Approval of Storm water Management Plan
Dear Mr. Mulhare:
On November 8, 2005 the Division of Water Quality (DWQ) received the revised storm water management plan
prepared by your engineer, Mr. David Kiker, P.E, ofWK. Dickson Consultants, to comply with the conditions of 401
Water Quality Certification, and Isolated Wetland Permit issued on September 26,2005.
The Plan has been reviewed and satisfies the storm water management conditions of the 401 and Tar- Pamlico River
Basin Buffer Rules as stated. The structural storm water practices as approved by DWQ as well as drainage patters
must be maintained in perpetuity. In addition, you should obtain or otherwise comply with any other required
federal, state or local permits before you go ahead with your proj ect including (but not limited to) Erosion and
Sediment Control, Rules and Non-discharge regulations.
No changes to the structural storm water practices shall be made without written authorization from the Division of
Water Quality. Storm water easements shall be recorded for a distance of at least 10 feet on each side of all storm
water conveyances on all lots containing these structures including future access for maintenance. The storm water
easements shall allow for the ability to maintain the structures, perform corrective actions as described above and
shall provide protection of the structures from potential alternations by future property owners. The authorization to
proceed with your proposed impacts or to conduct impacts to waters as depicted in your application and as
authorized by the Certification shall expire upon expiration of the 404 Permit.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act and the
Tar- Pamlico riparian buffer protection rule as described within 15A NCAC 2B .0258. If you have any questions,

The following checklist outlines design requirements per the Stormwater Best Management Practices Manual. Initial in the space
provided to indicate the following design requirements have been met and supporting documentation is attached. If a requirement has
not been met, attach an explanation of why. At a minimum, a complete stormwater management plan submittal includes a worksheet for
each BMP, design calculations, plans and specifications showing all BMPs and outlet structure details, a detailed drainage plan and a
fully executed operation and maintenance agreement. An incomplete submittal package will result in a request for additional information
and will substantially delay final review and approval of the project

INSPECTION AND MAINTENANCE AGREEMENTS

This section of inspection and maintenance agreement pertains to the extended detention wetlands and wet
ponds at the following locations:
Focus Area #7 - Residential Area#3
Engineered/Grass Swale Maintenance activities shall be performed as follows:
General Maintenance (in addition to significant runoff producing rainfall events)
1. Vegetation & Repair - The swale has a ground cover of fescue, which if properly maintained will
prevent erosion and provide an easy surface for inspection. Grass should be fertilized every October and
April.
· Re-Seeding (when needed) - annually re-seeding may be required to establish grass on areas
where seed did not take or has been destroyed. Before seeding, fertilizer (12-12-12) should
be applied at a minimum rate of 12 to 15 pounds per 1,000 SF. The seed should be evenly
sewn at a rate of three pounds per 1,000 SF. The seed should be covered with soil to the
depth of approximately Y4". Immediately following the planting, the area should be mulched
with straw.
2. Establishment Period - During the establishment period, check grass-lined channels after every
rainfall. After grass is established, periodically check the channel; check it after every heavy rainfall
event. Immediately make repairs. It is particularly important to check the channel outlet and all road
crossings for bank stability and evidence of piping or scour holes. Keep the grass in a healthy, vigorous
condition at all times, since it is the primary erosion protection for the channel.
3. Mowing - grass mowing, brush cutting and removal of weed vegetation will be necessary for the
proper maintenance of the swale and should be mowed at a minimum of twice annually. Acceptable
methods include the use of weed whips or power brush cutters and mowers.
4. Erosion - Erosion occurs when the water concentrates causing failure of the vegetation or when
vegetation dies and sets up the environment for rill erosion and eventually gullies from the stormwater
runoff. The swale should be inspected for these areas. Proper care of vegetative areas that develop
erosion is required to prevent more serious damage to the swale. Rills and gullies should be filled with
suitable soil compacted and then seeded. Methods described in Section I-A, on vegetation, should be
used to properly establish the grass surface. Where eroded areas are detected, the cause of the
erosion should be addressed to prevent a continued maintenance problem.
5. Remove all significant sediment accumulation to maintain the designed carrying capacity.

The wetland detention basin system is defined as the wetland detention basin, pretreatment including forebays
and the vegetated filter if one is provided.
Maintenance activities shall be performed as follows:
1. After every significant runoff producing rainfall event and at least monthly:

a. Inspect the wetland detention basin system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within
2 to 5 days as designed.
2. Repair eroded areas immediately, re-seed as necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed.
3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain
proper functioning.
4. Remove accumulated sediment from the wetland detention basin system semi-annually or when depth is
reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of
in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e.
stockpiling near a wetland detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments.
When the permanent pool depth reads feet in the main pond, the sediment shall be removed. If
the elevations of the marsh areas exceed the permanent pool elevation, the sediment should be removed
to design levels. This shall be performed by removing the upper 6 inches of soil and stockpiling it. Then the
marsh area shall be excavated six inches below design elevations. Afterwards the stockpiled soil should be
spread over the marsh surface. The soil should not be stockpiled for more than two weeks.]

5. Remove cattails and other indigenous wetland plants when they cover 50% of the basin surface. These
plants shall be encouraged to grow along the vegetated shelf and forebay berm. Wetland planting densities
in the marsh areas should be maintained by replanting bare areas as needed. Wetland plants should be
encouraged to grow in the marsh areas.
6. Mowing - grass mowing, brush cutting and removal of weed vegetation will be necessary for the proper
maintenance of the wetland/pond and should be mowed at a minimum of four times a year. Acceptable
methods include the use of weed whips or power brush cutters and mowers.
7. If the basin must be drained for an emergency or to perform maintenance, the flushing of sediment through
the emergency drain shall be minimized to the maximum extent practical.
8. All components of the wet [wetland] detention basin system shall be maintained in good working order.
9. Level spreaders or other structures that provide diffuse flow shall be maintained every six months. All
accumulated sediment and debris shall be removed from the structure, and a level elevation shall be
maintained across the entire flow spreading structure. Any down gradient erosion must be repaired and/or
replanted as necessary.

Bioretention
This section of inspection and maintenance agreement pertains to the extended detention wetlands and wet
ponds at the following locations:
Focus Area #3 - Multi-Family Area#4
Maintenance activities shall be performed as follows:
1. Maintenance of Earthen Containment Embankment
A. The earthen embankment shall at all times maintain a thick, healthy grass cover which is free of brush.
This type of cover, if properly maintained, will prevent erosion of the embankment and provide an easy
surface for inspection. Grass shall be properly fertilized every October and April (or as required) to
ensure that a substantial stand of grass is continuously present.
B. Grass mowing, brush cutting, and removal of weed vegetation will be necessary to the proper
maintenance of the embankment. The embankment slopes and emergency spillway area if applicable
shall be mowed when the grass exceeds eight inches (8") in height. Acceptable methods include use of
mowers, power brush cutters and weed whips.
C. Re-seeding: The embankment shall be periodically (at least once a year) limed, fertilized and shall be re-
seeded each fall. Consult the North Carolina State Cooperative Extension Services or the Soil and
Water Conservation District Office to determine precise lime and fertilizer requirements.
D. Trees and other unwanted woody vegetation shall not be allowed to grow on the earthen embankment.
Any vegetation which inhibits proper operation of the facility shall be removed.
E. All erosion gullies which form between maintenance operations shall be backfilled with topsoil material,
re-seeded and mulched properly until new vegetation is established. This is necessary to ensure that
such areas do not evolve into more serious damage situations.
F. All bare areas and pathways on the embankment shall, continuously as they occur, be properly re-
seeded and mulched to prevent further erosion.
G. During the regular quarterly inspection, the entire embankment shall also be inspected for cracks or
sloughing. Short, isolated cracks are usually not significant and can be repaired like erosion gullies;
however, larger cracks (wider than 1/4 inch), well defined, longer cracks, or large sloughed areas
indicate a serious problem. Should any such signs occur or be noticed, an experienced engineer must
be consulted and retained in order to ascertain cause of damage and prepare repair plans. Such repairs
shall be carried out immediately.
2. Maintenance of the Flow Control Structure:

A. The Flow Control Structure is a specially designed inlet structure. All concrete and/or block portions of
the structure shall be inspected during the regular quarterly inspection for signs of cracking or
deterioration. Cracks shall be considered significant if they exceed 1/8" in width. Minor needed
repairs shall be made immediately upon notice of damage, Once every six months, the interior of the
structure and all inlet and outlet conduits shall be inspected for signs of damage, leakage and/or
misalignment. Should any such signs occur or significant cracking and/or deterioration be noticed, an
experienced engineer must be consulted and retained in order to ascertain cause of damage and
prepare repair plans. Such repairs shall be carried out immediately. This structure and all inlet/outlet
conduits shall be kept clear of debris and shall not be allowed to serve as permanent shelter for
animals which may introduce such debris.
B. The weir crest areas shall be kept free of debris.
3. Maintenance of Inflow and Outflow Points:
A. All riprap armoring shall be kept clear of debris and unwanted vegetation. Riprap material shall be
replenished as needed to control erosion.
4. Maintenance of Planting Soil Area:
A. On a monthly basis, inspect and repair any eroded areas. Keep area clear of accumulated debris.
B. Once per year test for pH. Add limestone as required to maintain a pH range between 5.5 - 6.5 at
least once per year.
C. Replenish mulch as specified in project manual no less than once every six months.
5. Plant Materials:
A. Remove and replace all dead and diseased vegetation considered beyond treatment. Perform this
task twice per year between March 15 and April 30, and October 1 and November 30.
B. Treat all diseased trees and shrubs as needed. Replace dead or nonrecoverable diseased plants with
like kind as near to size as possible.

Dear Mr. Aghimien:
On behalf of the Ford's Colony at Rocky Mount development, WK Dickson is requesting approval on
the final design plans for the Focus Area #8 wet pond referred to as the South Pond. We have
attached a design spreadsheet, a DWQ worksheet, a stormwater/grading plan, and a signed and
notarized maintenance and inspection agreement. Per our November 7, 2005 telephone
conversation, a review fee has not been included with this submittal because this request follows up
on the previous Ford's Colony (overall development) 401 permit application that required a review
fee.
The conceptual design of this pond was reviewed and approved by DWQ as part of the overall
development plan. A copy of this approval letter is attached with this letter for your reference. The
following is a summary for the wet pond design parameters:
Drainage Area - 48.13 acres.
Impervious Area - 14.87 acres.
Impervious % - 30.9
Minimum Required Surface Area - 28,513 square feet.
Minimum Required Reservoir Volume (permanent pool) - 87,279 cubic feet.
Minimum Required Forebay Volume - 16,915 cubic feet (20% of minimum required reservoir
volume).
Provided (proposed) Surface Area - 28,586 square feet.
Provided (proposed) Reservoir Volume (permanent pool) - 87,503 cubic feet.
Provided (proposed) Forebay Volume - 16,958 cubic feet.
WK Dickson is requesting a waiver for the required forebay volume at the Sound Pond in Focus Area
#8. We feel that the proposed Sound Pond should exceed minimum design standards for a wet pond.
The subject forebay has been designed to be approximately 20% of the minimum reservoir volume
needed to meet Division of Water Quality (DWQ) requirements for a wet pond. The minimum
reservoir volume was determined based on the percent imperviousness of the upstream drainage area

The reservoir or aft bay of the pond was enlarged beyond the minimum required size to meet City of

Approval of Storm water Management Plan
Dear Mr. Mulhare:
On October 21,2005 the Division of Water Quality (DWQ) received the revised storm water management plan
prepared by your engineer, Mr. David Kiker, P .E, of WK Dicks.on Consultants, to comply with the conditions of 40 1
Water Quality Certification, and Isolated Wetland Permit issued on September 26,2005.
The Plan has been reviewed and satisfies the storm water management conditions of the 401 and Tar- Pamlico River
Basin Buffer Rules as stated. The structural storm water practices as approved by DWQ as well as drainage patters
must be maintained in perpetuity. In addition, you should obtain or otherwise comply with any other required
federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and
Sediment Control, Rules and Non-discharge regulations.
No changes to the structural storm water practices shall be made without written authorization from the Division of
Water Quality. Storm water easements shall be recorded for a distance of at least 10 feet on each side of all storm
water conveyances on all lots containing these structures including future access for maintenance. The storm water
easements shall allow for the ability to maintain the structures, perform corrective actions as described above and
shall provide protection of the structures from potential alternations by future property owners. The authorization to
proceed with your proposed impacts or to conduct impacts to waters as depicted in your application and as
authorized by the Certification shall expire upon expiration of the 404 Permit.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act and the
Tar- Pamlico riparian buffer protection rule as described within 15A NCAC 2B .0258. If you have any questions,

Sequence of Construction
Construction entrances will be stabilized. All sediment and erosion control devices will be installed.
The site of the pond. embankment. and emergency spillway will be cleared and grubbed.
The emergency spillway will be excavated and formed. top soil will be spread on the spillway. and it
will be seeded. Straw and jute net wnl be applied and the spillway wnl be watered to initiate grass growth.
A trench will be excavated for the primary spillway. The 15- spillway conduit. anti-seep collars. riser
drain. and outfalls will be constructed. The trench will be back filled.
The pond will be excavated and the embankment and forebay berm wnl be built from suitable materials.
The level spreader and foreboy drain will be constructed.
Place topsoil. seed. and mulch above permanent pool elevation.
Trenches will be excavated for storm drain systems. Pipes and structures will be installed. Trenches
will be backfilled. Fill will be placed and compacted os necessary to cover pipes and structures.
Place topsoil. seed and mulch in disturbed areas as necessary.
When site is stable. remove erosion controls. remove stobUized construction entrances. and seed and
mulch for final stabilization of all remaining disturbed areas.

Sequence of Construction
1. Construction entrances will be stabilized. All sediment and erosion control devices wRl be Installed.
The site of the pond, embankment, and emergency spillway will be cleared and grubbed.
2. The emergency spillway will be excavated and formed, top soil will be spread on the spRlway, and it
will be seeded. Strow and ).Ite net wRl be applied and the spillway wOl be watered to initiate gross growth.
3. A trench wOl be excavated for the primary sp 01 way. The 15- spillway conduit, anti-seep collars, riser
drain, and outfalls will be constructed. The trench will be back filled.
4. The pond will be excavated and the embankment and forebay berm will be built from suitable materials.
The level spreader and forebay drain will be constructed.
5. Place topsoil, seed, and mulch above permanent pool elevation.
6. Trenches wnl be excavated for storm drain systems. Pipes and structures will be Installed. Trenches
wnl be backfilled. Fill will be placed and compacted as necessary to cover pipes and structures.
Place topsoil, seed and mulch in disturbed areas as necessary.
7. When site is stable, remove erosion controls, remove stabilized construction entrances, and seed and
mulch for final stabilization of all remaining disturbed areas.
