manufacture use the definition as found in 40 CFR 469.12; for electronic crystal manufacture use the definition as found in 40 CFR 469.22; and for cathode
ray tube manufacture use the definition found in 40 CFR 469.31).

Facilities that Incorporate a solvent management plan into the Stormwater Pollution Prevention Plan may so certify, and the requirement for TTO monitoring
may be waived. The solvent management plan shall include a list of the total toxic organic compounds used and the other elements listed in the General
Permit. For those facilities electing to employ the TTO monitoring waiver, the discharger shall sign the following certification statement:
"Based upon my inquiry of the person or persons directly responsible for managing compliance with the permit monitoring requirement for total toxic organics
(TTO), I certify that to the best of my knowledge and belief, no dumping of concentrated toxic organics into the stormwateror areas which are exposed to rainfall or
stormwater runoff has occurred since filing the lest discharge monitoring report. I further certify that this facility is implementing the all the provisions of the
solvent management plan included in the Stormwater Pollution Prevention Plan."

may be waived. The solvent management plan shall include a list of the total toxic organic compounds used and the other elements listed in the General

In accordance with your application for a discharge permit received on September 6, 2017, we are
forwarding herewith the subject certificate of coverage (COC) to discharge under the subject state --
NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
We apologize for the lengthy processing time for this coverage to be issued. We held the application
until General Permit NCG030000 was renewed on November 16, 2017. Since then, our program has
been renewing several other General Permits, and limited resources to handle both these renewals and
other projects has delayed issuance of a new permit.
Please note that the NCG030000 General Permit was recently renewed with no changes for about a
year, and it expires on October 31, 2018. Semi-annual monitoring as outlined in the permit should
continue through that time. Next year we anticipate this general permit to be modified and renewed
for another five years. Typically all permit COCs are renewed automatically once the General Permit
is finalized, unless there are outstanding annual fees. There is no need to reapply for a renewal unless
the Division directs you to do so. Be sure to check our program website for updates and public notice
of proposed renewal actions in 2018.

On November 15, Ousmane Sidibe and I conducted an inspection for the Corning Optical Communications, LLC — Newton
Cable Annex site. They have submitted a Notice of Intent, received September 06, 2017 listing 3 outfalls. One outfall was
verified (active temporary sediment basin connected to city stormwater). The remaining 2 outfalls were not yet
installed. The contractor had mentioned that changes may have been made to the plans. This site is currently under
active construction. Please let me or Ousmane Sidibe know if you have any questions or concerns.

On October 20, 2017, personnel of this office inspected a project located on 1500 Prodelin Drive,
Newton in Catawba County, North Carolina. This inspection was performed to determine
compliance with the General Permit - NCG 010000 to Discharge Stormwater Under The National
Pollutant Discharge Elimination System for Construction Activities (Construction Stormwater
Permit NCG 010000). The inspection revealed a land -disturbing activity of approximately 7 acres
being conducted.

It is our understanding that you and/or your firm are responsible for this land -disturbing activity. The
purpose of this letter is to inform you that this activity was found to be in violation of Construction
Stormwater Permit NCG 010000. If you feel that you are not responsible for the following
violations, please notify this office immediately.
The violations of the Construction Stormwater Permit NCG 010000 that were found are:
1. Failure to implement the erosion and sedimentation control plan. The Permittec must
implement and follow the erosion and sedimentation control plan. The approved erosion and
sedimentation control plan is considered a condition of Construction Stormwater Permit
NCG 010000. NCG 010000 Section III.3) (a)
2. Failure to meet self -inspection and reporting requirements. NCG 010000 Section II. B. 3)
a. A written record of the daily rainfall amounts shall be retained and all records shall
be made available upon request.
b. Erosion and sedimentation control measures shall be inspected to ensure that they are
operating correctly. Inspection records must be maintained for each inspection event
and for each measure. At a minimum, inspection of measures must occur at the
frequency indicated below:
i_ All erosion and sedimentation control measures must be inspected by or
under the direction of the permittee at least once every seven calendar days,
ii. All erosion and sediment control measures must be inspected by or under the
direction of the permittee within 24 hours after any -storm event of greater
than 0.50 inches of rain per 24 hour period.
3. Failure to dewater sediment basin from the surface, NCG 010000 Section II. B. 4)
Sediment basins that have a drainage area of greater than one acre shall have outlet structures
that withdraw water from the surface.
The sediment basin of the project had no riser structure or surface withdrawal device present
as required by the approved plan.
4. Failure to install and maintain BMPs and control measures, NCG 010000 Section III.4)
The permittee must select, install, implement and maintain best management practices
(BMPs) and control measures that minimize pollutants in the discharge to meet the
requirements of this permit.
5. Bypass of stormwater control facilities, NCG 010000 Section IV 3)
Bypass of stormwater control facilities is prohibited except as allowed by permit conditions.

To correct these violations, you must:

approved plan, the SPCA and the implementing rules and Construction Stromwater permit NCG
010000.
Construction Stormwater Permit NCG 010000 Violations
The violations of the Construction Stormwater Permit NCG 010000 cited herein may be referred to
the Director of the Division of Energy, Mineral and Land Resources (Director) for appropriate
enforcement action, including civil penalty assessments for a continuing violation. This Notice
serves as a letter of proposed civil penalty assessment. You have (up to 15) calendar days from
receipt of this Notice by certified mail to cease the violations listed above, and to submit in writing
reasons why the civil penalty should not be assessed.
Accordingly, you are directed to respond to this letter in writing within 15 calendar days of receipt of
this Notice by certified mail. Your response should be sent to this regional office at the letterhead
address and include the following:
1. The date by which the corrective actions listed above have been or will be completed.
2. Rainfall data and self -inspection or self -monitoring records from (October 1, 2017) to
(October 31, 2017)
3. A plan of action to prevent future violations.
4. A plan for restoration of sedimentation'damage.
5. Reasons why a civil penalty should not be assessed.
To Achieve compliance, you must now do the following:
1. Perform weekly inspections and reporting of all measures on site, as required in the approved
plan.
2. Clean out sediment basin and re -install baffles, per the approved plan.
Properly re -install the skimmer, per the approved plan.
4. Allow stormwater to be filtered through the sediment basin, per the approved plan. Do not
pump straight from the basin into stormwater drains.

Pursuant to G.S. 143-215.6A, these violations and"any future violations are subject to a civil penalty
assessment of up to a maximum of $25,000.00 per day for each violation. Your above -mentioned
response to this correspondence, the degree and extent of harm to the environment and the duration
and gravity of the violation(s) will be considered in any civil penalty assessment process that may
occur.
Please be advised that any new land -disturbing activity associated with this project should not begin
until the area presently disturbed is brought into compliance with the SPCA and Construction
Stormwater Permit NCG 010000. When corrective actions are complete, you should notify this
office so that work can be inspected. You should not assume that the project is in compliance with
the SPCA and Construction Stormwater Permit NCG 010000 until we have notified you. After
installation, all erosion control measures must be maintained in proper working order until the site is
completely stabilized.
We solicit your cooperation, and would like to avoid taking further enforcement action. At the same
time, it is your responsibility to understand and comply with the requirements of the SPCA and
Construction Stormwater Permit NCG 010000. Copies of the relevant statute and administrative
rules may be examined at this office or will be sent to you upon request. Should you have questions
concerning this notice or the requirements of the SPCA and Construction Stormwater Permit NCG
010000 please contact either Angela Lee or me at your earliest convenience.
