Box 84 Vale, NC 28168 PARTICIPANTS: Troy Harrison, NC Solid Waste Section STATUS OF PERMIT: Active Issued: 3/18/2014 Expires: 3/18/2019 PURPOSE OF SITE VISIT: Routine Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: 15A NCAC 13B .0841 (e) states in part: “Each detention and treatment facility shall be designed, constructed, and maintained in such a manner as to: (1) Prevent leaks or the flow of septage out of the facility into the seasonally high water table, onto the ground surface, or into any surface waters;” On January 24, 2018, Dennis Hoyle Services was in violation of 15A NCAC 13B .0841 (c) because the 10,000-gallon tank observed to have multiple holes and extensive rust damage with evidence of a past leaks on the side. In order to come into compliance, Dennis Hoyle Services must immediately cease use of the tank and remove all waste from the 10,000-gallon tank. The Septage Detention and Treatment facility (SDTF) consisted of one 4,000-gallon, one 8,000-gallon, one 10,000-gallon and one 12,000-gallon tank for a total capacity of 34,000 gallons. These tanks are above ground and shall be used for the storage of domestic septage (including portable toilet waste) and grease trap septage. 2. There was also a 20,000 gallon tank on site that is listed on the permit to be added in the future and was observed not in use. This tank shall not be used for septage detention until placed in position, inspected by the Solid Waste Section and found to be in compliance. 3. Set-back/buffer requirements appear to have been met. 4. The “No Trespassing” sign needs replacing. 5. All weather roads are maintained for access to the site. 6. The 4,000-gallon, 8,000-gallon and 12,000 tanks appeared to be structurally sound and well maintained. The 10,000-gallon tank was observed to have multiple open holes and extensive rust damage with evidence of a previous leaks on the side. Tanks that have any area below the entrance where leaks may occur cannot be used and must be emptied. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. No odors observed in the area of the detention and treatment area.
