In accordance with your request, Certificate of Coverage Number NCGNE0223 is rescinded effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of*stormwater to waters of the State without valid coverage under an NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. If the facility is in the process of being sold, you will be performing a public service if you would inform the new or prospective owners of their potential need for NPDES permit coverage. The No -Exposure Certifications no longer -will have an expiration date. Previously your no -exposure exclusion had to be re -certified with the Division every 5 years. Mr. Philip Henson (Project Manager) and Ms. Josephine Jarrett (Plant Manager) represented the Facility during the inspection. 158 people are employed at the Facility where cotton is processed into yarn. Findings during the inspection are as follows: The entire property, exterior to the Facility, including the roof, was evaluated during this inspection. There was no evidence of spills, overflows or similar incidents anywhere on the site including the stormwater discharge outfalls. No vehicle maintenance takes place on site with the exception of a forklift. Maintenance of the forklift takes place inside a shop area. An awning covers the area where dry cotton plant leaf pulp is transferred from within the building into trailers. Cotton bales are off-loaded from trucks into the building under an awning. A dumpster for the disposal of baling wire is covered by an awning. Facility refuse is compacted into an enclosed container located directly adjacent to the building. Empty drums of tint are triple -rinsed and drained to a specially designed sanitary sewer system drain exterior to the building. (Method of residuals disposal complies with MSDS.) Preliminarily, it is my opinion that the No -Exposure Stormwater Certification should be granted for this facility. However, prior to making my final recommendation, I would be interested in knowing how refuse dumpsters (in this case an enclosed container that is part of a compaction system) have affected the issuance of such certifications.
