire to prevent any
runoff from firefighting activities from entering the storm drains. Hay Bales had been placed around the storm
drain located in front of the loading docks which lead to the area designated as “Crumb Storage” on Appendix K of
the approved facility application.
22. A large amount of tires were observed within the footprint of the building. Please ensure that tires are placed in
scrap piles of proper dimensions as cleanup efforts progress.
23. Please ensure that any open top trailers used to haul/store tires (while on-site) are either covered or stored under roof
as discussed during the inspection.
