ADDITIONAL COMMENTS
On January 25, 2018, John Patrone met with Kevin Lindley to conduct a post closure inspection of the Orange County
[Unlined] MSW and C&D Landfills - Closed on Eubanks Road in Chapel Hill, Orange County.
1. The closed unlined municipal solid waste (MSW) and construction and demolition debris (C&D) landfills are
referred to as the north landfill units.
2. The north landfill units are located across Eubanks Road from the Orange County regional [lined] MSW landfill
- closed, referred to as the south landfill unit, and adjacent to the Orange County [active] C&D landfill (68-04).
3. The facility is in contact with the SWS - Permitting Branch regarding a closure permit for the three closed landfills
(the south MSW landfill has closed since the PTO was issued).
4. The (unlined) MSW landfill closed in 1999 and the C&D landfill closed in 2006.
5. The facility maintains semiannual groundwater and surface water test records collected by Sherrill
Environmental, Inc., analyzed by Environmental Conservation Laboratories, Inc. (ENCO), and submitted by
Draper Aden Associates. Records were observed for May 30&31, 2017, November 15&16, 2016, May 18&19,
2016, November 10&11, 2015, and May 12&13, 2015. An exceedance is noted for each monitoring event. Mr.
Lindley stated that semiannual testing was conducted in mid-November 2017, results pending.
6. The facility obtains groundwater samples from 14 monitoring wells at the north landfill units.
7. The closed north MSW landfill is required to inject potassium permanganate into two wells to reduce the amount
of volatile organic compounds (VOCs) per its corrective action plan (CAP). The status of the CAP is active but
the results are being reviewed and evaluated by the SWS to determine if ongoing remedial measures are still
required.
8. The facility also conducts tests for Appendix II identified constituents.
9. The facility maintains quarterly methane monitoring records. Methane monitoring is conducted by facility
personnel at methane wells and in structures. Monitoring records were observed for first, second, third, and fourth
quarters 2015, 2016, and 2017. No exceedance of the methane LEL is noted.
10. Mr. Lindley stated that the facility uses a Gas Data LMSx gas analyzer and that it was calibrated on October 26,
2017.
11. The closed north MSW landfill has landfill gas (LFG) extraction wells that are piped to the landfill gas collection
and control (LFGCC) system located at the south MSW landfill unit.
12. The facility monitors 17 LFG wells at the north landfill units.
13. Landfill edge of waste markers have been installed (white posts).
14. The facility has added soil to two areas of the closed MSW landfill cap. Mr. Lindley stated that the soil will be
graded accordingly and sown with grass seed in the coming weeks.
15. The landfill cap contains native vegetation and is mowed annually or when necessary.
16. There was no indication of erosion or runoff.
17. The facility has all-weather access roads.
18. The facility is secured by a locked gate.
19. Facility signage is posted at the scale house/entrance to the closed south landfill unit.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
