PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: 15A North Carolina Administrative Code 13B .1404(a)(2) states: “A 100-foot minimum buffer is required between all property lines and compost areas for Type 3 and 4 facilities, 50-foot for Type 1 or 2 facilities.” During the previous inspection, waste was observed within the required 50-foot buffer to the adjacent property at the northeast corner of the site. Waste was found to be within approximately 20-feet of a steel stake marking the property boundary in this area. Therefore, the Town of North Wilkesboro was found in violation of 15A NCAC 13B .1404(2)(a). During the February 21, 2018 inspection, it appeared that all required buffers were being maintained. Therefore, this violation is considered resolved. 15A North Carolina Administrative Code 13B .1404(2)(3) states: “A 500-foot minimum buffer is required between compost areas and residences or dwellings no owned and occupied by the permittee, except that Type 1 and Small Type 2 and 3 facilities shall have a 200-foot minimum buffer.” FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 During the previous inspection, Waste was observed within the 200-foot buffer to a residence located at 220 Flint Hill Road. Measurements taken on site found the edge of waste to be 127 feet from the residence. Therefore, the Town of North Wilkesboro was found in violation of 15A NCAC 13B .1404(2)(3). During the February 26, 2018 inspection, it appeared that all required buffers were being maintained. Therefore, this violation is considered resolved. 15A North Carolina Administrative Code 13B .1406(6) states: “A site shall only accept those solid wastes that it is permitted to receive.” During the previous inspection, a stockpile of construction and demolition waste was observed on the south side of the ground material on site. Wastes observed consisted of pallets, plywood, PVC pipe, carpet, painted wood, vinyl flooring, and vinyl siding. Therefore, the Town of North Wilkesboro was found in violation of 15A NCAC 13B .1406(6). Inspection of the facility on February 26, 2018 found no unacceptable waste steams on site. Therefore, this violation is considered resolved. OBSERVED VIOLATIONS: None ADDITIONAL COMMENTS 1. This facility is approved for the acceptance of untreated and unpainted wood, silviculture waste, yard trash, and yard waste. The annual renewal form submitted on June 26, 2017 indicated that only tree limbs, and brush/shrubs are accepted on site. 2. A gate is provided at the entrance of the facility to prevent unauthorized access. 3. Only a small amount of unprocessed wood waste was on site at the time of inspection. Majority of the material was located along the far southern perimeter. 4. No unprocessed leaves or grass was observed on site at the time of inspection. 5. No unacceptable waste streams were observed on site at the time of inspection. 6. No objectionable odors were observed. 7. The road leading into the site was of all-weather construction and well maintained. 8. During the previous inspection, it was noted that two separate Notified Yard Waste Facilities had been approved for the property. However, the facility now only operates YWN-97-002 and is the sole operation on site. 9. Although soils were very wet at the time of the inspection due to recent rains, only minimal ponding was observed. Once soils dry, any areas of standing water should be regraded to prevent future ponding. 10. It appeared that good access provided around material to allow for access by firefighting equipment. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
