The benchmark exceedance is likely not attributed to leachate but rather originating from wildlife excrement that has been consistently observed in the SDO-I drainage area. Voluntary supplemental (not required for compliance purposes) raw leachate samples previously collected from the landfill leachate collection system has not contained detectable levels (<10 CFU/100 ml) of FC. Since previous analytical results indicate FC was not detected in raw leachate and wildlife excrement has been observed throughout the drainage area it is reasonable to assume the source of FC as detected in SDO-1 is not attributed to landfill activities. Concentrations of FC in raw leachate samples at several other facilities have also been consistently lower in relation to stormwater outfall samples and the benchmark. NCDEQ performed a field inspection at this facility during this monitoring period. A full Tier One response for this FC exceedance at SDO-1 can/will not be prepared at this time since the source of FC as identified in SDO-1 is likely not attributed to landfill activities and controls/improvements to mitigate FC levels at a landfill are realistically impractical. The facility plans to continue following permit conditions including semi-annual analytical/qualitative monitoring. In the future additional raw leachate samples may also be tested for stormwater sample comparison purposes. If the NCDEQ does not accept this alternative source demonstration in lieu of a Tier One response please provide us a list of acceptable FC control measures or case studies which have been proven effective in a landfill setting. (See information below.) Yes ❑ No Please verify whether Qualitative Monitoring must be performed during a "representative storm event" or "measureable storm event" (requirements vary, depending on the permit). Qualitative monitoring requirements vary. Most permits require qualitative monitoring to be performed during a "representative storm event" or during a "measureable storm event." However, some permits do not have this requirement. Please refer to these definitions, if applicable. A "representative storm event" is a storm event that measures greater than 0.1 inches of rainfall and that is preceded by at least 72 hours (3 days) in which no storm event measuring greater than 0.1 inches has occurred. A single storm event may contain up to 10 consecutive hours of no precipitation. A "measurable storm event" is a storm event that results in an actual discharge from the permitted site outfall. The previous measurable storm event must have been at least 72 hours prior. The 72-hour storm interval does not apply if the permittee is able'to document that a shorter interval is representative for local storm events during the sampling period, and the permittee obtains approval from the local DWQ Regional Office. Your current permit is set to expire on 10/31/2017. This decision applies only to the fecal coliform benchmarks. A benchmark exceedance of any other parameter listed in your permit will trigger the tiered response actions as described in the general permit. You must notify this office, in writing, within five business days if you become aware of any other significant source of fecal coliform at your facility that has the potential to be exposed to stormwater. The relief granted in this letter is contingent upon the current landfill practices at the Cleveland County Landfill. If Iandfill practices change and fecal coliform become a significant stormwater exposure risk, then this office reserves the right to withdraw this decision and reinstate the permit specified tiered response or other actions that may be warranted by the new set of circumstances. Coliform at SDO-1 Cleveland County Landfill Permit No. NCG 120072 Permit Period Benchmark Exceeded: Year 2 Period 2 Dear Mr. Khan: The analytical results of a stormwater sample collected from SDO-1 on November 18, 2014 indicated fecal coliforn (FC) (>1,600 colonies per 100 ml) in a concentration above the benchmark outlined in NCG120000 (1,000 colonies per 100 ml) (see attached SWU-248 form). A full Tier One response for this FC exceedance at S130-1 can/will not be prepared at this time since the source of FC as identified in SDO-1 is likely not attributed to landfill activities and controls/improvements to mitigate FC levels at a landfill are realistically impractical- The facility plans to continue following permit conditions including semi-annual analytical/qualitative monitoring. The compliance refers to requiring a Stormwater Pollution Prevention Plan which is not a requirement of this permit. The corrected compliance language that should go under Part IH, Section A: 1. is shown below. We have also attached a new page reflecting this change for your permit file (Part III page 1 of 11). This new page should replace the current page in your permit. SECTION A: COMPLIANCE AND LIABILITY 1. Compliance Schedule The permittee shall comply with the permit in accordance with the following schedule: Existing Facilities: Upon the effective date of the Certificate of Coverage the permittee shall comply with all of the conditions detailed in Part II, Section A: Final Limitations and Controls for Stormwater Discharges. New Facilities: Upon the beginning of discharges from the operation of the industrial activity the permittee shall comply with all conditions detailed in Part H, Section A: Final Limitations and Controls for Stormwater Discharges.
