On March 23, 2018, Myers Septic Tank Co. was in violation of 15A NCAC 13B .0838 (a) (9) because several ruts greater than 3 inches in depth were observed in Field 1. In order to come into compliance, Myers Septic Tank Co. must repair all damage to the field (including re-seeding) caused by driving on the fields causing ruts by May 11, 2018. The Septage Land Application Site consists of Field 1 (2.0 acres) and Field 2 (4.4 acres) for a total of 6.4 usable acres. 2. The site is permitted for land application of domestic septage. 3. The site had accessible all-weather roads to the septage land application field covered under the permit. 4. The signage that states “No Trespassing” and “Septage Land Application Site” that was missing on 10/31, 2017 has been replaced. 5. Both fields had disposal area boundaries that were delineated with permanent markers except for the missing marker at the Northwest corner (entrance) of Field 1 and a marker was on the ground in the inner curve of Field 1 (see photo below). Orange flags have placed at these areas. 6. All septage discharges appear to have been made within the disposal area boundary. 7. No evidence of standing liquid or pooled waste was observed. The waste appeared to be evenly distributed throughout the field. 8. Several ruts greater than 3 inches in depth were observed in Field 1. State regulations require septage not be applied if the application method will result in ruts greater than three inches in depth. In addition, road gravel was used in the field to repair the rut. This must be repaired as soon as possible and the gravel removed from the field. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The nutrient management plan has fescue and Bermuda grass as the established crop.
