On behalf of and at the request of Swing Transport, Inc., James Environmental
Management, Inc. is submitting this response to your Notice of Violation letter dated
September 7, 2006.
Swing Transport, Inc. contracted with James Environmental Management, Inc. on
September 13, 2006, to complete Stormwater Pollution Prevention Plans (SP3) for each
of its North Carolina terminals. Comprehensive Site Compliance Evaluations and the
onsite data collection required for the preparation of the SP3 plans were conducted on
October 3, 4, and 6, 2006. The terminal referenced in the Notice of Violation was
inspected on October 4, 2006.
The Pollution Prevention Plans are currently in production in the James Environmental
Management, Inc. office. The first of these documents will be delivered to the facility in
Manson during the week of October 30, 2006. The remaining documents will be
delivered to the remaining facilities no later than November 10, 2006.

Dear Mr. Sigmond and Mr. Summitt:
On August 29, 2006 Mr. Myrl Nisely made a stormwater inspection of the Manson terminal. The
information and walk-through provided by Mr. Sigmond were greatly appreciated. A tour of the facility
showed good housekeeping, good control of antifreeze and motor oil, and a well -run operation. However,
there was no permit on site nor a Stormwater Pollution Prevention Plan (SP3) manual as required by the
permit. For that reason, this is a Notice of Violation.
A follow-up discussion with Mr. Dan Summitt of the Salisbury office of Swing Transport revealed that
back in 1994 the NC Trucking Association offered to help several companies obtain stormwater permits.
That effort prepared permit applications that were submitted to the EPA. The EPA then provided data to
North Carolina Division of Water Quality from which the general permit was written. Subsequently, each
company submitted a Notice of Intent to apply for a permit for each facility, and was responsible for
dealing with its own permits once they were issued for specific locations. Our records show that four
NCG080000 Certificates of Coverage were issued to Swing over time, including one for the Mason
location. However, it appears the company failed to carvy out the instructions within the permit. General
permit NCGO80000 was reissued in August 2002 with fresh copies mailed to the Salisbury office for each
facility.
One oddity that may have come from the 1994 group application process is that oil/water separators� are
included as treatment processes in each permit. There was no such equipment at Manson, and lVoWnCarol ina

The Division directs Swing Transport, Inc. to prepare. a-Stoi`mwater pollution Protection Plan, following the
euidelines in the hermit, for the Manson facility within 45 days of receipt of this letter. At the end of this
period, notify this office in writing that the manual is in place.
This letter will be shared with inspectors located in other DWQ regional offices where active permits for
Swing Transport are in effect. Be sure to also provide SP3 manuals specific to those sites as needed.
