STATUS OF PAST NOTED VIOLATIONS:
15A NCAC 13B .0841 (e) states: “Each detention and treatment facility shall be designed, constructed, and maintained in
such a manner as to:
(1) Prevent leaks or the flow of septage out of the facility into the seasonally high water table, onto the
ground surface, or into any surface waters;”
On July 27, 2017, Gann Brothers Septic Tank Service, Inc. was in violation of 15A NCAC 13B .0841 (e) because an
overflow from possible overfilling out of a hole in the top was observed.
On November 14, 2017, Gann Brothers Septic Tank Service, Inc. continued to be in violation of 15A NCAC 13B .0841
(e) because an overflow from possible overfilling out of a hole in the top was observed.
The violations is not resolved. In order to come into compliance, Gann Brothers Septic Tank Service, Inc. must
immediately take action to prevent the over flow of waste. Failure to take these steps may result in additional
enforcement action with civil penalties.

ADDITIONAL COMMENTS
1. The Septage Detention and Treatment facility (SDTF) consisted of two 15,000-gallon and one 10,000-gallon
above ground gravity fed tanks for storage and treatment of domestic septage and grease trap pumping.
2. Set-back/buffer requirements appear to have been met.
3. Appropriate signage (No Trespassing signs) is posted for the site.
4. All weather roads are maintained for access to the site.
5. The 10,000-gallon tank appeared to be structurally sound; however, a leak from possible overfilling out
of a hole in the top was observed. The tanks must be maintained in a manner where there is no leakage
or overflow.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

6. The 15,000-tank located on the left (looking from the access road) that appeared to be empty. This tank was
previously observed with septage leaking out of the bottom of the tank. No leakage was observed.
7. The 15,000-tank located on the right (looking from the access road) has been previously repaired and no leaks
were observed
8. Vegetation had been cleared to allow for access to the tanks.
