VIOLATIONS:
1. 15A NCAC 13B .0402(6), “Equipment shall be provided in the storage and charging areas and elsewhere as
needed or as may be required to maintain the facility in a sanitary condition.” The middle left side of the
transfer station tipping floor collapsed forming a large hole that appeared to extend through the concrete
floor to the soil underneath. Facility staff stated that the concrete floor began to break apart over a two-
week period in the beginning of February 2018 and that the floor collapsed in late February 2018.
2. 15A NCAC 13B .0203(d), “By receiving solid waste at a permitted facility, the permittee(s) shall be considered
to have accepted the conditions of the permit and shall comply with the conditions of the permit.” Conditions
of the permit were not complied with per the following:
Permit Condition in Attachment 3, Conditions of Permit to Operate, Part VI - Number 11, “All water that
comes in contact with solid waste, including vehicle wash-down water, is leachate and must be captured
and properly treated before release to the environment.” The leachate observed in the collapsed tipping
floor/hole appeared to have a direct route to the soil underneath.
Permit Condition in Attachment 3, Conditions of Permit to Operate, Part VI - Number 11 (a) states, “The
leachate control system, such as floor drains, leachate collection devices, sanitary sewer connections and
leachate storage tanks, must be operational during facility operations.” The leachate control system at the
collapsed tipping floor/hole did not function as designed.
Permit Condition in Attachment 3, Conditions of Permit to Operate, Part VI - Number 11(b) states, “The
tipping floor must drain away from the building entrance and into the leachate collection system.” The
leachate observed in the collapsed tipping floor/hole did not drain into the leachate collection system. The
leachate appeared to have a pathway into the environment by way of the surrounding soil.
Based upon the foregoing, the Republic Services of North Carolina, LLC - Bishop Road Transfer Station shall come into
compliance upon receipt of this Notice of Violation (NOV) with the requirements of regulation 15A NCAC 13B .0402(6)
and 15A NCAC 13B .0203(d) and with the Permit Condition in Attachment 3, Conditions of Permit to Operate, Part VI -
Numbers 11, 11(a), and 11(b) by completing the following:
1. Immediately ensure that the collapsed tipping floor/hole is free of visible MSW and leachate/liquid. The area shall
be effectively cordoned off to prevent MSW and leachate/liquid from further accumulating in the collapsed
area/hole.
2. The soil exposed in the area of the collapsed tipping floor/hole shall be tested for 40 CFR 258, Appendix 1 metals
and organics constituents and BOD, COD, phosphates, nitrates, sulfates, and pH. Lab results shall be submitted
to the Solid Waste Section (Section) for review and any exceedance of the standards may result in excavation and
disposal of contaminated soils. Submit a sampling plan in electronic format sent via email for Section approval
prior to sampling. Conduct subsurface soil sampling at specific locations including a background soil location to
evaluate the extent of the potential environmental impacts from the release at the facility. Discrete subsurface soil
samples should be collected between one to two feet below ground surface. Please include the proposed sampling
methodology and a map depicting the proposed sampling locations.
3. The collapsed tipping floor shall be repaired as soon as possible after a determination on the soils has been
completed. A North Carolina certified engineer shall approve, to include his/her engineer’s seal, the repair plans
and as-built repairs and shall submit those as-builts to the Section to be included in the facility public record. Based
on conversations between Section management and Republic Services of North Carolina, LLC, a temporary fix
without PE certification would be allowed if plans are to be submitted for replacement of the entire tipping floor
system within 60 days of receipt of this NOV.
4. Provide a written plan to ensure this type of violation does not occur in the future. The plan should include routine
inspection of the transfer station tipping floor, daily cleaning of the tipping floor, and weekly or monthly washing
of the tipping floor.
5. A timeline for the completion of numbers 2 through 4 shall be submitted to the Section by April 23, 2018.

6. Notify Mr. Patrone when item number 1 is complete. An inspection to ensure compliance will be conducted.

ADDITIONAL COMMENTS
On March 27, 2018, John Patrone met with Bobby Needham to conduct a comprehensive inspection of the Republic
Services of North Carolina, LLC Bishop Road Transfer Station located on Bishop Road in Greensboro, Guilford County.
1. The facility is a municipal solid waste (MSW) transfer station owned by Republic Services of North Carolina,
LLC and operated by K.R. Drenth Trucking, Inc.
2. The facility is open for receipt of MSW Monday through Friday 4:00 am to 5:00 pm and Saturday 6:00 am to
12:00 pm. Facility staff work on site until 8:00 pm.
3. The facility permit, site plan, and operations plan were discussed.
4. The facility is not open to the public.
5. The facility is permitted to receive MSW generated within a 50-mile radius of Guilford County. The service area
includes the 26 counties listed in the permit.
6. Municipal solid waste is hauled to the Uwharrie Environmental Regional Landfill (62-04) in Montgomery
County. The facility is permitted to haul MSW to four other landfills as listed in the permit.
7. The following are facility certified personnel:
a. Anthony Perez, Certified Transfer Station Operations Specialist, TS-2012057, exp. 06/22/18
b. Joseph E. Prestandrea, Certified Transfer Station Operations Specialist, TS-2005010, exp. 04/05/20
8. It is suggested that additional certified personnel are available on site during operating hours.
9. A vehicle scale test was conducted by the North Carolina Department of Agriculture & Consumer Services on
December 11, 2015.
10. A vehicle scale test was conducted by Carlton Scale on December 15, 2017.
11. The facility receives commingled recyclable materials (paper, plastic, glass, metal, and cardboard). The
recyclables are off-loaded on the right side of the transfer station building tipping floor. Throughout the day,
recyclables are loaded into dedicated transfer trailers and hauled to the GDS Conover Transfer Station (18-05) –
MSW transfer station and recyclable materials processing operation.
12. The recyclable materials are separated from MSW by a small wall constructed of large concrete blocks.
13. When the facility permit is renewed, modified, or reviewed the recyclable materials transfer operation should be
described in detail.
14. Mr. Needham stated that in the future, recyclables will likely be direct hauled to the GDS Conover Transfer
Station.
15. The facility maintains records of the amount of material received. Throughput records were observed for
September 1, 2017 through March 26, 2018. Municipal solid waste received is 73,624.46 tons and recyclables is
3,489.29 tons.
16. The facility annual report (FAR) was received by the SWS dated July 26, 2017. Tonnage of MSW received July
2016 through June 2017 is 136,066.59 and the tonnage of recyclable materials received is 6,512.
17. K.R. Drenth Trucking, Inc. hauls MSW and recyclables from the facility for disposal and recycling.
18. Mr. Needham stated that the transfer trailers hauled-off each contain ~ 22 tons of MSW and ~ 6 tons of recyclable
materials.
19. Mr. Needham stated that ~ 25 MSW transfer trailers and two recyclable materials transfer trailers are hauled-off
daily.
20. Mr. Needham stated that full transfer trailers of MSW are generally not stored on site overnight.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

21. The transfer trailers appeared to be in good operational condition.
22. The exterior of the transfer trailers is required to be cleaned when grime is noticeable.
23. The transfer station tipping floor is designed to allow leachate to drain into the load out bay.
24. Leachate from the load out bay is piped to the City of Greensboro sanitary sewer system.
25. The load out bay floor is an old scale. Leachate drains along the length of the scale to the oil/water separator
tank.
26. The transfer station oil/water separator tank was pumped-out by Noble Oil Services, Inc. on March 15, 2018.
27. Water that accumulates at the exit of the load out bay (in the low area) shall be treated as leachate if it comes in
contact with solid waste.
28. The facility is required to conduct at least two waste screenings per week. Waste screening reports were observed
for September 1, 2017 through March 23, 2018.
29. The facility does not accept scrap tires or white goods.
30. The transfer station building has fire extinguishers.
31. The transfer station building walls are washed down by Byrne Truck Equipment. The most recent wash down
occurred in August 2017.
32. The tipping floor, walls, and load out bay shall be cleaned [no MSW remaining] by the end of each workday.
33. The damage to the transfer station tipping floor shall be repaired.
34. Until the damage is repaired, the area shall be cordoned off. Ensure the collapsed tipping floor/hole does not contain
MSW and/or leachate.
35. Windblown material is required to be picked up by the end of each workday.
36. It is suggested that the interior building walls, where damaged, are repaired accordingly.
37. By the end of each workday all MSW shall be removed from the transfer building approach pad and picked up
from the property.
38. The Pinecroft-Sedgefield Fire Department can be contacted to address an emergency at the facility.
39. The facility is secured by a locked gate. Personnel are on site during operating hours.
40. Access roads are of all-weather construction.
41. The facility has proper signage.
42. The PTO expiration date is October 12, 2024.
43. The PTO renewal application shall be submitted to the SWS by April 12, 2024.
44. The PTO is subject to limited review by October 12, 2019.
45. The PTO limited review request is due by April 12, 2019.
