ADDITIONAL COMMENTS
On March 9, 2018, John Patrone met with Will Copeland to conduct a comprehensive inspection of the Apex Nurseries,
Inc. YWN Site No. 2 located on Holland’s Chapel Road in Apex, Chatham County.
1. The yard waste notification (YWN) is operated by Apex Nurseries, Inc. It is known as YWN Site No. 2.
2. Apex Nurseries, Inc. operates an additional YWN on an adjacent parcel of land, No. 19-006 YWN Site No. 1.
3. The facility grinds land clearing debris (LCD) and yard waste.
4. The facility also grinds material for boil fuel.
5. The facility does not compost material.
6. The YWN area is designated by metal stakes.
7. During the inspection, no yard waste was observed on the YWN site.
8. Throughput records were observed from June 2015 through December 2017.
9. Ensure only high carbon to nitrogen ratio yard waste is received unless designated to be ground for boiler fuel.
10. Unprocessed and processed material for boiler fuel shall be maintained separately from unprocessed and
processed material for mulch.
11. Ensure a 50-foot buffer is maintained around the YWN designated area.
12. No erosion or runoff was observed.
13. Apex Nurseries, Inc. accepts ground mulch for sale to the public. The purchased mulch storage area is located
adjacent to the YWN designated area.
14. The facility has a sign.
15. The yard waste facility notification shall be renewed annually by June 1st.

administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
