On December 5, 2008, DENR North Carolina Brownfields Program (NCBP) received a Work
Plan for the proposed monitoring well location for the above reference brownfields property. In
accordance with the Notice of Brownfields Property Paragraph 8, this plan was submitted to
DENR prior to the well installation on the Brownfields Property. The work plan and well
location are approved.

Be advised that this approval from the Brownfields Program does not waive any applicable
requirement to obtain any necessary permits, licenses or certifications for the above listed
activities nor does it waive any requirement to comply with applicable law for such activities. If
