His help was greatly appreciated. Please see the attached inspection report. RRO is recommending to the Stormwater Permitting Unit that the permit should be issued. To assure compliance with analytical parameters in the permit, a great deal of cleanup around the facility will be needed. There are locations around the outside of the building, and especially in the area of the loading lean- to where the ground has been contaminated with oil. Once production is underway an inspection will be made near the end of 2011 by this office to re-evaluate conditions. Your consultant, who is preparing the required Stormwater Pollution Prevention Plan, should be able to offer guidance on what cleanup is considered necessary. The company is currently refitting a large complex of buildings to press oil from cotton seeds, and hopes to be ready by late September or October for the 2011 cotton harvest. In addition to installing their equipment, there will need to be a great deal of cleanup to remove residues and junk from the floors of the building. The front of the facility is flat and covered with crushed stone and dirt. There is a grass buffer between this lot and an elevated railroad track, meaning that stormwater cannot leave the site through the entrance driveway. Rainwater soaks into the ground rapidly, judging by the dry surface after a signficant rain the day before this inspection. There is one stormwater grate in front of the office building, but its discharge point is not known. The back of the building slopes slightly away from the building and has shallow swales that carry water parallel to the building to a culvert pipe that goes under a crushed stone roadway. Downstream of the culvert is a small retention pond, heavily surrounded by weeds. The overflow travels toward the Roanoke River. Very likely this would be the only discharge and sampling point. Cottonseed processing will all take place inside the building, with the resultant oil piped to two large tanks under a large lean-to that has a very high roof. Trucks will be top loaded from the tanks, which are inside a concrete block secondary containment that has no drain. The integrity of the containment walls appeared sound, but there is a crack in the floor that should be repaired to assure all liquids would be retained. On the outside of the containment next to a ramshackle building that will not be used for anything, is an oil soaked patch of ground where an air compressor stood for many years. This area, along with all the rest of the area under this loading zone will be cleaned up. There are many pieces of equipment from the old plant stored there now, some of which are being used in rebuilding the plant. Another inspection should be made near the end of this year once the plant is operating to evaluate the cleanliness and potential for rainwater runoff from around this lean-to structure. The process involves pressing and milling of the seeds, but there will be the use of sodium hydroxide in the refining step inside the building. Another look at the potential for a release to exit the building should be made. AnNaturai has already contracted with a consultant to develop the Stormwater Pollution Prevention Plan, so that should be available by the next inspection. RRO recommends issuing the permit. A site visit was conducted (after Richard Newton conducted sampling at one outfall and the results were reviewed over the phone with him - by Dave Parnell) on September 4, 2013. The facility has designated 18 outfalls, but has conducted only one sampling at SDO#1. During a wak-orouW& the site, Dave Parnell suggested ways of combining several of the SDO into a total of 3-4, providea some BMPs such"as diversion swales were used to move stormwater to a common location. The map must be r. Ishowing the 3-4 outfalls after the grading has been done. Much vegetation must be removed to access propos'0 # 3 and it must be monitored at a location above the point that stormwater from the adjacent facility co -mingles with Resers'. These locations were discussed with Richard Newton and he was requested to contact Parnell when this work was completed and vegetation was removed. All graded areas need to be seeded, mulched and tacked. Two weeks ago one of our night shift crews had a minor spill of cottonseed oil and waste water (about 100 gallons) that did not make it off the property. The next day we cleaned it up and since then we have put in other preventative measures for future occurrences that may happen. One of the employees on the shift that caused the incident has since been terminated. As stated before, all of the spill was contained on our property and we feel that we have done everything we can to prevent this from happening again. It is not our policy to discharge any waste water in our spillways. All waste water in our facility is pumped into a tank and trucked to Chicago and the night shift crew that had this spill was directed to pump into our waste tank, not the spill way. If someone would like to come inspect our spillways and give us any advice so they may be more efficient just in case future incidents may occur, please feel free to do so at any time. I'm still in the process of developing our preventive maintenance program, Section 2 e of the letter. The only concern I have, was in part 4 of your letter. We do service our mobile equipment at our location threw a contractor, Gregory Poole, and they take all old oil off site when they perform this maintenance. So at this time we don't use 55 gallons of motor/hydraulic oil per month. So I assume that we are except from part 4 of the letter. AgNatural is dedicated to keeping the environment clean and safe at all times and we will continue to improve in any area of operation to maintain a clean and safe environment. I really appreciate your time and help that you have giving me during this process. I have also sent a copy of all the items that I have addressed with this letter. This facility operation consists of taking cottonseed from the cotton gins, delinted the seed and making lint bales from the lint. The delinted cottonseed is then run threw an expander and expeller to extract the oil from the seed. The cottonseed oil is then refined to get all the gums and unwanted particles out. The meal and trash lint are turned into a pellet. c ) (A) MANAGEMENT COMMITMENT . In accordance with 40 CFR 112.7, the responsibility for oil spill control at .the AgNatural, LLC plant has been assigned to Tim Hayes, Environmental Coordinator. The management of AgNatural, LLC is committed to providing the manpower, equipment, facilities, materials, and resources required to implement this Spill Prevention Control and Coutermeasures Plan to establish precautionary measures and to expeditiously control and remove any harmful quantity of oil discharged from the AgNatural, LLC plant in Weldon, North Carolina. The finished oil is stored in two bulk storage tank to the west end of the facility with secondary containment walls around both tanks and cover by a tin roof. The delinted cottonseed is stored in a truck bin that is fully enclosed. AgNatural loads their outgoing products both inside and outside of the facility. The load out conveyor to the outside of the building is covered with a tin roof. Agnatural will do everything possible to maintain the roof over this area to prevent runoff of any product and the secondary containment around the bulk storage tanks from getting storm water in it. Wherever practical, AgNatural shall prevent exposure of all storage areas, material handling operations, and manufacturing or fueling operations. We are dedicated to keeping the water run off as clean as we can. We have installed a catch basin in our refining area to catch all process water to keep it from running off site. We have also installed an oil -water separator to remove oil from the water. At this time we pump our process water into our soap tank and ship it out with the soap. Roanoke Rapids Sanitary District had identified impacts on stormwater, spoken with you, and reported the issue with the dumpsters to Halifax County Solid Waste who in turn contacted North Carolina Solid Waste, who in turn contacted the Division of Water Quality. Food wastes have drained from dumpsters onto the asphalt lot and travelled to two outlets into a grassy area. Releases have been occurring long enough for a pool in the grass to develop a layer of sludge on the surface. This release of wastewater, and failure to have a stormwater permit, are violations subject to _ civil penalty enforcements of up to $25,000/ day. The SIC code (20) for food processors is one -of several industries identified by US EPA as requiring a stormwater permit. Accordingly, an application form and technical bulletin for the general permit appropriate for Food and Kindred Processing, NCG060000, were provided to you during our visit. Please submit the completed form to the address indicated within 20 days of receipt of this letter. As I discussed with you, the permit will require Reser's to develop a Stormwater Pollution Prevention Plan. The Plan is to include, among other topics, Best Management Practices (BMPs) to eliminate potential pollutants, identification of outfalls, and preparation of a site map, semi-annual sampling and provision of annual employee training about stormwater protection. Please have this Plan prepared as instructed in the permit and available when DWQ inspectors make a future visit several months from now.
