The Division of Energy, Mineral and Land Resources received your request to rescind your
coverage under Certificate of' Coverage Number NCGO80808. In accordance with your request,
Certilcate of Coverage Number NCGO80808 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of
stormwater to waters of the State without valid coverage under an NPDES permit is against
federal and state laws and could result in fines. If something changes and your facility would
again require stormwater or wastewater discharge permit coverage, you should notify this office
immediately. We will be happy to assist you in assuring the proper permit coverage.
If the facility is in the process of being sold, you will be performing a public service if you would
inform the new or prospective owners of their potential need for NPDES permit coverage.

I went by the (old) Heritage Home, Rutherford Distribution Center to scope out the recission request for NCG080808. It
appears that the property has in fact been split into Thomas Carpenter and Parkdale Mills as noted in the recission
request:. Therefore, I support the recission of this permit.
l don't see any issues with the exterior of the Parkdale Mills portion of the property. I'm not sure if there is any activity
or not.
The Thomas Carpenter portion of the property is a pallet recycling business and there's a lot of pallets stored outside on
site. See attached photo for contact information. Have they applied for a permit?

In accordance with your application for a discharge permit received on November 15, 2007, we
are forwarding herewith the subject certificate of coverage to discharge under the subject state--NPDES
general permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-
215. l and the Memorandum of Agreement between North Carolina and the US Environmental Protection
Agency dated May 9, 1994 (or as subsequently amended).
We are also rescinding the NPDES general permit, COC NCGI 80074, which this facility was
previously covered under.
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage.
. This permit does not affect the legal requirements to obtain other permits which may be required
by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area
Management Act or any other federal or local governmental permit that may be required.

Please see permit application attached.
We have received an application for coverage of an existing facility under NCG 08 from Broyhill
Furniture Industries, Inc. for their facility in Rutherfordton. The facility drains to a UT of Catheys
Creek (class WS-V) in Rutherfordton (Rutherford County). This facility does warehousing and
transportation for furniture. Does the Asheville Regional Office have any concerns about issuing
this facility a COC for this general permit? They are currently covered by ncgl80074; this will be
rescinded once we issue the new coc.
Note this is a different facility than the last Broyhill site we've been discussing.
