Suilins Directcr January 10, 2011 Dee Freeman Secretar/ Subject: Stormwater Monitoring Results Greyhound Lines, Inb. at 601 West Trade Street NPDES Stormwater Permit - NCG080000 Certificate of Coverage - NCG080591 Mecklenburg County Enclosed are the monitoring results from the laboratory analyses performed on the discharge from Stormwater Outfall 001 at the subject facility. The samples analyzed were grab samples collected during the sampling investigation performed on November 30, 2010, by Andrew Martin of Charlotte -Mecklenburg Storm Water Services. This sampling investigation was conducted as part of a cooperative working agreement between Mecklenburg County and the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit, NCS000240, Part 11 Section H. The enclosed monitoring results indicate that the stormwater discharged on November 30, 2010, contained an elevated concentration of Total Suspended Solids compared with the benchmark value contained in Stormwater general permit NCG080000. In addition, elevated concentrations of turbidity, Biological Oxygen Demand (BOD), Chemical Oxygen Demand (COD), fecal coliform, E. Coli, copper, lead, and zinc were detected as compared to the Divison's benchmarks developed for individual stormwater permits (turbidity — 50 NTU, BOD — 30 mg/L; COD -- 120 mg1L; fecal coliform — 1,000 CFU/100 ml; E. Coli, enterococcus -- 500 MPN/100 ml; copper — 0.7 pg/L; lead — 30 pg/L; and zinc 67 pg/L). In addition, the copper, lead, and zinc concentrations exceeded the applicable stream standards for toxic substances (copper — 7 pg/L; lead — 25 lag/L; and zinc — 50 pg/L). Since the stormwater sample was not collected in -stream, the stream standards do not apply; however, these standards can be used to indicate the potential of your runoff to impact the receiving stream. Please review the requirements of your stormwater permit and take the required steps/actions to reduce the concentration of Total Suspended Solids leaving your site. Through the development and implementation of stormwater management programs it is the Division of Water Quality's expectation that stormwater discharges at industrial sites covered by NPDES stormwater permits do not impact receiving waters. Division of Water Quality for implementation in North Carolina, The NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and operations planning to reduce pollutant sources. Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general permit or an individual permit, depending upon the facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general stormwater permits in North Carolina. One condition that is applicable to both the general permits and individual stormwater permits is the requirement to develop and implement site -specific comprehensive Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge. Copies of the general permits and accompanying documents can be accessed from the following webpage: http://portal.ncdenr.org/web/wq/ws/su/npdessw#General_Permits_NPDES. Permit text, technical bulletins, discharge monitoring forms, and a Notice of Intent [which is the application for coverage under a NPDES General Stormwater Permit] can be found on this website. The following items are a subset of permit requirements and are listed to assist you and help bring your attention to certain permitting issues, process and condition requirements of your permit. Please see the above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein. Failure to properly comply with conditions of the permit, like those bulleted below, is a violation(s) of the permit and subject to civil penalty assessment(s) of up to $25,000,00 per day. • Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general NPDES stormwater permit or an individual NPDES stormwater permit • All persons desiring to have facilities covered by a General Permit must register with the Division of Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees. • This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any discharge of stormwater associated with the industrial activity, process wastewater, and/or mine dewatering. • Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage (COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked. • Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable non-stormwater discharge or is covered by another permit, authorization, or approval. • There are currently 19 active general permits. The Permittee shall retain records of all monitoring information, including all calibration and maintenance records and all original strip -chart recordings for continuous monitoring instrumentation, and copies of all reports required by this general permit for a period of at least 5 years from the date of the sample measurement, report, or application. a Expiration — The permittee is not authorized to discharge after the expiration date of the general permit. In order to receive automatic authorization to discharge beyond the expiration date, the permittee shall submit forms and fees as are required by the agency authorized to issue permits no later than 180-days prior to the expiration date. Any permittee that has not requested renewal at least 180 days prior to expiration, or any permittee that does not have a permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subject to enforcement. Failure to renew your permit is a violation. o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not transferable to any person expect after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the Certificate of Coverage to change the name and incorporate such other requirements as may be necessary under the Clean Water Act. The Permit is NOT transferable. o Name Change, Closure, or Facility Ownership change — Permittee is required to notify the Division in writing in the event the permitted facility is sold or closed. The Division of Water Quality views changes of name or ownership as a modification that requires the Director's approval and reissuance of the permit. Comment: The February 2010 update to the SPPP removed the storm drain outfall location along West Trade Street — SDO#001, added a new outfall along 4th Street — SDO#002, and renamed the existing outfall SDO#002 to SDO#001. During the inspection a discharge of water with an oily sheen and orange citrus odor was observed discharging to West Trade Street from the historic SDO#001. Discharge from the historic SDO#001 is sheet flow from a paved driveway. Sheet flow of wash water containing Kon Kleen was also observed discharging off the property onto 4th Street. SDO#001 was impacted with wash water and Kon Kleen. The storm drain outfall that was previously removed from the site map should be added as an outfall location. There is a drain located in the Loading Area that has not been identified on the site map. Stormwater outfalls have not been evaluated for the presence of non-stormwater discharges. The site drains to Irwin Creek, Class C waters located in the Catwaba River Basin. The site visit and file review revealed that the subject facility is covered by NPDES General Stormwater Permit -- NCG080000. This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit, NCS000240, Part li Section H. The following observations and/or permit condition violations were noted during the CMSWS inspection (please see the attached addendum for information about your permit): 1) Stormwater Pollution Prevention Plan (SPPP) A Stormwater Pollution Prevention Plan (SPPP) has been developed, recorded, and properly implemented. Yes ❑ No Issues with the SPPP were noted during the inspection regarding the general location map, the site map, a drain located in the loading area, the size of the kitchen grease bin and the diesel UST, documentation of Preventative Maintenance and Good Housekeeping inspections of material handling areas, documentation of yearly employee training, documentation of the personnel responsible for overall coordination and development of the SPPP, documentation of the annual review of the SPPP, documentation of a Stormwater Facility Inspection Program, and a lack of procedures regarding pressure washing activities on site to prevent stormwater contamination. Please see the enclosed report for more detail on these issues. 2) Qualitative Monitorinct Qualitative monitoring has been conducted and recorded in accordance with permit requirements. Yes ❑ No ❑ Not Applicable 4) Permit and Outfalls The inspection found that the stormwater outfalls have not been evaluated for the presence of non-stormwater discharges. In fact, the inspector noted the discharge of wash water containing Kon Kleen from the property onto 4th street and the discharge of water with an oily sheen and orange'citrus odor to West Trade Street on the day of the inspection (illicit discharges not allowed by the stormwater permit). The inspector also found that not all outfalls from the site have been identified in the SPPP. Please see the enclosed report for more detail on these issues. 5) City of Charlotte Stormwater Ordinance. Review: The Summary section of the attached report contains a section entitled "Industrial Operations/City of Charlotte Stormwater Ordinance Review". This section highlights issues, which violate or may lead to a condition which violates the City of Charlotte's Stormwater Ordinance. Some of the items noted in this section also violate the terms of the general stormwater permit and/or NC General Statues and Administrative Codes. Thank you for the assistance and cooperation during the inspection. As noted above and in the enclosed report, permit and City of Charlotte Stormwater Ordinance violations, were noted during the inspection. It is requested that a written response be submitted to this Office by June 18, 2010, addressing these violations. In responding to the violations, please address your comments to my attention at the letterhead address. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1. The subject facility will have 90 days from the letterhead date to come into compliance with the noted issues. A follow-up evaluation will be conducted by CMSWS after August 16, 2010, to ensure compliance with the facility's Stormwater Permit and/or compliance with the City of Charlotte Stormwater Ordinance. The facility holds a UST permit for a 15,000-gallon underground storage tank (UST). Kitchen grease is disposed of by Sani-Can and used batteries are disposed of by Quest. There have been no spills at the facility in the previous three years. The facility pressure washes the lot every two weeks and disposes of the wash water into the sanitary sewer system. The facility is 100% impervious with two identified storm drain outfalls. Compliance _History: The permitteelfacility does not have any prior compliance issues with the NC Division of Water Quality or with Charlotte -Mecklenburg Storm Water Services (CMSWS). Industrial OperationslCity of Charlotte Stormwater Ordinance Review: Discharge Pines — Two white, 1-inch PVC pipes were observed plumbed to the outside of the main facility building. No discharge was observed from the pipes. Facility personnel were not familiar with the source of the pipes. Staining and deterioration of the building due to previous discharges was evident. The facility must permanently remove the pipes, properly plumb the pipes to an approved sanitary sewer system, or confirm the source as a permitted discharge. Loading Area — Sewage hoppers are located in this area. The pavement area was wet with standing puddles of water. An oily sheen was observed throughout the pavement in this area, leading down the driveway and off the property onto West Trade Street. A citrus odor was noted in this area. It appeared an oil spill had occurred with improper response and cleanup or pressure washing activities had recently occurred in the area without proper containment and disposal. The facility was directed to clean up the oil spill. The storm drain in the driveway was previously identified as Storm Drain Outfall #001 and has since been removed as an outfall location. The facility should implement proper spill prevention and spill response procedures. Drum Stora e1Dum ster Area — The kitchen grease bin, facility dumpsters, and used 55-gallon oil drums are stored in this area. Minor grease was observed on the pavement around the grease bin. Two used 55-gallon 15w-40 oil drums were observed stored upside down. The bungs were missing, allowing any residual oil product to be discharged to the pavement. Facility personnel explained that the drums were awaiting pickup for disposal. The facility should store used drums up off the ground in a covered area in a manner to prevent stormwater pollution. Wash Water Discharge — Facility personnel pressure wash the pavement around the facility approximately every two weeks. Facility personnel explained that the wash water is discharged back into the sanitary sewer system located on site. During the inspection green puddles of water with an orange citrus odor were observed in the storm drain inlet (Storm Drain Outfall #001, previously Storm Drain Outfall #002) and around the facility parking lot. Facility staff identified the green coloring resulted from the cleaning compound used to clean the concrete and pavement around the facility. The green water trail started at the Loading Area and trailed across the parking lot to SDO#001 and 4th Street. The chemical was identified as Kon Kleen from Pro Chem, Inc. This chemical is a strong base with a Health rating of 3, Fire rating of 0, Reactivity of 1, and PPE of E. Kan Kleen is listed as toxic to fish with a LC50 at 1,700 mg/L. Facility personnel that conducted the pressure washing could not identify where the wash water is discharged for disposal. Product was also observed in storm drain inlets along 4th Street. A thick oily sheen was associated with this wash water discharge. The facility was directed to conduct a cleanup and spill response removal of the product from the facility and from the storm drain infrastructure along 4th Street. Any illicit discharges to the storm drain system must be properly reported and recorded in the facility's Stormwater Pollution Prevention Plan.
