Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Scattered white debris was noted around the tank, if this is septage debris it needs to be cleaned up and implement changes to prevent this in the future. Septage shall be transferred to/from the facility in a safe and sanitary manner to prevent spills or leaks. No liquid waste or septage debris (paper/plastic trash from the waste) shall be on the ground surface. 2. Discussed cleaning procedures for porta johns. Any rinse water from the waste tank in a porta john is considered septage and shall be contained (not spilled on the ground surface) & disposed of properly (at the wastewater treatment plant). 3. The tank appears structurally sound. 4. The required “No Trespassing” sign is posted and the access road is adequate. 5. The approved setbacks are being met. 6. The required 5’ cleared radius (free of excess vegetation or debris) is present around the tank. Please maintain the cleared radius in the coming months.
