This permit is reissued pursuant to the requirements of North Carolina General Statute 143-21S.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended). The following information is included with your permit package: • A new Certificate of Coverage (COC) • A copy of General Permit NCG100000 • A copy of the Technical Bulletin for the General Permit • Two copies of the Discharge Monitoring Report (DMR) Form • Two copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the permit to update your current SPPP to reflect all new permit requirements. The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable, report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances. The more significant changes in the General Permit since your last COC was issued are noted either in the Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.orp/web/wq/ws/su/current- notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are posted on the Stormwater Permitting Unit's website with the new General Permit. Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other analytical monitoring requirements. • Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined in the "Definitions" section of the permit. • Sections B, C: The term "Representative Storm Event" has been replaced by "Measurable Storm Event." A measurable storm event is defined in the permit. • Section D: If the permittee fails to respond effectively to problems identified by qualitative monitoring, DWQ may require the permittee to perform corrective action. Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit, including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than 30 days from the date the facility receives the sampling results from the laboratory. Also note that existing permittees do not need to submit a renewal request prior to expiration unless directed by the Division. Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or decree. You are making great progress. Glad you are able to offset some of the cost by redeeming the scrap metal. DWQ thanks you for working with us to improve the environmental impact of your salvage operation. Not only are we cleaning up the area that you didn't like but several other piles of trash that had accumulated over several years. This will not happen again because we are going to get rid of the trash each time we crush cars. We have made many trips to the Johnston County landfill. So far I have spent over $20,000 hauling and landfill fees but we have gotten a small portion of that back with the scrap metal we are selling. I need a little more time to finish this so it will look like I think you want it to. When it rains it takes a few days to get dry enough to separate the trash from the dirt.With decent weather we should be finished in about 2 weeks. Sullins, Director Division of Water Quality On June 27, 2008, I, Myrl Nisely of the Raleigh Regional Office of the NC Division of Water Quality, performed a compliance evaluation inspection at the Deals on Wheels Salvage Yard. You and I spoke by telephone. The information you provided was very helpful. After our conversation I walked to the back of the yard. Please see the attached checklist in addition to the comment below. Stormwater Management The environmental consultant you are using had updated the stormwater manual and given employee training in April 2008. Copies of manifests showed removal of batteries, reclaimed gasoline and waste oil. Tires are taken to a landfill two or three times per month. Mercury switches are being removed from junk cars and will soon be redeemed for cash. New lumber was on -site with which you intend to build more covered storage for car parts. In general, the yard shows organization and attention to most stormwater concerns. Qualitative monitoring was done a few days before this inspection, while quantitative monitoring for 2008 remains to be completed. Items to be Addressed The one area of the stormwater program still needing attention is general housekeeping. Scattered throughout the yard are many small car parts. Along the back edge of the lot there has developed what amounts to an unpermitted landfill holding these kinds of small parts, along with general trash. Gas tanks, tires, hubcaps, metal pieces of all kinds, mattresses, tarps, wood waste such as pallets and cardboard, pop cans, motor oil plastic bottles, car seats, and a ceramic toilet have been pushed into piles near a location where a pinestraw- covered roadway leaves the site. Many 55-gallon drums stand in this area. Some of the barrels had open bungs and significant volumes of liquid in them. The barrels and many of the accumulated items seem to be unrelated to auto salvage operations. Unfortunately, a portion of the flow of stormwater leaving.the salvage lot goes through this area. So the potential for pollution of the stormwater is significant. These trash piles are to be removed immediately and proper disposal ­must be accomplished. You stated that crushing of cars is planned for July, historically in the same area as the "landfill". It is critically important to have all fluids drained from the cars and steps taken to avoid fluids running onto the ground. You are asked to respond in writing by July 25, 2008 with a schedule for removiniz the trash piles along the back of the property. Klimek, P.E., Director Division of Water Quality May 16, 2005 Mr. Mike Bailey Deals On Wheels, Inc. 14473 NC Hwy 96 Zebulon, NC 27597 Subject: Compliance Evaluation Inspection Stormwater Permit NCG100062 Deals -On -Wheels Salvage Yard Johnston County Dear Mr. Bailey: On May 10, 2005, myself along with Mr. Myrl Nisely, of the NC Division of Water Quality, performed a compliance evaluation inspection at the Deals on Wheels Salvage Yard. You represented the Deals on Wheels Salvage Yard and your assistance was appreciated. Much progress was noted towards meeting the conditions of your Stormwater Permit since Mr. Nisely's previous visit on December 29, 2004. Observations made during the Inspection are as follows: You hired an Environmental Consultant to evaluate your facility for stormwater related issues, make BMP recommendations and develop a stormwater manual. The stormwater manual was reviewed and found to contain all of the administrative components required by the permit. A list of BMP's along with target dates for implementation was included in the manual. Records were on hand for the initial stormwater training course presented by the Consultant to some Salvage Yard personnel. Mr. Nisely noted a noticeable reduction since his last visit in the amount of various auto parts scattered outside of the retail office. Batteries are now located out of the weather until sent to a recycler. Shelving units are being constructed in a storage building for the better handling and control of salvaged parts. In the future, engines and transmissions will be located in a covered area. Your plans also include the construction of a concrete pad where fluids and environmentally hazardous components will be removed from cars immediately upon entering the facility. • A secondary containment structure has been constructed around the diesel fuel storage tank. The structure is Iocated in a covered area. You stated that you plan to move used oil and anti -freeze tanks to within this containment in the near future. You have obtained labels for the proper marking of these tanks. Crushing of vehicles was being carried out at the far end of the site at the time of this Inspection. Fluids were observed being drained from vehicles into storage containers prp to being crushed. You indicated that you planned to remove this contaminated soil and dispose of it at a suitable disposal site. Approximately 95+% of the Salvage Yard's stormwater flow appears to be directed to the sole outfall for the facility. The outfall location appears to be appropriate. A silt fence has been installed in front of the outfall as recommended by your Environmental Consultant. A large amount of naturally occurring sand was noted throughout the yard. You are commended for the rapid development of your Stormwater Permit manual and your commitment to carrying out the BMP's described in the manual by the projected completion dates. This is very expensive: But we do want to do what is right. We have in the past carried all our tires off the rims to the Johnston County landfill,although the transmission went out a couple of months ago and I have just purchased another truck for hauling tires and batteries. We collect our fluids and have what we don't use have Noble Oil to pick it up. I am sure that us hiring James Environmental Management (512-244-3631 Jared) will put us in the best position to do as you need us to. James Environment needs a few weeks (not over 61 was told) to come to our sight (they are based in Texas but have a eastern rep.)and prepare our SPPP manual. Also I will be on vacation March 21-25 and would appreciate it if you not visit during that time because 1 need to be here. No Stormwater Pollution Prevention Plan has been created, nor was there evidence of other components of the permit such as employee training, records of qualitative inspections or a housekeeping plan. • Various auto parts were scattered outside of the retail office, including a battery. • Crushing of cars was being carried out at the far end of the site, the third period of crushing during 2004. You stated that fluids are drained before crushing and each type of fluid is placed in proper containers. You further stated that batteries are kept in a secured truck bed and are periodically sent to a recycler. You showed documents verifying these shipments. • Fluids are removed from cars whenever they are to be crushed or when a part containing fluid is being removed for some purpose.
