STATUS OF PERMIT: Yard Waste Facility Notification received by the SWS for June 1, 2017 through May 31, 2018. Yard Waste Facility Notification expires on June 1 of each year PURPOSE OF SITE VISIT: Comprehensive Inspection (to ensure that the yard waste facility notification is in compliance with 15A North Carolina Administrative Code (NCAC) 13B .1404(a)(1)-(10), 13B .1406, and the requirements as stated on the yard waste facility notification application and the corresponding approval letter). STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS On April 18, 2018, John Patrone met with Mark Moldenhauer to conduct a comprehensive inspection of the Mark Moldenhauer Yard Waste Notification on Lystra Road in Chapel Hill, Chatham County. 1. The yard waste notification (YWN) is located atop a portion of a notified land clearing and inert debris (LCID) landfill (N0193) that has been covered with soil and is no longer in operation. 2. The property (parcel No.: 67592) is owned by Couch Etta C. Heirs, Edna R. Council, Marjorie C. Laney & Joan E. The property owner contact listed on the current YWN facility renewal form is Joan Spencer (ph. 919-477- 6617). 3. The facility is not open to the public. Moldenhauer Landscaping, Inc. uses the YWN/property for its business. Mr. Moldenhauer stated that he does allow a few long-time business associates to bring material to the YWN by appointment only. 4. The facility only accepts high carbon to nitrogen ratio material. 5. Material is ground annually, commonly in the spring. 6. Material is off-loaded on the right side of the property and stored until ground. 7. The facility assumes, for unprocessed material received, that single axle dump truck capacity is 8 yd3, tandem axle dump truck capacity is 12 yd3, and quad-axle dump truck capacity is 16 yd3. 8. During the inspection, material was being ground. There was no appreciable amount of unground yard waste observed on site. 9. The facility maintains records of the amount of material received. Throughput records were observed for 2015, 2016, and 2017. 10. Mr. Moldenhauer stated that there was ~ 1,000 yd3 of mulch on site. 11. The facility assumes, for ground material hauled-off, that single axle dump truck capacity is 10 yd3, tandem axle dump truck capacity is 15 yd3, and quad-axle dump truck capacity is 20 yd3. 12. Material accepted is required to be less than 6,000 yd3 quarterly, processed and unprocessed combined. 13. The YWN operation must remain < 2 acres in size. 14. The facility appeared to meet required setbacks. 15. Soil is stockpiled for reuse adjacent to the YWN operation. Mr. Moldenhauer stated that the soil is screened before use. The soil is used by Moldenhauer Landscaping, Inc. 16. Concrete and rock are stored for reuse at the far end of the lot. The concrete and rock is used by Moldenhauer Landscaping, Inc. 17. Mr. Moldenhauer stated that logs stored on site are routinely brought to a sawmill. 18. No erosion or runoff was observed. 19. Access roads are of all-weather construction. 20. The site is secured by a metal gate with lock. 21. The facility has a sign. 22. The yard waste facility notification shall be renewed annually by June 1st.
