Facility is a closed, unlined sanitary landfill that entered the post-closure period on May 6, 1991. A partial history The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 of the site is as follows: o Sanitary landfill operations began in 1976, and the facility accepted waste until 1988. o On 10/5/1989 and 12/7/1989, Solid Waste Section (SWS) staff determined that the sanitary landfill had been properly closed, with the exception of a 2.07-acre area that had been used as a demolition landfill. o On 1/2/1990, the SWS issued a letter approving the continued operation of a demolition landfill on the site until such time as the final grades for the landfill were reached. o On 2/28/1991, proper final cover of the demolition landfill area was verified by the SWS. o On 5/6/1991, a closure letter was issued for the entire sanitary landfill site. o On 12/7/1992, an approval letter was issued by the SWS to the City of Winston-Salem for the operation of a new, permitted demolition landfill (Permit #34-90-07) at the site, until such time as final grades for the landfill were achieved. o On 5/25/1994, an LCID notification was recorded in the Forsyth County Register of Deeds (Book 1825, Page 1095, 1096) for an LCID landfill contiguous to the closed sanitary and demolition landfill units at the site. o On 3/2/2010, a notice of closure for the notified LCID landfill was recorded in the Forsyth County Register of Deeds (Book RE 2935, Page 270). 2. The facility includes a paved area used as an impoundment lot for abandoned vehicles by the City of Winston- Salem. 3. Ground water and landfill gas monitoring are not part of the facility’s post-closure operations. However, Mr. Rickett explained that monitoring ports had been installed on several old landfill gas vents when an office trailer had been staged at the impoundment lot for staff to use when working at the lot. He stated that he was unaware of any results of a monitoring program, as conducting any sampling events and maintaining any records would be the purview of the Streets Department. 4. The facility is protected by a perimeter chain link fence and two locking gates. The impoundment lot is fenced separately and is also secured by a locking gate. 5. Edge-of-waste markers were observed around the perimeter of the landfill. Mr. Rickett stated that the waste disposal boundary had been identified in 2009 by extensive hand-auguring, so that edge-of-waste markers could be installed as required. 6. A gravel access road extends from the landfill entry gate around the northern slope of the landfill for approximately 750’. The remainder of the landfill is accessible by foot. 7. No ponding water was observed at the facility. 8. The top of the landfill cap is covered with thick, well-established vegetation. The northern, western and southern slopes of the landfill are largely tree-covered, with some trees also established in small, isolated clumps along the eastern slope. Many of the trees observed to be growing on the landfill slopes were young, with diameters of less than 6”. Mr. Rickett stated that the landfill had not been bush hogged since 2009, when the auguring and installation of edge-of-waste markers took place. He added that much of the tree growth had occurred since that time. 9. After closure of a solid waste disposal site, it is the responsibility of the owner to undertake any maintenance necessary to protect the integrity and effectiveness of the cap, as specified in 15A NCAC 13B .0510(c). Preventing and removing woody vegetation is necessary to facilitate a complete and thorough inspection of the landfill cap and to assess the need for repairs. Please ensure that the landfill cap is inspected regularly and repaired as necessary. 10. Trees and fallen leaves inhibited the inspection of the landfill cap. However, some indications that erosion had begun to take place were observed along the landfill slopes. Please perform maintenance to stabilize the landfill slopes where erosion has begun to occur. Woody vegetation makes it difficult to assess the extent of any damage to the landfill cap.
