NCG030541 January — June 2018, WOLF #1, #2, #3, #4, and #5 To Whom It May Concern: Please find enclosed the semi-annual stormwater Discharge Monitoring Reports (one original and one copy) for the eight stormwater outfalls located at Cree, Inc., 3028 Cornwallis Road, Durham, Durham County, North Carolina. The analytical reports were received from the laboratory on May 15, 2018. ESC Lab Sciences (NC ID #ENV 375) conducted the analyses which completes the first 2018 semi-annual testing requirements for the Cornwallis Road site. Discharge samples were collected at every outfall #1, #2, #3, #4, and #5. For the sampled outfalls, and as in previous reports submitted to DEQ, levels for copper and zinc are above the benchmark values listed in Table 3 of section 11.13 of our stormwater permit for outfalls #1, #2, #3, #4, and #5 (Cu) and outfalls #1, #3, #4, and #5 (Zn). In September 2014, Cree was granted an exemption from the requirement to continue following Tier Two and Tier Three response actions as stated in Section B of the stormwater permit for these parameters. Cree will continue to monitor these levels throughout the next semi-annual testing period and report any success in eliminating the elevated levels, Additionally, outfall #5 tested above the benchmark level for pH at 9.98 as outlined on page 6, Table 3 of the general permit. In accordance with this exceedance, Cree has instituted Tier. One actions to include the following: Tier One If the first valid sampling results are above a benchmark value, or outside of the benchmark range, for any parameter at any outfall: Conduct a stormwater management inspection of the facility within two weeks of receiving sampling results. 1. Conduct a stormwater management inspection of the facility within two weeks of receiving sampling results. 2. Identify and evaluate possible causes of the benchmark value exceedance. 3. Identify potential and select the specific source controls, operational controls, or physical improvements to reduce concentrations of the parameters of concern, and/or to bring concentrations within the benchmark range. 4. Implement the selected actions within two months of the inspection. 5. Record each instance of a Tier One response in the SPPP. Include the date and value of the benchmark exceedance, the inspection date, the personnel conducting the inspection, the selected actions, and the date the selected actions were implemented. DMR results from this recent testing for NCG030541 are included for review. Cree's next semi-annual test period will occur July - December 2018 at which time pH will be re -analyzed for comparison to the earlier benchmark exceedance. For the sampled outfalls, and as in previous reports submitted to DEQ, levels for copper and zinc are above the benchmark values listed in Table 3 of section I1.13 of our stormwater permit for outfalls #001 and #004 (Cu) and outfalls 4001 and 4004 (Zn). In September 2014, Cree was granted an exemption from the requirement to continue following Tier Two and Tier Three response actions as stated in Section B of the stormwater permit for these parameters. Cree will continue to monitor these levels throughout the next semi-annual testing period for 2017 and report any success in eliminating the elevated levels. In addition, value for TSS was above benchmark level at outfall 4004 during the sampling event; Cree will therefore initiate Tier One activities as described in Section II, Part B, page 3 of General Permit NCG030000, and will re-evaluate this parameter in our first semi-annual testing period in 2017. NCG030541 (RTP/Wolfspeed) January- June, 2016, SDO #1, #2, #3, #4, and #5 To Whom It May Concern: Please find enclosed the semi-annual stormwater Discharge Monitoring Reports (one original and one copy) for the five stormwater outfalls located at Cree's RTP/Wolfspeed site located at 3026 Cornwallis Road, Durham, Durham County, North Carolina. The analytical reports were received from the laboratory on July 14, 2016. Meritech Laboratories (Certificate 4165) conducted the analyses which completes the 2016 first semi-annual testing requirements for the RTP/Wolfspeed site. As in previous reports submitted to DEQ, levels for copper and zinc are above the benchmark values listed in Table 3 of section II.B. of our permit for outfalls #'s 001,002,003,004 and 005 (Cu) and #'s 001,002,004,and 005 (Zn). As noted in previous reports, Cree has been granted an exemption from the requirement to follow Tier Two and Tier Three response actions as stated in Section B of the stormwater permit due to absence of these elements in our manufacturing processes. Cree will continue to monitor these levels throughout the next semi-annual testing period for 2016 and report on any success in eliminating the elevated levels. Additionally, outfall #003 tested above the benchmark level for TSS (Total Suspended Solids) at 301 mg/l as outlined on page 6, Table 3 of the general permit. In accordance with this exceedance, Cree has instituted Tier One actions to include the following: Tier One If the first valid sampling results are above a benchmark value, or outside of the benchmark range, for any parameter at any outfall: 1. Conduct a stormwater management inspection of the facility within two weeks of receiving sampling results. 2. Identify and evaluate possible causes of the benchmark value exceedance. 3. identify potential and select the specific source controls, operational controls, or physical improvements to reduce concentrations of the parameters of concern, and/or to bring concentrations within the benchmark range. 4. Implement the selected actions within two months of the inspection. 5. Record each instance of a Tier One response in the SPPP. Include the date and value of the benchmark exceedance, the inspection date, the personnel conducting the inspection, the selected actions, and the date the selected actions were implemented. Cree's next semi-annual test period will occur July -December 2016 at which time TSS will be re- analyzed for comparison to the earlier benchmark exceedance. DMR results from this recent testing for NCG030541 are included for review and completes Cree's first semi-annual testing requirement for 2016. The analytical reports were received from the laboratory on July 8, 2015. Meritech Laboratories (Certificate #165) conducted the analyses which completes the first 2015 semi-annual testing requirements for the Durham site. Please note that outfall SDO-006 ("no access during event") on the DMR sheet was not sampled at this time because the composite sampler in use failed to produce a sample during the rain event. As in subsequent reports submitted to DENR, levels for copper and zinc are above the benchmark values listed in Table 3 of section II.B. of our stormwater permit for outfalls #001, 002, 004a, and 005 (Cu and Zn) and outfall #003a (Cu). In September 2014, Cree was granted an exemption from the requirement to continue to follow the Tier Two and Tier Three response actions as stated in Section B of the stormwater permit. Cree will continue to monitor these levels throughout the next semi-annual testing period for 2015 and report any success in eliminating the elevated levels. DMR results from this recent testing for NCG030541 are included for review and completes Cree's first semi-annual testing requirement for 2015 for the Durham site. NCG030541 (RTP) January- June, 2015, SDO #1, #2, #3, #4, and #5 To Whom It May Concern: Please rind enclosed the semi-annual Stormwater Discharge Monitoring Reports (one original and one copy) for the five stormwater outfalls located at Cree's RTP site located at 3026 Cornwallis Road, Durham, Durham County, North Carolina. The analytical reports were received from the laboratory on July 8, 2015. Meritech Laboratories (Certificate 4165) conducted the analyses which completes the 2015 semi-annual testing requirements for the RTP site. Please note that outfall SDO-003 (no flow) was not sampled at this time. As in subsequent reports submitted to DENR, levels for copper and zinc are above the benchmark values listed in Table 3 of section II.B. of our permit for outfalls #001,004 and 005 (Cu and Zn) and 4002 (Cu). Cree was granted an exemption from the requirement to continue to follow the Tier Two and Tier Three response actions as stated in Section B of the stormwater permit. Cree will continue to monitor these levels throughout the next semi-annual testing period for 2015 and report on any success in eliminating the elevated levels DMR results from this recent testing for NCG030541 are included for review and completes Cree's first semi-annual testing requirement for 2015. The analytical reports were received from the laboratory on December 23, 2014. Meritech Laboratories (Certificate # 165) conducted the analyses which completes the 2014 semi-annual testing requirements for the Durham site. Please note that outfall SDO-003 (no flow) was not sampled at this time. These results follow the actions implemented as 'Pier 2 response for elevated copper and zinc levels at the facility. Notification that Cree, Inc. intended to implement the actions required as a Tier 2 response was sent to the DWQ in January, 2014 based on the results of the stormwater sampling conducted in December, 2013. Additional samples were obtained in February, 2014. As Cree has demonstrated that no copper or zinc is used in its manufacturing process and has no clear source for the contamination, DWQ has granted relief from further Tier response testing on September 24, 2014 (see attached). However, this letter indicates relief only for NCG030433 (Durham site) and not for NCG030541 (RTP site) as was originally requested (attached request letter). Cree feels this is an oversight and is requesting a second letter indicating Tier relief for the RTP site as well. DMR results from this recent testing for NCGO30541 are included for review and completes Cree's semi-annual testing requirement for 2014. Subsequent testing continues to report values for copper and zinc above the benchmark values listed in Table 3 of section II.B. of our permit for outfalls #1,4 and 5(Cu and Zn), and within limits for all other permit parameters. Cree will continue to monitor these levels throughout the semi-annual testing periods for 2015 and report on any success to eliminate the elevated levels. This letter is to follow up our meeting on Friday, August 1, 2014 at the DENR offices at 3800 Barrett Drive. The meeting presented reasons why Cree's Durham and RTP (Research Triangle Park) facilities should return to semi-annual stormwater monitoring from Tier 2 testing. Elevated copper and zinc levels, we believe, are not originating from the Durham or RTP sites. We have conducted extensive reviews of the sites for external sources of upper and zinc, and Cree does not use copper or zinc compounds in the manufacturing processes which could contribute to these levels. Further, Cree has questioned the proximity of a copper smelting plant in the vicinity that could be contributing to these elevated copper and zinc levels to be considered by DENR as a source due to atmospheric conditions. It was also noted that pH data from the May 2014 sampling event was below 6.0 for all 12 outfalls analyzed by Meritech, Inc., but normal for Enco Laboratories for 10 out of the 12 outfalls. Cree considers this to be inconsistent with sampling from June 2013 thru February 2014 where all pH values were within normal range. The discrepancy is probably due to analysis error than to real values. Based on these findings, Cree formally asks to resume semi-annual stormwater testing for the fall reporting period. Notification that Cree, Inc. intended to implement the actions required as a Tier 2 response was sent to the DWQ in January, 2014 with the results of the stormwater sampling conducted in December, 2013. Additional samples were obtained in February, 20I4 and again for this report in May, 2014. The Cree Durham site received an annual spw3 inspection by David Parnell on April S, 2014. Suggestions from that inspection have been implemented , and additional actions have been taken to identify and limit the amount ofcopper and zinc in the storm water. However, subsequent testing continues to report values for copper and zinc above the benchmark values listed in Table 3 of section II.I3. of our permit for all outfall discharge monitoring points with the exception of outfalls #6 and #7 for zinc. As test results continue at elevated levels for copper and zinc for four successive sampling periods, Cree is requesting a meeting with DWQ to determine the best path forward to address these elevated values.
