The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.orp/web/wglws su/`current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit

Some of the changes include:
• Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C: The monitoring parameter Oil & Grease (0&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C: The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,

renewal request for the subject permit certificate of coverage. This is a violation of NCGS § 143.215.1 (c)(l) which
states "All applications shall be filed with the commission at least 180 days in advance of the date on which it is
desired to commence the discharge of wastes or the date on which an existing permit expires, as the case may be".
Any permittee that has not requested renewal at least 180 days prior to expiration or permittee that does not have it
permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subjected to
enforcement procedures as provided in NCGS §143-2t5.6 and 33 USC 1251 et. seq.
In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a
completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit" at
the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). If the
subject discharge has been terminated, please complete the enclosed rescission request form. Mailing instructions
are listed on the bottom of the form. You will be notified when the rescission process has been completed.

First, I want to thank you for the July 17, 1996 tour of Tyson's wastewater treatment systems,
animal waste system and truck wash facility. Everyone was impressed with its operation. The
meeting was also good because a Iot of information was traded between the Division and Mr.
Jerry Foster, Foster Technical Services, Inc. I think this information will help him finalize the
non -discharge permit applications that are required by your company. Also, I would like to
remind you of the agreed upon date, September 3, 1996, for submitting the applications to our
office. The permit applications to be submitted are for the animal waste system used at
Northline and the truck wash system.
Also, I would like to ask for a finalized copy of your Stormwater Pollution Prevention Plan.
The plan was due June 11, 1994. I have been working with Tyson on this, but I have yet to
receive a final plan. The plan should be site specific and should cover the requirements of
Tyson's permit no. NCG060026. Also, as agreed upon before, the plan is due in our office by
September 3, 1996.

During my site visit of October 24, 1995, it was found that additional work was needed on
Tyson's Stormwater Pollution Prevention Plan (SPPP). Also, it was found that Tyson was
unsure if they had applied or have received a permit for the boiler blowdown that was
discharging into the drainage ditch (please reference Mr. Bill Moore's letter dated February 5,
1993).
Per our discussions about the SPPP, the following things were suggested:
1. Since a lot of your staff are no longer there, it might be advisable to reorganize the
the plan to make your present team more comfortable with the plan. It was obvious that
they were unaware of requirements in the plan. So it is suggested that they reorganize
the plan such as to follow the format of the permit. This will add simplicity to your plan
and also meet all requirements of your permit.
2. It is suggested that more detail be given to the sections associated with employee
training, good housekeeping, and spill prevention and response. Per our tour of the site,
it was determined that things could be done that would better improve the site. One
thing is to set up a housekeeping program that would eliminate the grain that is
discarded/spilt onto the pavement. This can be done either by eliminating the spillage
or by dry sweeping the pavement so many times per day or after each loading/unloading.
Also, screens can be put up around stormwater collection basins and drainage spill ways
to collect solids/grains. It was noticed that plastic collection devices were in some of the
secondary containment at your bulk storage tanks. It is suggested that these devices be
filled with cement such to remove the possibility of holes that might occur in these
devices. All valves on your bulk storage tanks should have locks. The two valves on
the drainage pipes through the secondary containment wall at the vehicle fueling docks
should be removed and the holes should be filled with cement. Two reasons for this.

First the bulk storage tanks are under roof so no rainwater accumulates and because the
piped are made of plastic and could easily break.
3. It has also been determined that Tyson has one more stormwater discharge.
Location of the sampling points must be determined and defined in your plan. It is
suggested that the drainage ditches where your stormwater discharges into be cleaned out.
4. Wastewater from the vehicle wash down area needs to be kept inside the building.
Wastewater was observed flowing from the area into a drainage ditch. This ditch stored
what appeared to be animal waste. All animal waste from the trucks needs to be directed
to the lagoon. Also it was mentioned that solids was a problem as far as pumping it to
the lagoon. This can be corrected by eliminating the septic tanks and replacing them
with a lift station with a grinder pump.
I have checked to see if an application has been filed for the boiler blowdown and it has not.

Mr. Robert Tankard and I met with Mr. Larry Pinkham at the subject
facility on 2 February 1993. The purpose of our visit was to discuss your
application for coverage under General Permit No. NCG060000. From our
inspection, we concluded that stormwater discharges may be covered ,under this
general permit. A certificate of coverage should be issued in the near
future. I suggest that you begin preparation of your stormwater pollution
prevention plan for this facility.
During our visit, we discovered 2 wastewater discharges that cannot be
covered by the general permit for stormwater discharges. One discharge is
blowdown from the boiler. Larry indicated that biocides are used in the
boiler water to inhibit corrosion (see permit language regarding biocides).
This discharge may be covered under a separate General Permit, No. NCG500000.
I have enclosed a copy of the general permit and a Notice of Intent
(application form).
The other discharge is wastewater from the truck washing bay. Larry
explained that truck washing wastewater (includes disinfectant) is drained to
a pump tank, pumped to a storage lagoon, and then sprayed on adjacent farmland
with portable irrigation equipment. From our observations, it was obvious
that the system was not functioning properly. Wastewater was ponding over a
large area adjacent to the lagoon and the drainage ditch. You should take
immediate steps to correct this problem. Also, the treatment system for the
truck wash will require a State non -discharge permit. An application for
spray irrigation disposal systems is enclosed.

REQUIREMENTS/PURPOSE
In order to be deemed permitted by the Division of Environmental Management
(DEM), existing animal waste management systems which are designed to serve
feedlots greater than or equal to the following animal populations are required
to be registered with DEM by December 31, 1993:
100 head of cattle
75 horses
250 swine
1,000 sheep
30,000 birds with a liquid waste system
New or expanded animal waste management sytems serving feedlots of the size
indicated above which are constructed between February 1, 1993 and December 31,
1993 must also register with DEM by December 31, 1993.
Although the actual number of animals on the farm may vary from time to time, the
design capacity of the waste handling system should be used to determine if a
farm is subject to the registration requirement. For example, if the waste
system for a feedlot is designed to handle 300 hogs but the average population
is 200 hogs, then the feedlot is required to register. The design capacity is
based on handling waste from animals that are confined for at least 45 days out
of a 12 month period (not necessarily consecutive days).
This registration is required by regulations governing animal waste management
systems adopted by the Environmental Management Commission (EMC) on December 10,
1992 (Title 15A NCAC 2H .0217).

On the reverse side of this page is the registration form which must be submitted
to DEM by December 31, 1993. Assistance in completing the form can be obtained
from one of the local agricultural agencies such as the soil and water

TO BE DEEMED PERMITTED BY THE DIVISION OF ENVIRONMENTAL MA14AGEMENT
REQUIREMENTS/PURPOSE
In order to be deemed permitted by the Division of Environmental Management
(DEM), existing animal waste management systems which are designed to serve
feedlots greater than or equal to the following animal populations are required
to be registered with DEM by December :31, 1993:
100 head of cattle
75 horses
250 swine
1,000 sheep
30,000 birds with a liquid waste system
New or expanded animal waste management sytems serving feedlots of the size
indicated above which are constructed between February 1, 1993 and December 31,

Although the actual number of animal° the farm may vary from time to time, the
design capacity of the waste handling system should be used to determine if a
farm is subject to the registration ;requirement. For example, if the waste
system for a feedlot is designed to handle 300 hogs but the average population
is 200 hogs, then the feedlot is required to register. The design capacity is
based on handling waste from animals that are confined for at least 45 days out
of a 12 month period (not necessarily ,.onsec.tive days).
This registration is required by regulations governing animal waste management
systems adopted by the Environmental Management Commission (EMC) on December 10,
1992 (Title 15A NCAC 2H .0217).

In accordance with the State of North Carolina Department of Energy, Mineral and Land Resources General Permit No. NCG060000 Part II
Section B: Analytical Monitoring Requirements, this is a Tier III notification for the Smithfield Hog Production Creswell Mill, operating under
Certificate of Coverage No. NCG060026. Outfall i#2 has exceeded the benchmark value of 120 mg/L for Carbon Oxygen Demand on four
consecutive occasions during the term of the current permit. The fourth analytical result showing a benchmark exceedance was received
on March 12, 2018.
The sample collection dates for the four exceedances are as follows:
• November 8, 2017
• December 6, 2017
• January 30, 2018
• March 12, 2018
Measures have been implemented to address this issue, They include:
• A site evaluation of possible contributors
• Installed a new containment structure at fat receiving
• Perform outfall maintenance including dredging and installation of rip rap.
• We will implement additional BMPs on individual storm drains located across parking lot. Socks or other drain filters will be used.
It is possible that this is a duplicate notice of an earlier submission, but we could not locate a copy in the files at Creswell Mill. If you have

Inspection Summary:
This inspection was prompted by questions following a site visit by WaRO-DWR. I visited the site with Justin Davis of DWR
[phone] for his follow up inspection of the facility's cooling water permit (NCG500313).
We met with Colin Dykes, Mill Superintendent, Smithfield Foods [phone], walked the site and discussed the
requirements of the general NPOES permits.
Regarding the Industrial SW permit (NCG060026): Particulants and operating materials should not settle on or enter waters
of the state. Oil and grease shall not enter waters of the state.
Permit compliance can be maintained with improved housekeeping and maintenance SOP's and/or implimentation of
diversion berms or other 6MP's to prevent exposures.
Follow up inspections are expected.
