FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section N0655_INSP_20180306 Page 2 of 4 ADDITIONAL COMMENTS: 1) This Facility is a Land-Clearing and Inert Debris (LCID) Landfill Notification. 2) This Facility is recorded with the Carteret County Register of Deeds at: Book 913; Page 399. 3) This Facility is permitted to receive for disposal: a. Land Clearing Waste: stumps, trees, limbs, brush, grass, and other naturally occurring vegetative materials generated solely from land clearing activities. b. Yard Trash: brush, grass, tree limbs, and similar vegetative materials resulting from landscaping and yard maintenance. c. Inert Debris and Untreated Wood: concrete, brick, concrete block, uncontaminated soil, gravel and rock, untreated and unpainted wood; and d. Used Asphalt: used asphalt or asphalt mixed with dirt, sand, gravel, rock, and concrete. 4) The disposal area for this Facility may not exceed 2 acres in total size. 5) This Facility is monitored by a 24 hour security camera placed adjacent to the facility access road. 6) This Facility is secured by a locked cable at the Facility entrance and has controlled access for safety. 7) Signage is posted at the Facility entrance with the Facility contact name and telephone number clearly displayed. 8) Inert debris consisting of scrap concrete, concrete block and brick is being stockpiled for reuse in an area adjacent to the landfill.*Please note that the State rules regarding recovered materials state that for a material to qualify as a recovered material, the majority of the material (75% or more) must be sold, used, or re-used within twelve months. 9) The access road to the Facility is being managed properly at this time. 10) The landfill footprint marker stakes have been removed. *Within thirty days of receipt of this Facility Compliance Inspection Report, please re-install permanent, highly visible marker stakes around the toe of the landfill delineating the disposal area boundary. 11) Overall, the closed areas of this Facility have a well-established cover crop of native warm season grasses and coppice type cover. However, some areas of sparse coverage were observed in various places around the landfill. *Within thirty days of receipt of this Facility Compliance Inspection Report, all areas lacking in sufficient cover need to be seeded and mulched to establish a groundcover suitable to prevent erosion of your landfill cap system. 12) Brushy vegetation has been established on portions of the access around the perimeter of the landfill. *Within thirty days of receipt of this Facility Compliance Inspection Report, please clear the area around the entire perimeter of the landfill to provide unrestricted access around the toe all outside slopes for Facility maintenance and inspections. 13) Two sinkholes were observed near the top lift of the landfill approximately midway down the western sideslope (please see the aerial photo on page 4 of this report). *Within thirty days of receipt of this Facility Compliance Inspection Report, please repair these areas by filling and compacting the voids. All repaired areas should be seeded and mulched once the repair operations are completed. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section N0655_INSP_20180306 Page 3 of 4 14) No new disposal activity appears to have occurred since the last Facility Compliance Inspection. 15) Soil has been stockpiled on the top lift of the landfill and in an area adjacent to the landfill for use in cover and maintenance operations. *The soil stockpile needs to be stabilized to prevent erosion and off site sedimentation. 16) Eroded areas were observed on the southern slope of the landfill (please see the aerial photo on page 4 of this report). *Within thirty days of receipt of this Facility Compliance Inspection Report, please repair all eroded areas by filling and grading at a slope not greater than 3:1. After repairing these areas, please seed and mulch to establish a cover crop suitable to prevent erosion of your landfill cap system. 17) *Corrective measures are required as a result of this Facility Compliance Inspection.
