Lumina Avenue, Wrightsville Beach, NC 28480 Authorizing development in New Hanover County at Banks Channel, 410 and 330 Waynick Blvd., Wrightsville Beach, as requested in the permittee's letter dated received 7/24/09, including the attached workplan drawings (3), all dated 1/12/09 This permit, issued on September 18, 2009 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Boat Ramp 1) Unless specifically altered herein, this minor modification authorizes the installation of a boat ramp and the construction of one approximately 37' and one approximately 60' boat ramp stabilization walls, all as expressly and specifically set forth in the attached permit application aiid -workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (910) 796-7215 for this determination. 2) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work shall cease when the permit expires on December 31, 2012 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Lv Carolina Yacht Club c/o Paul Rhinehart M Permit # 69-09 Page 2 of 2 ADDITIONAL CONDITIONS 3) Excavation and ground disturbing activities above and below the normal high water line shall be limited to that absolutely necessary to establish adequate ramp slope and provide a ramp no greater in size than specified in the attached ',?7orkplan drawings. 4) No sewage, whether treated or unt eatec!, shall > e discharged at any time 7 om any boats using"the boatramp facility. Any sewage disciiarge at the boatramp facility shall be considered atviolation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout 11 the entire existence of the permitted stricture. r. . 5) This minor modification shall be attached to the original of Permit #69-09, which was issued on 6/5/09, and copies of all documents shall be readily available on-site when Division personnel inspect the project for compliance. 6) All conditions and stipulations of the active permit remain in force under this minor modification unless specifically altered herein. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required
