Dear Ms. Karoly:
Pursuant to your correspondence dated February 9, 2007, we are providing the
following supplemental information to facilitate your processing of the 401 Water
Quality Certification.
1. Dare County has elected to place 16.6 acres of wetlands (of the subject 34
acre parcel) under deed restriction to be held by a third party as mitigation
for the impacted 1.66 acres necessary to construct the wastewater treatment
facilities. This 10:1 ratio preservation-type mitigation was accepted and
preferred by the US Army Corps of Engineers, US Fish and Wildlife
Service and Dare County since it abuts the property of the Alligator River
National Wildlife Refuge. The County Attorney, Mr. Robert Outten, has
prepared the necessary paperwork to place the deed restriction into effect, a
copy of which will be provided to your office under separate cover from
Dare County.
2. A stormwater management plan was prepared and submitted to the
NCDWQ Washington Regional Office on February 6, 2007 for review and
approval.
