POND MAINT~NANCE REQUIREMENTS
I. Monthly, or after every runoff producing rainfall event, whichever comes first:
A. Inspect the trash rack; remove accumulated debris, repair/replace if it
is not functioning.
B. Inspect and clear the oriface of any obstructions.
C, Inspect the pond side slopes and grassed inlet swales; remove trash,
and repair eroded areas before the next rainfall event.
D. Pond inlet pipes will be checked for undercutting, rip rap or other
energy dissipation structures will be replaced, and broken pipes will
be repaired.
II. Semi-annually:
A. Accumulated ~ediment from the bottom of the outlet structure will be
removed.
B. The pond depth will be checked at various points. If depth is reduced
to 75% of original design depth or 3 fee~ whichever is greater, sediment
will be removed to at least the original design depth.
III. General:
A. Moving of the side slopes will be accomplished according to the season.
Maximum grass height will be 6".
B. Cattails are encouraged along the pond perimeter; however, they will be
removed when they cover more than 1/2 the surface area of the pond.
C. The oriface is designed to draw down the pond in 2-5 days. If drawdown
is not accomplished in that time, the system will be checked for clogging.
The source of the clogging will be found and eliminated.
D. All components of the detention pond system will be kept in good working
order. Repair or replacement components will meet the original design
specifications as per the approved stormwater plan. If previously
approved components are determined to be ineffective, the component
must be redesigned and/or replaced.
NOTE:
1) Pond may be accessed for maintenance along the drainage easement for the
48 inch culvert from the street.
2) If the pond needs to be drained, the volume below the normal pool will
have to be pumped out.

You have our approval to place fill material in an additional 0,16 acres of wetlands or waters for
the purpose of constructing two road crossings at Sunset Ridge Phase SC, as you described in your
application dated 13 February 1996. After revie\\ing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2671. This certification allows you to use
Nationwide Permit Number 26 when it is issued by the Corps of Engineers, This certification replaces
one issued on 26 February 1996 due to an incorrect address,
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. For this
approval to be valid, you must follow the conditions listed in the attached certification. Deed
restrictions shall be added to all lots with jurisdictional wetlands to prevent future wetland fill. In
addition, you should get any other federal, state or local permits before you go ahead with your projecL
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send
a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Offi~
of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.

Reference your application of February 1, 1995, submitted on your behalf
by Soil & Environmental Consuli:ants, Inc., for Department of the Army
, authorization to discha::ge fill m<,terial within \'laters of the united States,
adversely impacting a total of 0.57 acre of wetlands (0.02 for utility lines
and 0,55 acre for other fill) on your property. Specifically, the project is
known as Sunset Ridge Subdivision, located on the south side of Holly Springs
Road, east of Bass Lake Road and adjacent to Middle Creek, in Holly Springs,
Wake County, North Carolina.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization was
provided, pursuant to Section 404 of the Clean Water Act, for discharges of
dredged or fill material into headwaters and isolated waters. Authorization
was also provided for the discharge of material for backfill or bedding for
utility lines, including outfall and intake structures, provided there is no
change in pre-construction contours.
Your work is authorized by these nationwide permits provided it is
accomplished in strict accordance with the enclosed conditions and Drovided
you receive a Section 401 water quality certification from the North Carolina
Division of Environmental Manaqement (NCDEM). You should contact Mr. John
Dorney, teleDhone (919) 733-1786, to resolve the concerns his office has
expressed, in order to obtain the required water quality certification. Be
advised that NCDEM's authorization may impose stricter requirements than this
nationwide Dermit aDDroval; in this case, the more restrictive authorization
must be adhered to. These nationwide permits do not relieve you of the
responsibility to obtain other required State or local approval.
This verification will be valid until these nationwide permits are
modified, reissued or revoked, which will occur no later than January 21,
1997, It is incumbent upon you to remain informed of changes to the
nationwide permits, which will be announced by public notice when they occur.
If you commence or are under contract to commence this activity before the
date the nationwide permit is modified or revoked, you will have twelve months
from the date of the modification or revocation to complete the activity under
the present terms and conditions of these nationwide permits. There may be
other required State or local approvals for which you are also responsible,
Please note that this work, most of which is already completed, is
associated with Phase V of your subdivision. Previously authorized impacts
for the subdivision and Devil's Ridge golf course were 0.51 acre for road

impacts resulting from construction of the project are currently 3.91 acres.
Your partnership is in the process of acquiring additional property which
includes waters of the united States. You are strongly advised to plan
further development in a manner which avoids impacts to the aquatic resources.
As stated in earlier correspondence, any discharge of dredged or fill material
within wetlands without prior authorization by this office is a violation of
Section 404 of the Clean Water Act (33 USC 1344) .

APPROVAL of .wI Water Quality Certification and ADDITIONAL CONDITIONS

Dear Sirs:
You have our approval to place fill material in an additional 0.16 acres of wetlands or waters for
the purpose of constructing two road crossings at Sunset Ridge Phase SC, as you described in your
application dated 13 February 1996, After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2671. This certification allows you to use
Nationwide Pennit Number 26 when it is issued by the Corps of Engineers, This certification replaces
one issued on 26 February 1996 due to an incorrect address.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application, For this
approval to be valid, you must follow the conditions listed in the attached certification. Deed
restrictions shall be added to alllots with jurisdictional wetlands to prevent future wetland fill. In
addition, you should get any other federal, state or local pennits before you go ahead with your project.
If you do not accept any of the conditions of this certification, yoo may ask for an adjudicatory
hearing, You must act within 60 days of the date that you receive this letter. To ask for a hearing, send
a written petition which confonns to Chapter 150B of the North Carolina General Statutes to the Office
of Administrative Hearings, P,O, Box 27447, Raleigh, N,C, 27611-7447, This certification and its
conditions are final and binding unless you ask for a hearing,
This letter completes the review of the Division of Environmental Management under Section 401
