Pursuant to 15A NCAC 13B .0201(c) and .0206(a) a complete permit review request including updated Facility, Operations, and Waste Screening Plans was due on or before 21 March 2014. PURPOSE OF SITE VISIT: Partial Facility Compliance Inspection without records review STATUS OF PAST NOTED VIOLATIONS: 1) 15A NCAC 13B .0542 (a) states “The owner or operator of a C&DLF unit must maintain and operate the facility in accordance with the operation plan prepared in accordance with this Rule.” -C&D LANDFILL, INC. CONSTRUCTION AND DEMOLITION DEBRIS (C&D) LANDFILL PERMIT NO. 74-07-CDLF-2009 ATTACHMENT 1 PART IV: GENERAL CONDITIONS (6) states “Construction and operation of this solid waste management facility must be in accordance with the Solid Waste Management Rules, 15A NCAC 13B, Article 9 of Chapter 130A of the North Carolina General Statutes (NCGS 130A-290, et seq.), the conditions contained in this permit; and the approved plan.” -C&D LANDFILL, INC. CONSTRUCTION AND DEMOLITION DEBRIS (C&D) LANDFILL PERMIT NO. 74-07-CDLF-2009 ATTACHMENT 2 PART I: FACILITY SPECIFIC CONDITIONS (18) states “All required sedimentation and erosion control measures must be installed and operable to FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 7407_INSP_20180124 Page 2 of 5 mitigate excessive on-site erosion and to prevent silt from leaving the area of the landfill unit during the service life of the facility.” -C&D LANDFILL, INC. CONSTRUCTION AND DEMOLITION DEBRIS (C&D) LANDFILL PERMIT NO. 74-07-CDLF-2009 ATTACHMENT 3 PART I: OPERATING CONDITIONS (13) states “The use of alternative periodic cover requires approval, prior to implementation, by the Section.” Unresolved. The Facility operator has repaired the landfill cap system by compacting, covering, and grading all Facility sideslopes at a slope not greater than 3:1. However, a groundcover suitable to prevent erosion of the landfill cap system has not yet been established. 2) 15A NCAC 13B .0542 (f)(2) states “…areas which will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, must be covered and stabilized with vegetative ground cover or other stabilizing material.” Unresolved. All inactive areas of the landfill have been compacted, covered, and graded at a slope not greater than 3:1. However, a groundcover suitable to prevent erosion of the landfill cap system has not yet been established. 3) 15A NCAC 13B .0542 (k)(1) states “Adequate sediment control measures consisting of vegetative cover, materials, structures or devices must be utilized to prevent sediment from leaving the C&DLF facility.” Unresolved. A groundcover suitable to prevent erosion of the landfill cap system has not yet been established. 4) 15A NCAC 13B .0542 (k)(3) states “Provisions for a vegetative ground cover sufficient to restrain erosion must be accomplished as directed by appropriate state or local agency upon completion of any phase of C&DLF development consistent with Rule .0543(c)(5) of this Section.” Unresolved. A groundcover suitable to prevent erosion of the landfill cap system has not yet been established. ADDITIONAL COMMENTS: 1) This Facility is a Construction and Demolition Landfill, White Goods Collection, and Scrap Tire Collection facility. 2) This Facility is permitted to receive Construction and Demolition (C&D) waste as defined in 15 NCAC 13B .0532(8); Inert Debris as defined in GS 130A-290 (a)(14); Land-clearing waste as defined in GS 130A-290 (a)(15); Asphalt in accordance with GS 130-294 (m); and regulated-asbestos containing material in accordance with 40 CFR 61 and 15 NCAC 13B .0542 (c). 3) This Facility is permitted to receive the aforementioned wastes generated within a 100-mile radius of the Facility. Counties included in the permitted area are Beaufort, Bertie, Bladen, Camden, Carteret, Chatham, Chowan, Craven, Cumberland, Currituck, Dare, Duplin, Durham, Edgecombe, Franklin, Gates, Granville, Greene, Halifax, Harnett, Hertford, Hyde, Johnston, Jones, Lenoir, Martin, Nash, New Hanover, Northampton, Onslow, Pamlico, Pasquotank, Pender, Perquimans, Pitt, Sampson, Tyrrell, Vance, Wake, Warren, Washington, Wayne, and Wilson Counties. 4) This Facility is currently operating in Phase II. 5) Proper signage including the Facility permit number, accepted waste types, banned or excluded items, hours of operation, and the emergency contact number is posted at the Facility entrance. 6) The hours of operation are Monday through Friday 7:00 AM to 5:00 PM. 7) The Facility is secured by means of a locked gate at the Facility entrance. 8) The entrance to the Facility is well maintained and no windblown debris was noted along the roadway approaching the site. 9) The Facility access road is of all-weather construction and is being maintained in overall good condition. 10) Permanent Edge of Waste Markers are in place around the footprint of the landfill and are being maintained The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. All reviewed wells were readily accessible, properly labeled, and secured with functional locks. 12) Ground vegetative material is being stockpiled in an area adjacent to the northern end of Phase II for use in weekly cover and erosion repair. The stockpile is being maintained with a buffer of 50 feet from all surface water ditches. This ground vegetative material is mixed with soil at a 50/50 ratio and used as cover. 13) The soil cover mix is being properly applied, compacted, and sloped at a slope not greater than 3:1. Weekly cover operations are being conducted as required. 14) The active working area is being maintained in a compact and manageable size. The working area is being covered weekly or when it reaches ½ acre in size. 15) Windblown debris is being well managed. No windblown materials were observed outside of the active working area. 16) The waste type was reviewed; only Construction & Demolition waste was observed and no unpermitted waste streams were noted in the active disposal area during this Facility Compliance Inspection. 17) All outside slopes of Phase II have recently been covered, compacted, and graded at a slope not greater than 3:1. Plans are underway for the seeding and mulching of all repaired/newly graded areas. *As per our conversation, these areas need to be seeded and mulched as soon as possible to establish a groundcover suitable to prevent erosion of your landfill cap system. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 7407_INSP_20180124 Page 4 of 5 18) An area of erosion was observed on the southwest sideslope of Phase II just below the old access road to the top lift (please see the aerial photograph below). *This area should be filled, compacted, and graded at a slope not greater than 3:1 and then seeded and mulched to establish a groundcover suitable to prevent erosion of your landfill cap system. As per our conversation, it is recommended that tracked equipment work vertically on the final cover of the outside slopes to help prevent the channelization of surface waters which leads to erosion of your landfill cap.*Please continue working to cover and grade all outside slopes of Phase I. Once completed, all repaired areas should be seeded and mulched to establish a groundcover suitable to prevent erosion of your landfill cap system. 20) *Continued corrective measures are required as a result of this Facility Compliance Inspection.
