The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Mr. Lindsay requested a follow up visit to ensure the remedial actions being taken to address the violations listed
above were proceeding in the correct manner.
2. LBD stopped accepting waste on January 24, 2018.
3. The site should be graded to allow for positive drainage of surface water from the landfill.
4. All unacceptable wastes shall be removed and disposed at a permitted facility. Acceptable wastes are; land
clearing waste, concrete, brick, concrete block, uncontaminated soil, gravel and rock, untreated and
unpainted wood, and yard trash, all other waste types must be removed. Please, retain weight receipts for the
unacceptable waste that is removed.
5. Any street sweepings accepted at the facility must be removed and disposed at a permitted municipal solid
waste facility.
6. The LCID waste shall be covered in accordance with 15A NCAC 138 .0566 (5); upon revocation of a permit,
the disposal area shall be covered with a minimum of one foot of suitable soil cover sloped to allow surface
water runoff in a controlled manner.
7. The side slopes for the closure of this site should be no less than 3:1 to aid in preventing erosion and
establishing a vegetative cover sufficient to restrain erosion.
8. Ground cover shall be established in accordance with 15A NCAC 138 .0566 (7), Provisions for a ground cover
sufficient to restrain erosion must be accomplished within 30 working days or 120 calendar days upon
completion of any phase of landfill development.
9. A survey shall be done of the entire waste disposal area and survey map submitted to the solid waste section.
10. Edge of waste markers shall be installed along the perimeter of the entire disposal area and should be visible
from one to the next one.
11. At the time of this inspection 401 Sand staff had made progress in creating appropriate side slopes and covering
waste.
12. Corrective measures are necessary as a result of the findings of this inspection and shall be completed within 30
days’ receipt of this report.
