OBSERVED VIOLATIONS:
15A North Carolina Administrative Code (NCAC) 13B .0841(j) states: “Septage shall be transferred to and from a
detention system in a safe and sanitary manner that prevents leaks or spills of septage, including septage in pipes used for
transferring waste to and from vehicles.”
Millers Septic Service was in violation of 15A NCAC 13B .0841(j) During the inspection, the tank began to overflow onto the ground for approximately 4-5 minutes.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. This Septage Detention and Treatment facility (SDTF) consists of one 6,000-gallon and one 9,000-gallon steel
tanks for storage and treatment of domestic septage (including portable toilet waste) and grease trap pumpings. 2. Set-back/buffer requirements appear to have been met.
3. Appropriate signage (No Trespassing sign) was posted for the site.
4. All weather roads are maintained for access to the site.
5. The tanks appeared to be structurally sound.
6. Remember to keep vegetation cleared around the tanks. 7. A PVC pipe leading from the 9,000-gallon tank to an air compressor that is used for aeration.
8. Upon arrival at the tanks, a septage pumper vehicle was on site and offloading into the 6000-gallon tank. There
was no operator in the immediate vicinity (see photo A). During the inspection, the 6000 gallon-tank began to
overflow onto the ground for approximately 4-5 minutes. There was a very strong odor. Several photos were taken (see photos B and C). I called Warren Miller and informed him of the spillage. Mr. Dustin Dillard
arrived shortly thereafter. He stated that he was washing his hands and thought he had enough space in the
tank. Mr. Dillard immediately began sucking up the spilled waste back into the vehicle. Mr. Dillard stated that he was going to get lime to put on the ground over the spill. The photograph (photo D) was submitted at
5:19 PM day however it showed lime only on the area near the front of the tanks. It appears that lime was not applied to the additional areas where the septage flowed. A spill report was submitted at 5:16 PM by Mr. Dillard.
The spill report stated: “On 4/18/19 @ 256 pm a spill occurred at septage detention site sdtf-02.05 located on black oak ridge road Taylorsville driver Dustin Dillard had temporarily walked away. While empting a truck a
tank overfilled and septage overflowed onto the ground. Troy Harrison was present. The spill was small approximately 50-100 gallons and was confined to the storage site. The spill was vaccumed up and the grounds limed by 4pm”
