OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0838 (a) (9) states: “Septage shall not be applied to a site if the application method will result in ruts greater than three inches in the soil surface”.
On March 22, 2018, Dennis Willis Septic Service was in violation of 15A NCAC 13B .0838 (a) (9) because several ruts greater than 3 inches in depth were observed in Fields 2 and 3.
In order to come into compliance, Dennis Willis Septic Service repair all damage to the fields (including re-seeding) caused by driving on the fields causing ruts by June 7, 2018. By May 7, 2018, Dennis Willis Septic
Service must submit progress on the repairs to:

ADDITIONAL COMMENTS
1. All photographs were taken by Troy Harrison on March 22, 2018.
2. The Septage Land Application Site consists of Field 1 (6.8 acres), Field 2 (10.9 acres) and Field 3 (9.0 acres) for a total of 26.7 usable acres. 3. The site is permitted for land application of domestic septage and grease trap pumpings.
4. The access road to the tanks was passable but needs repair. As a reminder, North Carolina regulations require that each site have an all weather access road.
5. Appropriate signage was displayed at the entrance to the fields.
6. All septage discharges appear to have been made within the disposal area boundary. No recent applications were observed in Fields 1 and 3 and contained livestock. Field 3, while not in use at the time of inspection, had ruts that had not been repaired.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

7. Field 2 was being used at the time of inspection. There are several areas of concern:
a. Several ruts greater than 3 inches in depth were observed in Field 1. State regulations require septage not be applied if the application method will result in ruts greater than three inches in depth.

b. There were several areas in Field 2 where heavy applications were observed. It is important to land
apply in a manner as to not caused pooled or concentrated waste. However, if that does occur the waste must be manually spread (usually with a rake) to prevent damage to the crop. There were also areas with dormant vegetation. According to the nutrient management plan (NMP) for Field 3,
the crop is fescue only and requires re-seeding if the fescue ground cover falls below 90%. c. Ponded water was observed in Field 2. State regulations require that septage shall not be applied to
a site if any liquid is ponded on the site. There were several areas in the field, especially next to the road with ponded water. This will need to be repaired.
8. Field 1 was being used as pasture.
9. No objectionable odors were observed.
