On March 27, 2014, the Division of Energy, Mineral and Land Resources received your request to rescind
your coverage under Certificate of Coverage Number NCG 160044. In accordance with your request,
Certificate of Coverage Number NCG 160044 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters
of the State without valid coverage under an NPDES permit is against federal and state laws and could result
in fines. If something changes and your facility would again require stormwater or wastewater discharge
permit coverage, you should notify this office immediately. We will be happy to assist you in assuring the
proper permit coverage.
If the facility is in the process of being sold, you will be performing a public service if you would inform the
new or prospective owners of their potential need for NPDES permit coverage.

On August 12, 2008 Mr. Myrl Nisely of the Raleigh Regional Office of Division of Water
Quality made an inspection of the Butner asphalt facility for storrnwater permit compliance. It
was a pleasure meeting Richard Hanson and James Backus. Their help facilitated the visit and
was greatly appreciated. The plant was in compliance. Please see the attached inspection
checklist. These observations are offered:
A well -written Stormwater Pollution Prevention Plan (SP3) had been updated in .Tune. All of
the required components were accounted for, although written documentation of employee
training was absent. Training is provided in Charlotte, so records are kept there. Please add
documentation of attendance by the Butner personnel to this SP3.
2. Likewise, when a year goes by without spills, there needs to be a notation and signature on
the page for Significant Spills.
3r=Tlie•offce contained a series of SP3 three-ring binders for the years from 2000 to date. The

intent of the permit is to have just one large binder that can hold the materials over a five
..year pe'riod.� ,All activities during a given year such as Qualitative and Quantitative

generated:' This will continue each year until the volume contains records for a'five-year
,';:'•�perio`d Eachx,year the manual is to be reviewed and updated where changes have occurred,
with tl7e review date displayed on an early page. In this way, the SP3 becomes a living
s documerif for" a moving five-year window. That way, information is centrally located, and
inspectors can then made a check on activities quickly, all in one place.
Records at the Division of Water Quality show that Rea provided a change of ownership
notice in 2003, but the data was not changed in our database. The ownership has now been
changed, but there are still mixed listings of contact persorLs. Per a telephone call to you on
8/14/08, you will send a letter specifying those details. We will then correct our internal
information to fully separate this facility from the rest of the Sunrock site in Butner. Your
help on this is appreciated.

The Sunrock Butner facility holds three stormwater permits, NCG 020072 (quarry), NCG
160044 (asphalt) and NCG 140225 (readymix concrete). You have raised the question of
whether the concrete and asphalt stormwaters can be combined and held in a ponded mode to
eliminate runoff, thereby taking away the need for either permit and the required monitoring.
In order for the State to evaluate this approach, please submit to this office an engineering
proposal, including design calculations and drawings to show a system capable of handling a 25
year, 24 hour storm event. There would be a freeboard requirement as part of such an
arrangement, unless a satisfactory plan is presented for overflowing the holding pond to another
of the ponds onsite for water reuse. The proposal is to be prepared by a North Carolina
professional engineer.

In response to your renewal application for continued coverage under general permit NCG 160", the Division of
Water Quality (DWQ) is forwarding herewith the reissued Stormwater general permit. This permit is reissued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
* A copy of general stormwater permit NCG160000
* A Stormwater Pollution Prevention Plan (SPPP) Certification Form. Completion of this form is required to
certify that you have developed and implemented the SPPP as per the conditions of the permit. This form
must be completed and returned to the Division within 30 days of receipt of this letter.
DO NOT SEND the SPPP with the signed form.
• Five copies of the Analytical Monitoring form and five copies of the Qualitative Monitoring form
* A copy of a Technical Bulletin for the general permit which outlines changes in the permit, key requirements,
and addresses frequently asked questions
* A Certificate of Coverage
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or
decree.

In accordance with your application for discharge permit received on January 18, 1995, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and
the Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal
Area Management Act or any other Federal or Local governmental permit that may be required.
