After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2665. This certification allows you to use Nationwide Permit Number 13 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. State Park DATE: June 7, 1996 SUBJECT: East Prong Roaring River Stream Bank Stabilization PY 960585 i i JLN ?y FTL KS SF(711 !weTF4 ,»,.. - - Joe Enclosed is a 404 permit application for work in the East Prong Roaring River located in Stone Mountain State Park. We have identified four sites totaling 330 linear feet of stream bank that are in serious need of stabilization with large boulders (riprap) and/or root wads. It is anticipated that less than one-third acre of flowing waters will be impacted by the project. Sites 1 and 2 on the plan have the potential to erode to the park road in the near future. Plans are to use riprap as the main method of stabilization due to the height of the eroding banks (some 10-12 feet high). Root wads will be incorporated into the plan where feasible. Materials for the project will be supplied by NCDOT as they become available during the construction of SR 1100 (Oklahoma Road). We would like to have approval for this project as soon as possible since NCDOT will begin work on the Oklahoma Road within the next week and will be able to deliver materials to the project sites once construction begins. Region Coordinator Habitat Conservation Section DATE: June 7, 1996 SUBJECT: Review of an application by Stone Mountain State Park to stabilize eroding stream banks at 4 sites on the East Prong Roaring River, Wilkes County. Stone Mountain State Park is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of Engineers. The NCWRC has reviewed information provided by the applicant, conducted a site visit on May 29, 1996, and our field biologists have developed the plan submitted by State Parks. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The applicant proposes to stabilize eroding stream banks at four locations totaling 330 linear feet. Large boulders (riprap) supplied by the North Carolina Department of Transportation (NCDOT) taken from the Oklahoma Road (SRI 100) construction project will be used to stabilize the eroding banks. Where applicable, root wads will also be used to provide additional bank stability and fish habitat. The East Prong Roaring River in Stone Mountain State Park is Designated Public Mountain Trout Water managed as Delayed Harvest. The project has the potential to reduce bank erosion and sedimentation, thereby, improving trout habitat. Based on the information provided by the applicant and the fact that our biologists are proponents of the project, we have no objection to the project as proposed. However, construction will be prohibited during the brown and rainbow trout spawning period of October 15 through April 15 in order to protect the egg and fry stages from sedimentation. It should be noted that the site was visited by Beth Morton and Allan Smith with the Division of Environmental Management, Winston-Salem Regional Office on May 29, 1996, at which time they expressed no objection to the project as proposed Thank you for the opportunity to review and comment on this project.
