FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section N1073_INSP_20180306 Page 2 of 5 ADDITIONAL COMMENTS: 1) This Facility is a Land-Clearing and Inert Debris (LCID) Landfill Notification. 2) This Facility is recorded with the Carteret County Register of Deeds at: Book 913; Page 399. 3) This Facility is permitted to receive for disposal: a. Land Clearing Waste: stumps, trees, limbs, brush, grass, and other naturally occurring vegetative materials generated solely from land clearing activities. b. Yard Trash: brush, grass, tree limbs, and similar vegetative materials resulting from landscaping and yard maintenance. c. Inert Debris and Untreated Wood: concrete, brick, concrete block, uncontaminated soil, gravel and rock, untreated and unpainted wood; and d. Used Asphalt: used asphalt or asphalt mixed with dirt, sand, gravel, rock, and concrete. 4) The disposal area for this Facility may not exceed 2 acres in total size. 5) This Facility is monitored by a 24 hour security camera placed adjacent to the Facility access road. 6) This Facility is secured by a locked cable at the Facility entrance and has controlled access for safety. 7) Signage is posted at the Facility entrance with the Facility contact name and telephone number clearly displayed. 8) The access road to the Facility is being managed properly at this time. 9) Marker stakes have been placed around the toe of the landfill delineating the disposal area boundaries. 10) The perimeter road has been cleared to provide access around the toe of the landfill. 11) The waste type in the landfill was reviewed. The waste type being disposed was LCID only and no unpermitted wastes were observed during this Facility Compliance Inspection. 12) Waste was observed as having been pushed from the working face over the southwestern sideslope (please see the aerial photo on page 5 of this report). This area needs to be compacted, covered, and graded at a slope not greater than 3:1. *The landfill should be constructed in a lift type progression. All waste should be covered monthly or when the active working area reaches one acre in size, whichever occurs first. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section N1073_INSP_20180306 Page 3 of 5 13) It appears that the active areas of landfill have not been covered in some time. *Please ensure that the active working area is covered monthly, or when the active working area reaches 1 acre in size, whichever occurs first. 14) Eroded areas were observed on the eastern sideslope of the landfill (please see the aerial photo on page 5 of this report). *Within thirty days of receipt of this Facility Compliance Inspection Report, please repair these eroded areas by filling and grading at a slope not greater than 3:1. After repairing the erosion, please seed and mulch to establish a cover crop suitable to prevent erosion of your landfill cap system. 15) A cover crop of native warm season grasses and mixed coppice has been established on portions of the landfill sideslopes. However, several areas on the outside slopes were observed as having insufficient cover to prevent erosion of your landfill cap system. *Within thirty days of receipt of this Facility Compliance Inspection Report, please seed and mulch all areas lacking a cover crop to establish a cover crop suitable to prevent erosion of your landfill cap system. 16) Some brush, small trees, and woody vegetation was observed growing in many areas on the Facility sideslopes. *Within thirty days of receipt of this Facility Compliance Inspection Report, please mow the landfill cover crop. A regular maintenance schedule needs to be instituted which should include regular FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section N1073_INSP_20180306 Page 4 of 5 mowing to prevent the establishment of woody vegetation and trees on the outside slopes of the landfill. 17) Portions of the eastern sideslope appear to be graded at a slope greater than 3:1. * Within thirty days of receipt of this Facility Compliance Inspection Report, please re-grade this slope at a slope not greater than 3:1 and seed and mulch to establish a groundcover suitable to prevent erosion of your landfill cap system. 18) No off site erosion was observed during this Facility Compliance Inspection. 19) *Corrective measures are required as a result of this Facility Compliance Inspection.
