Carolyn, I’ve attached the following documentation to confirm that Crescent South Tryon, LLC, Prospective Developer for the Former Goodyear Service Center Brownfields project, has satisfied the public notice requirements set forth in N.C.G.S. § 130A-310.34: 1. Stamped USPS certified mail receipts for transmittal of the Summary Notice of Intent to each owner of record of property contiguous to the Brownfields Property. To aid in your review, I’ve also re-attached the chart of the contiguous property owners that I sent previously, with corresponding certified mail tracking numbers. The certified mail receipts are all date stamped for February 14, 2018, however, you may notice that some of the receipt date stamps are very faint and hard to read. We hope that providing the receipts to you today can serve as proof that they were mailed on time. 2. The following Notice of Intent transmittal letters, with signatures confirming receipt of the hand-delivered NI packages: a. The transmittal letter for the hand-delivered Notice of Intent for the Charlotte City Manager. This letter was signed the City Manager’s assistant to confirm receipt at the time of delivery on February 14, 2018. b. The transmittal letter for the hand-delivered Notice of Intent for the Charlotte County Manager. This letter was signed the County Manager’s assistant to confirm receipt at the time of delivery on February 14, 2018. c. The transmittal letter for the hand-delivered Notice of Intent that was made available for public review at the Charlotte-Mecklenburg Library. This letter was signed by a library attendant to confirm receipt at the time of delivery on February 14, 2018. 3. Photographs of the public notice sign to document that it was posted at the Brownfields Property by today, February 15, 2018. 4. A copy of the relevant page of the Charlotte Observer newspaper documenting that the SNI was published in today’s edition of the newspaper, February 15, 2018. The notification are complete. You are not required to notify the 2 properties beyond I- 277 parcels 12512303 and 07305106, but as you stated on the table you have included them to err on the side of being over inclusive. What is the estimated private estimate for redevelopment with this amendment. In BF Program, we are asked to track as a whole investments spurred by brownfields redevelopment. An estimate to the closest thousand is fine. You may need to forward this request to the PD. Carolyn, In preparation for the start of the public comment period for the Former Goodyear Brownfields Amendment, we propose to send copies of the SNI to each owner of contiguous property as reflected in the attached chart and map. Please let us know if this list is acceptable to you. We intend to have all public comment tasks completed by the proposed February 15th start date. Those tasks are as follows: 1. Publish the approved SNI in a newspaper of general circulation serving the area in which the brownfields property is located, 2. Conspicuously post a copy of the SNI at the brownfields property, 3. Mail or deliver the SNI to each owner of property contiguous to the brownfields property, 4. Provide a copy of the full NI to the local location where it will be available for public review asstated in the SNI, and 5. Provide a copy of the full NI, consisting of the one-page NI and the Amendment NBP andAmendment to the Brownfields Agreement with its exhibits (the survey plat, and the legaldescription), to all local governments having jurisdiction over the brownfields property. Pursuant to NCGS § 130.310.34.(b), the public comment period shall begin following completion of the above tasks. The NI and SNI, with a date filled in representing our belief as to how long itwill take you to complete those tasks by February 15, 2018, are attached hereto. The commentperiod shall not end any sooner than 30 days after you complete the tasks. NCGS § 130.310.34(b) also requires the Prospective Developer to submit documentation of the public notices to DEQ prior to DEQ entering into a Brownfields Agreement. That documentationshall be submitted by promptly providing to me, preferably at Carolyn.minnich@ncdenr.gov or atBrownfields Program, 1646 Mail Service Center, Raleigh, NC 27699-1646, the following: Affidavit of publication of the SNI from the newspaper or a copy of the SNI published in the newspaper which shows the name of the newspaper and the date of publication, Photos of the SNI posted at the site, one close up to show the wording and one far enough to show the posting location relative to the property, Copies of the cover letters and copies of the mailing receipts stamped by the post office or copies of the delivery service receipts for the SNI sent to contiguous property owners, A letter from confirming receipt of the full NI from each local government entity and the entity where the document will be available for viewing.
