REGAN Secretary MICHAEL SCOTT Director April 30, 2018 CERTIFIED MAIL 7016 1370 0000 2590 0043 RETURN RECEIPT REQUESTED Ms. Carole McLeod, President 950 Eagle Road Waxhaw, NC 28173 SUBJECT: FFD II, LLC dba Recycle Carolina 3616-Transfer-2013 Gaston County Dear Ms. McLeod: The Solid Waste Section (Section) received your letter dated April 13, 2018 regarding the referenced facility and the estimated annual tonnage for reporting year 2016-17. While the Section can appreciate what all you are going through with the sale of the hauling company, the timeframe to submit this information and the way it was submitted does not meet the requirements of your permit or the laws/rules governing the operations of this type facility. The timely submittal of tonnage and other information on the prescribed form is vital to Departmental efforts to comply with our own reporting deadlines imposed by the General Assembly. As a reminder, the 2017-2018 Facility Annual Reports will be due starting in July 2018. It is imperative that you submit a report by no later than August 1st even if the facility operated at a minimal capacity and/or did not operate at all since July 2017. A report of zero tonnage is acceptable. Failure to report in a timely manner this year will result in enforcement action by the Section which may include penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
