We have attached the letter for reference. This was our first notification of the rescinded storm water permit NCG050311. Richard Draskinis was contacted by you on 2016-04-05 and discussed the error made by Jean Sweeney from 3M Company to request Desco Industries' storm water permit to be rescinded. This permit was transferred from 3M Company to SCS Desco Industries and finalized in 2015-03-10 after the sale of the business to Desco Industries, Inc. We have been operating under this transferred permit since that time. Per your conversation with Richard Draskinis, the following were discussed. • An overview on how the permit was rescinded by 3M Company and granted by the state. • Reactivating the permit was not an easy thing to do since it was already sent to the EPA and that you would look into recommendations to resolve this matter of compliance. The options could include resubmitting an application for a permit if the NCDENR cannot reactivate the permit that we transferred from 3M Company to SCS Desco. We will need an official written lette in regards to how we can operate without an active permit during the time in resolving this matter. Klimek, P.E., Director Division of Water Quality On May 15, 2006, I conducted a stormwater compliance evaluation inspection of the J J Converting facility in Sanford, North Carolina. Richard Daskins and Debbie Bigelow represented the company during the inspection. Their aid was greatly appreciated. The J J Converting facility is a manufacturing facility that discharges stormwater through three outfalls into Carrs Creek, a class C water within the Cape Fear River Basin. The stormwater management and the spill prevention and response plans were reviewed during the inspection and found to be sufficient. Documentation indicates that the plan is reviewed annually by Leonhardt Environmental. Leonhardt Environmental also conducts the annual spill prevention and response training for the facility's employees. This training was last conducted in December 2005. The site map should be updated to include all impervious surfaces and outdoor storage, drainage pipes, and a differentiation of the drainage areas. Qualitative monitoring is required by permit to be performed semi-annually in the spring (April — June) and fall (September — November) at each of the three outfalls. Documentation indicates that only outfall one is being monitored. Mr. Daskins confirmed this during the inspection. Please send documentation for this spring's monitoring to the letterhead address by July 14, 2006. Failure to do so would be a violation of your stormwater permit and could result in enforcement action. A visual review was made of the site and the stormwater outfalls. Organic chemical barrels were being stored outside in a covered area at the time of the inspection. Secondary containment was present but was full at the time with stormwater. Catalyst barrels for the incinerator were also being stored outside at the time of the inspection. These rusting containers were in an uncovered area without secondary containment. Mr. Daskins stated that these issues would be resolved quickly.
