site for his home. During our visit David Moye flagged the Coastal Wetland, and as discussed on site you are
NOT to clear any vegetation within 30' of the CAMA (pink) flags nor 30' from the waters edge (Zone 1). Any
clearing in these areas would be in violation of the Tar Pamlico Buffer rules as noted in 15A NCAC 02B .0259.
Please also note that NO impervious structure(s) shall impact Zone 2 (31-50'); this would include but not be
limited to: driveway, house, decks, steps to house, and shed.

On January 30, 2004 Mr. Alan Johnson of this office met with you at the site of the proposed
development on David Cox Rd. to discuss the construction of an additional stream/road crossing.
In accordance with our policy regarding avoidance and minimization of impacts to stream/wetlands,
this office questions the need for the additional stream/road crossing that has been proposed. In
addition to the proposed stream crossing, two access points are proposed to the development on the
south side of the stream. Two more access points into the development are shown on the north side of
the stream. In light of the numerous access points, another stream crossing to "connect" the
development does not appear to be necessary.

The purpose of this letter is to notify you that the North Carolina. Wetlands Restoration Program (NCWR.P) is
willing to accept payment for stream impacts associated with the subject project. Please note that the decision by
the NCWRP to accept the mitigation requirements of this project does not assure that this payment will be
approved by the U.S. Army Corps of Engineers and the N.C. Division of Water Quality Wetlands/401 Unit. It is
the responsibility of the applicant to contact these agencies to determine if payment to the NCWRP for impacts
associated with this project is appropriate.
This acceptance is valid for six months from the date of this letter. If we have not received a copy of the issued
404 Permit/401 Certification within this time frame, this acceptance will expire.
Based on the information supplied by you in a letter dated September 9, 2003 the stream and wetlands restoration
that is necessary to satisfy the compensatory mitigation requirements for this project is summarized in the
following table. The maximum amount of mitigation that the NCWRP will accept for this project is also
indicated in this table.

You have our approval, in accordance with the attached conditions (WQC # 3400) to conduct the
following activity at your property located on 7"' Street off Shallotte Boulevard, Brunswick County. This
approval allows you to:
1). Maintenance dredge 1.01 acres (44,100 square feet) of open water area by bucket and barge, and
dispose of approximately 10,000 cubic yards of spoil material on the existing high ground property;
2). Construct a 6' x 375' pier with a 20' x 10' fixed platform and an 8' x 20' floating dock.
This approval is only valid for the purpose and design that you described in your CAMA application and
plans received by the Division of Water Quality (DWQ) on October 24, 2003. After reviewing your
application and plans, we have determined that General Water Quality Certification Number 3400 covers this
activity. This Certification allows you to use your CAMA Permit when the NC Division of Coastal
Management issues it. Please keep in mind that there may be additional Federal, State or Local regulations
applicable to your project, such as (but not limited to) Sediment and Erosion Control, Non-Discharge and
Water Supply Watershed regulations, NPDES Stormwater and Coastal Stormwater. In addition, this
approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your CAMA Major
Permit application received by the Division of Coastal Management on October 21, 2003. If you change
or modify your project, you must notify the Division (DWQ) in writing and you may be required to
send us a new application for a new certification. If the property is sold, the new owner must be given
a copy of the Certification and approval letter and is thereby responsible for complying with all conditions.
If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow
the conditions listed in the attached certification and the additional conditions listed on the
following page:

On October 14, 2003 the NC Division of Water Quality (DWQ) received your application for a
General 401 Water Quality Certification to impact waters for the purpose of shoreline stabilization in
Catawba County of Lake Hickory.
On December 12, 2003 Mr. Alan Johnson met with Mr. Tony Gaines and discussed the project
at the site. Based on their discussion the current plan for stabilizing the shoreline appears to impact
too much of the buffer. Several other alternatives were discussed which would appear to require
less impact to the buffer.
Be aware that impacts to the buffer would need to be minimized, and the buffer would be
required to be restored to the original grade and vegetative cover unless approved by the DWQ.
Until a modified plan is provided, this project will be placed on hold for our processing (15A NCAC
2H .0507(h)).

On behalf of Crosland Land Company, we will follow-up with additional infonnation you
requested regarding the project planning in the very near future.
As indicated the impacts on the project are expected to be very limited. Since the project is a
proposed mixed residential devlopment, we expect the impervious area to exceed 30% in the
multi-family areas of the site. The application proposed stormwater management for these multi-
family areas. Sewer lines are intended to connect to existing trunk sewer lines and are not
expected to impact wetlands, and are expected to be limited to stream crossings. We expect to
plan the layout of sewer lines so as to be below the NCDWQ's notification threshold.
We will make evey effort to provide a more detailed plan for your review.

As discussed, you advised the NWP3 pertained to maintenance of stream corridors. The Riley's
Branch Drainage Improvements design concepts could not be considered maintenance as they
introduced "new" maintenance features.
For those reasons, if I understand you correctly, you proposed the NWP39 in lieu of the NWP3. We
verified the impact calculations for both existing and proposed stabilizatioin efforts. The impacts did
not'exceed the permit conditions. We would like you to continue your permit evaluation with the
NWP3 re-designated as a NWP39.

It is the purpose of this letter to confirm the intent of the State of North Carolina to accept the above
referenced permanent conservation easements for the NC Wetlands Restoration Program (NCWRP).
It is my belief that the 3-M Corporation and the State of North Carolina are in. a good starting position to
move quickly on these two property acquisitions. NCWRP has prior approval by resolution from the Council of
State and the preliminary survey and title information that I have in hand helps to expedite the closing. If the
two of us can coordinate the necessary updated title work and document preparation as discussed in out
telephone conversation, we could potentially close these transactions by the week of February 241°. However,
must be realistic and caution that unforeseen circumstances could delay the closing.
Mr. Ron Ferrell of NCWRP has indicated that the 3-M Corporation will be paying for all expenses
related to this donation.

This is to respond to your letter of 28 June 2002 regarding our project.
The purpose of this project is primarily to stop erosion of wetlands along the
Intracoastal Waterway and on our property. The small outlet to the ICW allows
flow of water to and from the ditch in question. This occurs at changes of tides
or after heavy rainfall and is increasing erosion on the waterway and along the
path of the flow. This is the "flowing water" referred in your letter. We believe
that this opening to the ICW must be closed as it is causing erosion as much a
100 feet inland of the ICW and subsequent loss of wetlands. By filling the
ditch to the level on each side and restoring the saltmarsh vegetation therein,
heavy rains will be dispersed over a larger area and, thus, filter through a larger
area rather than sitting in a continually saturated ditch area or draining through
the opening directly into the ICW. We believe this will also help to buffer
erosion.
As outlined in our application, this project would return the land to its original
wetland condition and encourage more seepage through the soil and into the
water table below.
We would welcome an onsite meeting with anyone you deem appropriate.
However, we will be out of the area during the period of 22 July to 1 August.

subject wetland system's only connection to the canal is the ditch indicated on the drawing. For this reason
I have revised our proposal to reduce the area of impact and provide connection of all residual wetlands to the
existing ditch. I am including the revised drawing that I would like to be considered as our new proposal. I
have also added to this revised drawing a twenty feet wide corridor or allowance for a future pile supported
walk to access the high ground at the rear of lots 189 & 190. In accordance with our discussion, the owner
would also propose to record deed restrictions consistent with the Corps version that we reviewed in your
office. It is also still the owner's desire to provide compensatory mitigation for the 0.20 acres now proposed
for fill.
I can revise my application and full provide a new full scale copy of the drawing if so needed. Please

Dear Michelle,
On July 18th I made a site visit to the Kinston Country Club to make stream determinations for two separate features on
the property. Features one and two are identified on maps provided by NCDWQ.
Feature one is a blue line stream on Kinston USGS topographic quadrangle map. This stream, adjacent to existing tennis
courts, is subject to the Neuse River Riparian Buffer Rules (15A NCAC 02B.0233). No impervious surface should be
constructed within 50 feet of the top of bank of this stream. Streambank stabilization along the stream next to the cart
path adjacent to existing tennis courts is an allowable use under the buffer rules.
Feature two is a ditch that runs into a stream along the eastern border of the property. The stream portion and ditch
section show up as one feature on the soil survey map of Lenoir County. A stream origin was marked at where the
stream and ditch meet. Streambank stabilization is an allowable use under the Neuse Buffer Rules (15A NCAC 02B
.0233) and may be applied to the stream section where the stream makes a 90 degree turn adjacent to the maintenance
shop. Any flow abatement structures (dams etc.) must be placed 50 or more feet upstream of the origin of the stream as
marked by DWQ personnel on 8/6/02.

Staff of the Division of Water Quality have reviewed the width of the subject application for
the proposed water quality impacts to the French Broad River. You are requesting to construct
two whitewater training courses by constructing and placing rock structures in the French Broad
River downstream of Amboy Road adjacent to the French Broad River Park and underneath the 1-
240 bridges at Jean Webb Park. The purpose of this letter is to provide comments and request
additional information listed below:
1. The sketches indicate that structures will be constructed across the width of the river
at both locations and the wording indicates that these structures will be grouted. Since
concrete (due to its pH) is toxic to fish and other aquatic organisms, how will these
structures be grouted and not affect fish and wildlife?
2. There are main MSD of Buncombe County sewer lines and pump station in the vicinity
of the structures at the French Broad River Park. How will these utilities be protected
from damage during construction and from future flooding events? Recommend you
contact the MSD of Buncombe County regarding the location of their sewer lines at
both sites.
3. Do you have a certification from the City of Asheville that these structures will not
result in a no rise situation during flooding events? Please provide a copy of the
certification to this office.
4. The plans and typical details submitted with the application do not include distances,
depths, areas, specifications or scale of the structures relative to the French Broad
River. Please provide typical details that include these types of specifications.

It would be helpful to include material size (size of boulders) as well as orientation,
depths and distances as they relate to the existing channel.
5. A hydrologic, shear stress analysis, sediment transport and /or scour analysis will be
necessary based on the bed and bank materials as well as vegetation and channel
morphology. The most appropriate method of analysis is dependent upon the type of
structure or channel alteration proposed, the bed and bank material, the channel
morphology and existing vegetation as well as the location of the structures in relation
to the existing bed and bank features.
6. The French Broad River is relatively stable and these activities could result in changes
to the hydrology and sediment transport in the river that could result in destabilization
of the streambed and banks. We are concerned that the proposed structures within
the channel could result in a change in the channels' dimension or profile or that there
is an increase in channel depth near the banks. Factors that would influence the
river's response to these changes are channel slope, floodway slope, sinuosity,
channel morphology, bed and bank material, vegetation, sediment supply and bed
rock out crops. At a minimum, this would require the development of a site plan at a
detailed scale that includes the channels morphological features such as the location
of stream banks and existing land contours. The proposed location of each type of
structure or channel alteration should also be shown on the site plan.
7. The proposed structures could affect aquatic life movement. How will these structures
be installed so as to provide aquatic life movement up and down the river?
8. There is some concern regarding the bank terraced seating and vegetation. The
sketch does not provide enough detail on how the vegetation and seating will be
intermixed. Why does this seating have to extend into the water? It appears that
spectator seating could be located higher on the bank away from the water. Because
the proposal is for this to extend below the ordinary high water mark, we have
concerns regarding bank stability. Also, we will need to approve the type of plants to
be used for bank protection. Please provide a list of plants that are proposed to be
used for revegetation.
The information listed above is needed before the Division of Water Quality can issue a
401 Water Quality Certification. Unit this information is received and approved we are placing
this project on hold for our processing purposes due to incomplete information, in accordance

Per your request, Mr. Michael Parker with this Office conducted a site investigation of
the subject property on June 13, 2002 for the purpose of determining whether a 401 Water
Quality Certification will be necessary for the disturbance of at least 150+ feet of a channel (see
attached map). Martin-Marietta, the current property owner, has a prospective buyer who has
indicated a need to fill (pipe) the channel to facilitate site development. Mr. Tamp Bandy with
Wetland and Natural Resource Consultants accompanied Mr. Parker during the investigation.
Based on observations made by Mr. Parker, the channel that is to be impacted does
appear to have the characteristics of a stream under the current guidance used by the Army Corps
of Engineers (ACOE). Furthermore, the channel also appears as an intermittent stream (dotted
blue line) on the current USGS topographic quad map. It should be noted, however, that it is
the ultimate responsibility of the ACOE to determine whether or not the channel to be
impacted is indeed a stream for which they may claim jurisdiction.
Please be advised that the Division of Water Quality (the Division) requires that approval
be obtained prior to disturbing more than 150 linear feet of stream under Nationwide Permit No.
39 and General Certification No. 39. It should also be noted that compensatory mitigation is
required to replace unavoidable lost or degraded aquatic life uses of these streams, either through
in stream measures and/or riparian techniques - such as buffer establishment or vegetative
planting for temperature control (typically referred to as stream bioengineering). In determining
whether stream mitigation will be necessary, the Division must ascertain whether or not aquatic
life requiring continuous water is present. Based on observations by Mr. Parker and Mr. Bandy,
crayfish were found in the channel. The location where aquatic life was observed began at a
point where a large rock vein dissects the channel approximately 200 feet southeast of where the
channel passes under Highway 74. Mr. Bandy also placed flagging at this location. Such being
the case, mitigation will be required by the Division if the channel impacts below this point are
to exceed 150 linear feet in length.

planning to disturb jurisdictional wetlands and/or 150+ linear feet of a stream channel during the
construction of the subject airport apron extension.
Please be advised that the Division of Water Quality (the Division) requires that approval
be obtained prior to disturbing more than 0.1 acre of wetlands and/or 150 linear feet of stream
channel under the current Army Corps of Engineers (ACOE) Nationwide Permits and Division
401 Water Quality Certifications. It should also be noted that it will be the responsibility of the
ACOE to determine whether or not any channel being impacted. is indeed a stream for which they
may claim jurisdiction.
For jurisdictional channel impacts, compensatory mitigation may be required to replace
unavoidable lost or degraded aquatic life uses of these streams, either through in stream measures
and/or riparian techniques-such as buffer establishment or vegetative planting for temperature
control (typically referred to as stream bioengineering). In determining whether a stream
mitigation will be necessary, the Division will need to ascertain whether the stream supports
aquatic activity (such as fish, crayfish, salamanders, etc.,).

In regards to the storm water pipe on your property members of our staff have discussed the situation with our supervisors
to arrive at a couple of options. The pipe can be left as, which we understand is not a desirable option. The other choice is
to extend the pipe up to Zone 11. This is allowable under the Neuse Riparian Buffer Rule as long as diffuse flow of runoff is
achieved before it enters Zone II. Grading and re-vegetating are allowed in Zone II provided that the health of the
vegetation in Zone I is not compromised. A reputable engineering firm might be able to offer guidance and other options
on extending the pipe and achieving diffuse flow.
Your original request to extend the pipe into Zone I is not allowable under the Neuse Riparian Buffer Rule.
