Dear Mr. Bradley:
Enclosed are the monitoring results from the stormwater discharge sampling at Outfall #001 at the subject facility on
January 25, 2011. The grab samples were collected during the sampling investigation performed by Aliyah Owens
of Charlotte -Mecklenburg Storm Water Services (CMSWS) and included analyses required by the permit and .
additional analyses of interest in stormwater discharges. This sampling investigation was conducted as part of a
cooperative working agreement between Mecklenburg County and the Division of Water Quality. In addition, the
inspection was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit,
NCS000240, Part 11 Section H.
The enclosed monitoring results indicate that the stormwater discharged on January 25, 2011 contained an elevated
concentration of Total Suspended Solids (TSS) compared with the benchmark value contained in Stormwater
general permit NCG080000. In addition, elevated concentrations of chemical oxygen demand (COD), biochemical
oxygen demand (BOD), turbidity, copper, and zinc were also detected as compared with the Division's benchmarks
developed for these parameters (usually contained in individual stormwater permits; COD — 120 mg/L; BOD — 30
mg/L; turbidity — 50 ntu; copper — 7 pg/L; and zinc — 67 pg/L).
Please review the requirements of your stormwater permit and take the required steps/actions to reduce the
concentration of TSS leaving your site. Through the development and implementation of stormwater management
programs it is, the Division of Water Quality's expectation that stormwater discharges at industrial sites covered by
NPDES stormwater permits do not impact receiving waters.

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal Clean
Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The NPDES
permitting program for stormwater discharges was established in 1990. Phase I focuses on site and operations
planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the facilities
SIC code and the industrial activity occurring at the facility. There are currently 19 active general stormwater
permits in North Carolina. One condition that is applicable to both the general permits and individual stormwater
permits is the requirement to develop and implement site -specific comprehensive Stormwater Pollution Prevention
plans (SPPP). These plans are required to include a comprehensive evaluation of the site and operations to reduce
pollutant sources and prevent pollutant discharge.

discharge monitoring forms, and a Notice of Intent [which is the application for coverage under a NPDES General
Stormwater Permit] can be found on this website.
The following items are a subset of permit requirements and are listed to assist you and help bring your attention to
certain permitting issues, process and condition requirements of your permit. Please see the above mentioned
website to. obtain a copy of the permit so you may fully comply with all the conditions therein. Failure to properly
comply with conditions of the permit, like those bulleted below, is a violation(s) of the permit and subject to
civil penalty assessment(s) of up to $25,000.00 per day.
Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of Water
Quality (DWQ) by filing of a Notice of Intent (1\101) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any discharge of
stormwater associated with the industrial activity, process wastewater, and/or mine dewatering.
Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General Permit.
That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine dewatering
pursuant to the type of General Permit until the permit expires or is -modified or revoked.
Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable non-
stormwater discharge or is covered by another permit, authorization, or approval.
There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan
o Collection, reporting, and recording of Analytical Monitoring
o Collection, reporting, and recording of Qualitative Monitoring

o Records — Visual monitoring shall be documented and records maintained at the facility along with
the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall also be
maintained on site. The Perrnittee shall retain records of ail monitoring information, including all
calibration and maintenance records and all original strip -chart recordings for continuous monitoring
instrumentation, and copies of all reports required by this general permit for a period of at least 5
years from the date of the sample measurement, report, or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits no
later than 180-days prior to the expiration date. Any permittee that has not requested renewal at
least 180 days prior to expiration, or any permittee that does not have a permit after the expiration
and has not requested renewal at least 180 days prior to expiration, will be subject to enforcement.
Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the name
and incorporate such other requirements as may be necessary under the Clean Water Act. The
Permit is NOT transferable.
o Name Change, Closure, or Facility Ownership change — Permittee is required to notify the Division in
writing in the event the permitted facility is sold or closed. The Division of Water Quality views
changes of name or ownership as a modification that requires the Director's approval and
reissuance of the permit. Name and ownership changes require you to complete a Name/Ownership
Change Form from the Division and mail it back to the Division of Water Quality along with all
appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

A follow-up evaluation was conducted by Aliyah Owens of Charlotte -Mecklenburg Stormwater Services (CMSWS) in
response to the deficiencies noted in the Compliance Evaluation inspection conducted on February 3, 2010. Site visits
were conducted on February 5, 2010, and February 11, 2010, to complete the follow-up evaluation. The follow-up
evaluation was conducted as part of a cooperative working agreement between Mecklenburg County and the Division of
Water Quality. In addition, the evaluation was conducted on behalf of the City of Charlotte in compliance with the City's
NPDES Permit, NCS000240, Part II Section H.
The follow-up compliance evaluation found that the Transflo Charlotte West Terminal has implemented corrective actions
to address the deficiencies noted in the original inspection including. -
Submittal of paperwork documenting the completion of semi-annual qualitative monitoring. Please remember that
qualitative monitoring is required semi-annually by permit NCG080000.
• Submittal of paperwork documenting the completion of an evaluation of the stormwater outfalls for non-
stormwater discharges. Please remember that this evaluation is required annually by permit NCG080000.
Thank you for the assistance and cooperation following the original inspection. Overall, the facility's Stormwater program
was well developed and implemented and this Office commends the permittee's efforts to ensure compliance with your
NPDES permit.

On February 3, 2010, Aliyah Owens from Charlotte -Mecklenburg Stormwater Services (CMSWS), conducted a
site inspection of the Transflo Charlotte West Terminal facility located at 6816 CSX Way in Charlotte,
Mecklenburg County, North Carolina. The site drains to Paw Creek, Class C waters located in the Catawba
River Basin. The site visit and file review revealed that the subject facility is covered by NPDES General
Stormwater Permit — NCG080000.
This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and
the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part II Section H. The following observations and/or
permit condition violations were noted during the CMSWS inspection (please see the attached addendum for
information about your permit):

Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may
be assessed against any person who violates or fails to act in accordance with the terms, conditions, or
requirements of any permit issued pursuant to G.S. 143-215.1.
The subject facility will have 90 days from the letterhead date to come into compliance with the noted issues.
A follow-up evaluation will be conducted.by CMSWS after July 12, 2010, to ensure compliance with the
facility's Stormwater Permit and/or compliance with the City of Charlotte Stormwater Ordinance,

• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees:
• This Notice.of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
-discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked.
• -Any other point -source discharge to'5urface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):

o Collection, reporting, and recording of Vehicle Maintenance Monitoring (if applicable)
o Records — Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample'measurement, report, or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to the expiration date. Any permittee that has not requested
renewal at least 180 days prior to expiration, or any permittee that does not have a permit after
the expiration and has not requested renewal at least 180 days prior to expiration, will be
subject to enforcement. Failure to renew your permit is a violation,
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water
Act. The Permit is NOT transferable.
c Name Change, Closure, or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes require you to complete a
Name/Ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.

Inspection Summary:
Facility Description;
The Transflo Charlotte West Terminal is a terminal storage facility. Products such as plastic pellets, ethanol, magnesium
hydroxide, and food -grade glycols are loaded from rail cars by customers. The facility operates from 6:00 am -- 6:00 pm,
Monday — Friday with 14 employees.
Compliance History:
The permitteelfacility does not have any prior compliance issues with the NC Division of Water Quality or with
Charlotte -Mecklenburg Storm Water Services (CMSWS).
Industrial Operations/City of Charlotte Stormwater Ordinance Review:
During the initial stormwater inspection several housekeeping issues were observed. Minor staining of a sticky white
substance was observed on the gravel surface. Facility personnel could not identify the substance. A 55-gallon drum
labeled PE was observed outdoors on a gravel surface and was not capped. The permittee has contracted a company to
repair engines at the facility. Oily engine parts were observed on the ground surface. The parts were uncovered and
exposed to stormwater. According to facility personnel, the contractor's work will be complete within a week. By the end
of the inspection, facility personnel had covered the engine parts with a tarp.
A return visit to the facility on February 5, 2010, revealed that the engine parts in the maintenance area were not properly
covered. Engine parts should be elevated off the ground and covered. The 55-gallon drum that was exposed to
stormwater during the initial inspection was observed to be capped and placed in a trailer during the second visit to the
facility. The area of the sticky white substance observed on the gravel surface during the initial inspection was cleaned
and restored.
A third visit to the facility conducted on February 11, 2010 revealed that the engine parts were no longer outdoors and
exposed to stormwater.

NPDES STORMWATER PERMIT COMPLIANCE EVALUATION INSPECTION
Assessment Date: February 3, 2010
Background
On Wednesday, February 3, 2010, Charlotte -Mecklenburg Stormwater Services (CMSWS) was
contracted on behalf of the City of Charlotte to show compliance with the City's National Pollutant
Discharge Elimination System (NPDES) permit, NCS000240, Part II Section H to conduct an
inspection of the Charlotte West TRANSFLO Terminal, located in Charlotte, NC. The inspection
is part of a cooperative working agreement between Mecklenburg County and the North Carolina
Department of Environment and Natural Resources (NCDENR) Division of Water Quality. The
walk through audit was conducted by Aliyah Owens of CMSWS, in which she revisited the
terminal on February 5t" and 11t", Terminal records or other documentation were reviewed during
this inspection along with a site inspection. The inspection was intended to assure compliance
with the state of NC's federally approved NPDES stormwater permitting program, in which the
facility is covered by NPDES General Stormwater Permit — NCG080000. This report offers the
response of the findings of the inspection.

1.0 Introduction
This Storm Water Pollution Prevention Plan fulfills the requirements of Permit No. NCG080802,
issued by the N.Carolina DENR, effective on 11/112007. The permit is attached as Attachment A.
1.1 General Facility Information
The Charlotte, NC TRANSFLO Terminal is located at 6816 CSX Way in Charlotte, NC. Kinder
Morgan Material Services currently operates the terminal. The standard industrial classification
(SIC) code for the terminal is 4214.
The terminal is a non-exempt industrial activity. Only those portions of the terminal that are involved
in vehicle maintenance (including vehicle rehabilitation, mechanical repairs, painting, fueling, and
lubrication) or equipment cleaning operations are associated with industrial activity.

2.0 Pollution Prevention Team
The Storm Water Pollution Prevention (SWPP) Team is responsible for implementing the SWPPP at
the Charlotte TRANSFLO Terminal. The SWPP Team develops, implements, modifies, and
provides required reports on the SWPPP related activities. The team members and their

3.0 Description of Potential Pollution Sources
The Charlotte Food Grade (FG) TRANSFLO Terminal currently utilizes 8 railroad spur tracks with a
total capacity of 219 railcars for the transloading of bulk products between railroad equipment and
highway vehicles. The facility has two primary fixed structures for the support and operation of the
terminal; a single story concrete block general office and an equipment garage/storage building and a
one story modular administration office building. The facility has a boiler located in modular portable
container and associated diesel fuel AST for heating of products. There are two small storage
buildings for product samples and transfer equipment. The facility has asphalt paving in all transfer
and operational areas. There is an emergency containment underground storage tank for spilled
products on site. It is not used for storm water retention or control.
This facility is bounded on the north side by CSX Transportation railroad tracks, the south by
undeveloped woodlands, the east by light industrial occupancies and the west by undeveloped land.
3.1 Facility Drainage
The Charlotte FG TRANSFLO Terminal transfer area storm water runoff is conveyed from the terminal
via nine (9) parallel storm sewers, orientated perpendicular to the tracks, which serve the paved areas
between the tracks. These storm sewer systems discharge to a concrete lined detention basin
located between track 8 and the south boundary fence. The detention basin discharges directly to an
unnamed tributary to Paw Creek (Outlet 1)
3.1.1 Site Map
The location of the Charlotte FG TRANSFLO Terminal is shown in Figure 1. The site map of the
terminal is shown in Figure 2.
3.1.2 Potential Pollutant Sources
The approximate center of the terminal is located at 35 degrees, 16 minutes, 24 seconds north
latitude and 80 degrees, 55 minutes, 23 seconds west longitude. Elevations at the terminal are
between 730 and 770 feet National Geodetic Vertical Datum (ft-NGVD) of 1929. The terminal ground
level is nearly level except for portions of the storm water management system and the surrounding
green spaces.
The primary mission of the Charlotte FG TRANSFLO Terminal is the transfer of bulk products from
railcars to truck trailers and vice versa for limited products. The procedures for transferring these bulk
materials at the terminal do not involve exposure during the transfer process. Maintenance of transfer
equipment includes the use of fuel and lubricants during normal equipment operation and

maintenance.
Areas generating storm water runoff associated with vehicle maintenance or equipment cleaning
operations at the terminal are located in the large office/maintenance building. This area is covered
and not exposed to storm water. The drains from this building are connected to the municipal waste
water treatment system.
3.2 inventory of Exposed Materials
The facility has three above ground fuel storage tanks for equipment fueling and boiler fuel supply.
These include:
1. Tank 1- A 1000 gallon welded steel diesel fuel tank used for the fueling of mobile transfer
equipment. This tank is double walled to provide secondary containment for the inner tank.
2. Tank 2- A 1000-gallon welded steel diesel fuel tank used for the fueling of steam boiler
equipment. This tank is double walled to provide secondary containment for the inner tank.
3. Tank 3- A 500-gallon welded steel diesel fuel tank used for the fueling of the hot water boiler. This
tank is double walled to provide secondary containment for the inner tank.
Other transfer equipment and maintenance items such as hoses, lubricants and spill control supplies
are stored in the equipment/maintenance building. Paints, thinners and small quantities of fuel are
stored in the maintenance building in flammable liquid cabinets. Outdoor maintenance is limited to
fueling mobile equipment at Tank 1.
An oillwater separator, located behind the garage/storage building, treats the discharge from a sink
and two (2) floor drains, located inside of the building. This oil/water separator discharges to the
municipal sanitary sewer system. Drain covers are utilized when performing minor maintenance
activity.
A waste storage area is located in the maintenance garage on spill containment pallets.
3.3 Significant Spills and Leaks
There have been no significant spills and or leaks of pollutants that have occurred at areas exposed to
precipitation, or that otherwise drain to a storm water conveyance at the terminal, at any time within
the three years prior to this permit.
If any spills or leaks occur they will be reported, investigated, and recorded according to TRANSFLO's
policy for environmental releases.
3.4 Sampling Data
Sampling of stormwater discharges for the purpose of analytical monitoring is not required, as the
facility utilizes less than 55 gallons of new motor oil per month. Qualitative monitoring is required, and
will be conducted on a semi-annual basis beginning for the period of September -November 2003,
then April -June 2004, and semi-annual during the same periods until permit expires. The qualitative
monitoring results will be recorded using the form in Appendix C of this plan.
3.5 Risk Identification and Summary of Potential Pollution Sources
This section describes potential pollutant sources at each of the regulated areas at the terminal. This
section also includes a description of any significant potential source of pollutants at the terminal and,
for each potential source, any pollutant or pollutant parameter of concern.

3.5.1 Loading and Unloading Operations
Loading and unloading operations associated with vehicle maintenance or equipment cleaning
opertions are limited to the transfer of small quantities of petroleum, oils and lubricants (POLs), fuels,
paints, and parts from delivery vehicles to storage areas and/or the end -use location.
Rail/truck transloading does not involve the direct exposure of the material to the elements, but during
the transfer process it is possible for small quantities of material to be released which are captured on
tarps or in drip pans.

(BTEX)
3.5.2 Outdoor Storage Activities
Outdoor storage activities associated with vehicle maintenance or fueling are confined to fueling of
mobile equipment from tank Al. All equipment -cleaning operations are conducted inside the
maintenance building. The drains from this building are connected to the municipal waste water
system.

3.5.3 Outdoor Manufacturing or Processing Activities
Outdoor manufacturing or process activities associated with vehicle maintenance or equipment
cleaning operations are not performed at the terminal.

3.5.4 Equipment and Vehicle Maintenance Activities
Equipment and vehicle maintenance activities are typically performed inside the maintenance garage.
In the event that maintenance activities are conducted outdoors, laydown sheets will be used to
contain any drips or spills that might occur. Oil sorbent wipes are used to remove oil/grease prior and
during the maintenance activities.
3.5.5 Equipment and Vehicle Cleaning Activities
The facility will perform cleaning operations indoors, in areas with drains that lead to a sanitary sewer
system.
3.5.6 Significant Dust or Particulate Generating Activities
Significant dust or particulate generating activities associated with vehicle maintenance or
equipmement-cleaning operations are not performed at this terminal.
3.5.7 On -Site Waste Disposal Practices
Non -hazardous wastes such as used oil and lubricants are generated at this terminal. These are
stored in 55-gallon drums on secondary containment pallets inside the maintenance garage building.
The waste storage area is secured within the building during non -business hours.
4.0 Measures and Controls - Best. Management Practices
This section summarizes the implementation schedule for the storm water managemnet controls
appropriate for the terminal. A brief description of each control is described in the following sections
4.1 Good Housekeeping
Material and chemical storage areas, which may contribute pollutants, are maintained in a clean,
orderly manner. The facility grounds are kept clean and dry by using brooms, vacuum cleaners, and

with absorbent materials for cleaning up any liquid spills and leaks. Also, waste storage locations
where materials are contained and covered to prevent contact with precipitation or storm water runoff.
4.2 Preventive Maintenance
A preventive maintenance program involving periodic inspection and maintenance of storm water
management devices will be implemented. All covered operations are managed through approvpriate
spill prevention and control. All vehicle and equipment that has the potential to adversely affect
stormwater quality wil have a preventive maintenance program implemented.
4.3 Spill Prevention and Response Procedures
A preventive maintenance program involving periodic inspection and maintenance of storm water
management devices is implemented. All covered operations are managed through appropriate spill
prevention and control. The facility will implement an Emergency Action Plan outlining steps to be
taken in the event of an environmental release.
Drip pans and/or oil adsorbent pads shall be placed under vehicles with observable leaks. Drip pans
and/or oil adsorbent pads placed under vehicles shall be routinely inspected, emptied, and cleaned to
prevent overtopping.
4.4 Secondary Containment
Secondary containment of bulk storage of petroleum liquids will be provided in accordance with the
federal rules requiring spill prevention, control, and countermeasures. Where secondary containment
devices are connected to stormwater conveyance systems, the connection shall be controlled by
manually activated valves equipped with locks. Any storm water accumulation within the secondary
area(s) will be visually observed for the presence of contaminants prior to release. Records will be
kept documenting the observations and any test results.
4.5 Inspections
The facility and equipment inspections will be conducted on a semi-annual basis during the periods of
January to June and July to December until the permit expires. The facility and equipment inspection
results will be recorded using the form in Appendix D of this plan.
4.6 Employee Training
Terminal employees, at all levels of responsibility, shall be informed as to the components of the
SWPPP. Training addresses the following topics:
- Good housekeeping
- Preventive Maintenance, and
- Spill prevention and response
Training is completed annually, documented and attendance records are maintained at the facility and
are hereby incorporated into the plan by reference.
4.7 Recordkeeping and Internal Reporting Procedures
This plan will be retained onsite at the terminal until at least three (3) years after coverage under the
permit terminates 10/31/2012. Also, this plan will be made available, upon request, to the N.Carolina
DENR.
The following SWPPP elements will be updated as appropriate:
- Figure 2 - Facility Site Map
- Section 3.2 - Inventory of Exposed Materials
All required monitoring and inspections will be conducted as required, and will be incorporated as a
part of the plan.
- SWPPP training records will be maintained on -site and will become a part of the plan by reference.

4.8 Non-Stormwater Discharges
There are no identified non -storm water discharges at the terminal.
4.9 Sediment and Erosion Control
There are no areas that have a high potential for significant soil erosion. Other than ballast, no
additional sediment and erosion controls are recommended for the terminal.
4.10 Rail/Truck Transloading
The following best practices shall be utilized during the rail/truck material transloading process to
minimize impact to stormwater quality:
1. Tarps and drip pans will be utilized as appropriate for all transfers to capture and contain any
material released during the process. Details on the use of these devices are provided in the work
instructions for each type of transfers.
2. Material captured on tarps and drip pans will be disposed of, recylced, or otherwise removed
immediately after the transfer is completed and not allowed to come into contact with stormwater,
3. During periods of precipitation, loading may have to be restricted if there is a chance that material
captured on tarps or in drip pans might be expected to impact storm water.
4. Equipment shall be maintained and utilized in accordance with established operating procedures to
minimize spillage during the transfer. ,
5.0 Comprehensive Site Compliance Evaluation
A comprehensive site compliance evaluation shall be conducted as appropriate and, at a minimum, on
an annual basis. The evaluation will be documented using the form in Appendix D. The evaluation
shall determine if:
- changes in terminal operations or structures have occurred which impact the SWPPP;
- storm water management controls have been implemented and are functioning as planned; and
- changes in the existing SWPPP are required to prevent the discharge of pollutants in compliance
with the permit.
The SWPPP Team, along with any other designated personnel, shall:
- visually inspect water drainage areas for evidence of, or the potential for, pollutants entering the
drainage system;
- evaluate the effectiveness of storm water management controls to reduce pollutant loadings;
- inspect any structural storm water control measures to ensure that they are operating correctly;
- visually inspect equipment needed to implement the SWPPP;
- revise the SWPPP whenever there is a change in design, construction, operation, or maintenance,
that has a significant effect on the potential for the discharge of pollutants to the surface water.
- prepare a report summarizing inspection results and follow-up actions, the inspection date,
personnel conducting the inspection, incidents of non-compliance or certification of activity compliance
with the plan; and
- sign the report and keep a copy on file at the terminal.
6.0 Response To Spills or Releases
The facility Emergency Action Plan (EAP) lists specific actions to be implemented by the temrinal
persoonel in the event of a spill or release. The facility SPCC plan also details actions to prevent
discharge of any product or material to surface waters.

Part III of the GP consists of general conditions and definitions consistent with all GPs, which
are applicable to your SW discharge. These conditions also include special reporting requirements.in
the event of noncompliance, bypassing of treatment works (if applicable), and other conditions that
pertain to your stormwater discharge. In Part II1, Section B (2), please note that GPs are not
transferable. If you, as the permittee, cease to need this COC (for example: your facility has closed),
then you should request that the COC be rescinded. It should also be noted that the GP requires that
any monitoring data be retained by the permittee for a period of three (3) years and made available to
a Division representative upon request. if you haven't already done so, please note that any analytical
and/or qualitative monitoring as required by this GP should begin upon commencement of your SW
discharge as a result of a representative storm event.
Failure to comply with the terns and conditions of any NPDES Permit may subject the
permittee to enforcement action pursuant to Section 143-215.6 of the North Carolina General Statutes
in the form of civil penalties of up to $25,000 per violation. Criminal penalties may also be
recommended for violations determined to be intentional or willful. if you find that you are unable to
comply with the terms and conditions of the GP, you should contact this Office immediately.
Lastly, when representatives from this Office contact you in order to conduct an inspection of
your facility, you should be prepared to demonstrate compliance with all terms and conditions
included in the GP. When an inspection is scheduled at your facility, the inspection will focus on
evaluating the following items: Stormwater Pollution Prevention Plan, stormwater outfall locations, a
review of any qualitative and/or analytical monitoring data required by the GP, and any other
activities that may be required by the GP that are unique to your discharge. This information should
be readily available if requested by a Division representative.

Our records indicate that you have been issued the subject Certificate of Coverage (CDC)
under General Permit (GP) No. NCG080000 from the North Carolina Division of Water Quality to
discharge stormwater associated with industrial activities performed at your facility. The purpose of
this letter is to advise you of the importance of the GP and the liabilities in the event of failure to
comply with the terms and conditions of the GP. If you have not already done so, it is suggested that
you thoroughly read the GP. Of particular importance are Part II and Part III, Sections A & B.
Part II is titled "MONITORING, CONTROLS, AND LIMITATIONS FOR PERMITTED
DISCHARGERS". Part 11, Section A discusses the need to develop a Stormwater Pollution
Prevention Plan (SPPP), which includes, but is not limited to the following components: a site plan, a
stormwater management plan, a spill prevention and response plan, preventative maintenance and
good housekeeping program, and employee training. Specific guidance as to the information to be
included in each plan is also listed in this Section. Section B sets forth the analytical monitoring that
should be performed at all outfalls that discharge stormwater runoff from the vehicle maintenance
areas.
Part I1, Sections C is titled "DISCHARGE LIMITATIONS AND ANALYTICAL
MONITORING REQUIREMENTS - OIL WATER SEPARATORS AND PETROLEUM BULK
STATIONS AND TERMINALS". Table 3 of this Section sets forth the analytical monitoring
required by your GP if you discharge from an oil/water separator and/or a petroleum bulk station or
terminal, Part I1, Section D of the GP sets forth the qualitative monitoring required during the term of
your permit, which should coincide with the initial analytical monitoring event (regardless of the
season). Table 4 lists the qualitative monitoring to be performed during the term of this permit.

are applicable to your SW discharge. These conditions also include special reporting requirements in
the event of noncompliance, bypassing of treatment works (if applicable), and other conditions that
pertain to your stormwater discharge. In Part III, Section B (2), please note that GPs are not
transferable. If you, as the permittee, cease to need this COC (for example: your facility has closed),
then you should request that the COC be rescinded. It should also be noted that the GP requires that
any monitoring data be retained by the permittee for a period of three (3) years and made available to
a Division representative upon request. If you haven't already done so, please note that any analytical
and/or qualitative monitoring as required by this GP- should begin upon commencement of your SW
discharge as a result of a representative storm event.
Failure to comply with the terms and conditions of any NPDES Permit may subject the
permittee to enforcement action pursuant to Section 143-215.6 of the North Carolina General Statutes
in the form of civil penalties of up to $25,000 per violation. Criminal penalties may also be
recommended for violations determined to be intentional or willful. If you find that you are unable to
comply with the terms and conditions of the GP, you should contact this Office immediately.
Lastly, when representatives from this Office conduct an inspection of your facility, you
should be prepared to demonstrate compliance with all terms and conditions included in the GP. If an
inspection is scheduled at your facility, the inspection will focus on evaluating the following:
Stormwater Pollution Prevention Plan, stormwater outfall locations, a review of any qualitative and/or
analytical monitoring data required by the GP, and any other activities that may be required by the GP
that are unique to your discharge. This information should be readily available if requested by a
Division representative.
