Box 479 Salisbury, NC 28145 Dear Mr. Treme: You have our approval to place fill material in 1.91 acres of wetlands or waters for the purpose of constructing a diffuser, outfall and sewer line at Grant Creek WWTP, as you described in your application dated 25 April 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3027 and 3022. These certifications allow you to use Nationwide Permit Numbers 7 and 12 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. We examined the floodplain for approximately 300 feet to either side of the underground telephone cable right-of-way, north of the proposed WWTP site. The floodplain varies from 350 to 500 feet wide in this area. The northernmost 200 feet (towards the river) supports Piedmont levee forest (mostly river birch, green ash, overcup oak, sycamore, American elm, and silver maple), with the trees mostly 8 to 12 inches dbh, and a few larger. Jurisdictional wetlands are in a band approximately 150 feet wide between the levee and the base of the slope. These wetlands are sparsely forested with the same canopy trees, and dominated by marsh vegetation (mostly black willow, buttonbush, box elder, lizard tail, rose mallow, duck potato, pickerelweed, sedges, and bulrushes). These wetlands have high value for wildlife habitat. Crossing the floodplain in or immediately southeast of the telephone cable ROW is the alternative of least impact. Placing the outfall farther upstream where the wetland is narrower would cause more damage because it would require additional clearing and grading of the slope adjacent to the wetland. You will need to send a letter to Monica Swihart at DEM explaining the reasons for the change in design, and reporting the expected change in impacts. Since ly Robert J. Price, Jr., Director We have received information concerning the above project from the State Clearinghouse. We have conducted a search of our files and are aware of no structures of historical or architectural importance located within the planning area of the proposed wastewater outfall. We have located the following structures of historical or architectural importance within the general area of the proposed wastewater treatment plant: Fisher-Cruse House (John Fisher House). Located in the Spencer vicinity, north side of SR 1921 (Ellis Cross Road), just east of the junction with SR 1920 (Cruse Road). This house was placed on the state study list for potential nomination to the National Register of Historic Places on July 21, 1978. Alexander Long House. Located in the Spencer vicinity, Sowers Ferry Road (SR 1918). This house was listed in the National Register on February 1 , 1972. A map is enclosed to show the relation of the historic properties to the proposed wastewater treatment plant. There are no known recorded archaeological sites within the project boundaries. However, the project area has never been systematically surveyed to determine the location of significance of archaeological resources. We recommend that a comprehensive survey be conducted by an experienced archaeologist to identify the presence and significance of archaeological remains that may be damaged or destroyed by the proposed project. Price, Jr., Director We have received the archaeological report for the above project from Archaeological Research Consultants, Inc. During the course of the survey sixteen archaeological sites were recorded (31 RW127-142). None of these sites were recommended as eligible for nomination to the National Register of Historic Places. Based upon the information submitted, we are unable to concur with this opinion until revisions have been made to the draft report and to the submitted site forms. Specifically, we request maps be included that clearly indicate site boundaries, variation of survey coverage, and the location and nature of shovel tests. A comprehensive map should also be included that indicates the overall location of surveyed areas and areas which were not surveyed. Upon receipt of the revised draft report and site forms, we will continue our review of this project. In a July 8, 1993 letter (attached), we noted the existence of two historic structures near the potential wastewater treatment plant. The properties are the National Register-listed Alexander Long House and the Fisher-Cruse House which is on the state study list for eventual nomination to the National Register. Upon further research we have determined we do not have enough information in our files to evaluate the correct boundaries of the Alexander Long House or the eligibility of the Fisher-Cruse House. The original research on each of these properties only evaluated the historic house for its eligibility for listing in the National Register under Criterion C for architecture. We need additional information on both properties to determine their eligibility under Criterion A for their association with broad patterns of social history in agriculture. Price, Jr., Director Thank you for forwarding additional information concerning the above project. We have reviewed the revised report and would like to comment. Given that disturbance was heavy and none of the sites was considered significant, we feel the revised report satisfies our minimum requirements. We are concerned that prehistoric background references rely exclusively on obscure citations, none of which is more recent that 1976. As an example, the interpretation of the Pee Dee chronology is outdated and has been revised by recent work in the southern Piedmont (cf. Oliver 1993). Future submissions should reflect the current archaeological literature to ensure accurate and comprehensive evaluations. The following properties have been determined not eligible for listing in the National Register of Historic Places: 31 RW127-142, lack of research potential The photographs in the addendum to the proposed Salisbury wastewater treatment plant show that the sites no longer retain the rural setting. We, therefore, agree with the proposed boundaries. Please inform us about buffers which are planned between the project and the historic boundaries. Box 29535, Raleigh, North Carolina 27626-0535 Telephone 919-733-7015 FAX 919-733-2496 FINDING OF NO SIGNIFICANT IMPACT Yadkin River Effluent Outfall and Regional Wastewater Treatment Plant City of Salisbury, Rowan County An environmental assessment (EA) has been prepared, pursuant to the requirements of the North Carolina Environmental Policy Act, for the City of Salisbury's proposed Yadkin River effluent outfall that would include combining the flows from the 7.5 million gallons per day (MGD) Grant Creek and the 5.0 MGD Town Creek wastewater treatment plants (WWTP). An EA/FONSI was previously circulated through the State Clearinghouse for the proposed elimination of the effluent outfall from Grant Creek and the construction of wastewater treatment facilities for a discharge relocation to the Yadkin River. The environmental review for this project was completed on Gece«ber 1, 19_ . This current EA covers the elimination of the effluent outfall from Town Creek through the construction of a 5.0 MGD pump station and approximately 15,000 feet of force main from the pump station to the Grant Creek WWTP. Flows from the two 'eTWTPs would be combined and treated in a chlorination/dechlorination/post aeration system between the Grant Creek WWTP and the Yadkin River, prior to discharge into the Yadkin River. The existing plants at Town Creek and Grant Creek would be abandoned except for the influent pump stations and other primary treatment facilities. The EA also evaluates a future 20 MGD regional wastewater treatment plant with a discharge to the Yadkin River. The regional plant would be built when a treatment capacity of more than 12.5 MGD is needed to serve Salisbury and its neighboring municipalities. Ultimately, the plant could potentially serve most of the communities in Rowan County. The plant would be built and permitted for treating 20 MGD, but would be built to accommodate expansion in 20 MGD increments up to 100 MGD. This EA and Finding of No Significant Impact (FONSI) are prerequisites for the issuance o` a nondischarge and NPDES discharge permit by the Division of Environmental Management for the construction of this project. It is concluded that the proposed project will not result in significant impacts to the environment provided that it is carried out in accordance with the impact avoidance/mitigation measures contained in the EA. Pending approval by the State Clearinghouse, the environmental review for this project will be concluded. An environmental impact statement will not be prepared for this project.
