Facility has active coverage under the NCGO8O0OO permit as a Petroleum Bulk Station/Terminal with total petroleum storage capacity of less than -one million gallons. Met with Mr. John Nunn, Assistant Plant Manager, who provided the facility's Stormwater Pollution Prevention Plan (SPPP) for review and Ms. Wanda Pender„ Director of Package Development, who provided the facility's analytical monitoring retards for review. Facility's SPPP appeared to contain all permit -required components and is updated annually. Analytical monitoring records from 2014 to 2018 show that stormwater discharges from the facility's single outfall are collected twice per year and that results have not exceeded the discharge limitations contained in the permit. After reviewing the analytical monitoring records, observations were made of site conditions including secondary containment for all AST's, stormwater containment pit with manual valve that remains closed and locked until release of accumulated stormwater through an oil water separator, and the outfall. The facility appeared to be well operated and maintained. After the site observations, qualitative (visual) monitoring records were provided for review by Mr. Mike Carter, Tank Farm Manager. Submitting 0utfall Information for E-Reporting The U.S. Environmental Protection Agency (EPA) finalized the National Pollutant Discharge Elimination System (NPDES) Electronic Reporting Rule in. December 2015. The rule requires NPDES regulated facilities to report certain information electronically, instead of filing written paper reports. EPA is phasing in the requirements of the rule over a 5-year period. The first phase required regulated entities to submit Data Monitoring Reports (DMRs) electronically starting on December 21, 2016. We realize that deadline has passed, and EPA is aware that NC is working on expanding the State's eDMR System (currently available to NPDES Wastewater Permit -holders) to include Stormwater Program DMR reporting. As soon as eDMR is available for your permit, we will notify you. In the meantime, we must collect information about the. discharge outfalls at your facility to prepare the system to flow data to EPA as the new federal rule mandates. To submit outfall information to DEQ: Go to the following website and enter the discharge outfall number,. type of discharge, receiving water information, representative outfall status information, and other details no later than November 30, 2017. Reviewed facility's Stormwater Pollution Prevention Plan (SWPPP), which was last revised in August 2010. The SWPPP does not contain documentation of an annual review/update, which should include the items found under Part II, Section A, item 7 of the current NCG080000 General Permit. Although stormwater discharge samples have been collected semi-annually since 2008 for analytical monitoring, the parameters that have been tested do not match the discharge characteristics fisted within the Analytical Monitoring requirements contained in the NCG080000 permit. Qualitative (visual) monitoring has been conducted, but not for the characteristics listed in the permit and not recorded on the appropriate forms. All monitoring should be performed per the conditions listed in the permit and recorded/reported on the appropriate forms, which were provided at the time of inspection. A copy of the current Certificate of Coverage and NCG080000 General Permit was also provided. Observations of site conditions were made including the tank farm areas with secondary containment and the stormwater outfall. Site appeared to be well maintained. NPDES Stormwater General Perm it-NCG080033 Harnett County Dear Mr. Walker: On September 29, 2008, Dale Lopez from the Fayetteville Regional Office of the Division of Water Quality conducted a site inspection for the Warren Oil Company facility located at 2340 US Hwy 301 South, Dunn, NC. A copy of the inspection report is enclosed for your review. Your time and assistance was greatly appreciated, as was that of Harold Lambert, Plant Manager, and James "Red" Lee, Asst. Plant Manager. The Stormwater from this facility drains to Stony Run Creek, Class C waters located in the Cape Fear River Basin. The site visit and mile review revealed that the subject project is covered by N.PDE'S Stormwater General Permit-NCG080033, and that there were deficiencies in performing Monitoring of the semi-annual Qualitative and the Analytical monitoring (aiuivall-y with the old permit, and semi-annually with the new permit) --- please see. The facility had an Oil/Water separator that received flow from the bulk tank containment areas, the parking lots, and the railcar containment area. The oil portion in the Oil/Water separator and any oil in the bulk tank containment areas are treated with applications of a product named "Microbe" that is a blend of acclimated bacteria and enzymes used to break down hydrocarbons. Page 20 of 27 Pages Permit No. NCGO80000 The permittee shall at all times properly operate and maintain all facilities and systems of treatment and control (and related appurtenances) which are installed or used by the permittee to achieve compliance with the conditions of this general permit. Proper operation and maintenance also includes adequate laboratory controls and appropriate quality assurance procedures. This provision requires the operation of back-up or auxiliary facilities or similar systems which are installed by a permittee only when the operation. is necessary to achieve compliance with the conditions of the general permit. a--• • • -• •. 67•' It shall not be a defense for a permittee in an enforcement action that it would have been necessary to halt or reduce the permitted activity in order to maintain compliance with the condition of this general permit. a. Definitions (1) "Bypass" means the known diversion of stormwater from any portion of a stormwater control facility including the collection system, which is not a designed or established or operating mode for the facility. (2) "Severe property damage" means substantial physical damage to property, damage to the control facilities which causes them to become inoperable, or substantial and permanent loss of natural resources which can reasonably be expected to occur in the absence of a bypass. Severe property damage does not mean economic loss caused by delays in production. b. Bypass not exceeding limitations. The permittee may allow any bypass to occur which does not cause effluent limitations to be exceeded, but only if it also is for essential maintenance to assure efficient operation. These bypasses are not subject to the provisions of Paragraphs C. and d. of this section. c. Notice (1) Anticipated bypass. If the permittee knows in advance of the need for a bypass, it shall submit prior notice, if possible at least ten days before the date of the bypass; including an evaluation of the anticipated quality and affect of the bypass. (2) Unanticipated bypass. The permittee shall submit notice of an unanticipated bypass as required in Part II, E. 5. of this general permit. (24-hour notice). Page 21 of 27 Pages Permit No. NCGO80000 d. Prohibition of Bypass (1) Bypass is prohibited and the Director may take enforcement action against a permittee for bypass, unless: (a) Bypass was unavoidable to prevent loss of life, personal injury or severe property damage; (b) There were no feasible alternatives to the bypass, such as the use of auxiliary control facilities, retention of stormwater or maintenance during normal periods of equipment downtime or tiro weather. This condition is not satisfied if adequate backup controls should have been installed in the exercise of reasonable engineering judgment to prevent a bypass which occurred during normal periods of equipment downtime or preventive maintenance; and (c) The permittee submitted notices as required under Paragraph c. of this section. (2) The Director may approve an anticipated bypass, after considering its adverse effects, if the Director determines that it will meet the three conditions listed above in Paragraph d. (1) of this section. 4. Upsets a. Definition. "Upset " means an exceptional incident in which there is unintentional and temporary noncompliance with technology based permit effluent limitations because of factors beyond the reasonable control of the permittee. An upset does not include noncompliance to the extent caused by operational error, improperly designed treatment or control facilities, inadequate treatment or control facilities, lack of preventive maintenance, or careless or improper operation. b. Effect of an upset. An upset constitutes an affirmative defense to an action brought for noncompliance with technology based permit effluent limitations if the requirements of paragraph c. of this condition are met. No determination made during administrative review of claims that noncompliance was caused by upset, and before an action for noncompliance, is final administrative action subject to judicial review. C. Conditions necessary for a demonstration of upset. A permittee who wishes to establish the affirmative defense of upset shall demonstrate, through properly signed, contemporaneous operating logs, or other relevant evidence that: (1) An upset occurred and that the permittee can identify the cause(s) of the upset; Page 22 of 27 Pages Permit No. NCG080000 (2) The permitted facility was at the time being properly operated; and (3) The permittee submitted notice of the upset as required in Part II, E. 5. (b) (B) of this general permit. (4) The permittee complied with any remedial measures required under Part II, A. 2. of this general permit. d. Burden of proof.
