Dear Mr. Byars. -
A follow-up evaluation was conducted by Aliyah Owens of Charlotte -Mecklenburg Stormwater Services (CMSWS) in
response to the deficiencies noted in the Compliance Evaluation inspection conducted on February 17, 2010. A site visit
was not needed to complete the follow-up evaluation. The follow-up evaluation was conducted as part of a cooperative
working agreement between Mecklenburg County and -the Division of Water Quality. In addition, the inspection was
conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit, NCS000240, Part II Section H.
The follow-up compliance evaluation found that the Charlotte Observer has implemented corrective actions to address the
deficiencies noted in the original inspection including:
• Submittal of an employee roster to document the required employee training required by the permit and the
guidelines under which training would be completed. Please remember that employee training is required
annually by NCG080000.
• Submittal of paperwork documenting the completion of an evaluation of the stormwater outfalls for non-
stormwater discharges. Please remember that this evaluation is also required annually by NCG080000.
Thank you for the assistance and cooperation following the original inspection. Overall, the facility's Stormwater program
was well developed and implemented and this Office commends the permittee's efforts to ensure compliance with your
NPDES permit.

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990 Phase 1 focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive
evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge.

forms, and a Notice of Intent [which is the application for coverage under a NPDES General Stormwater
Permit] can be found on this website.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. Please see the
above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein.
Failure to properly comply with conditions of the permit, like those bulleted below, is a violation(s) of
the permit and subject to civil penalty assessment(s) of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked.
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly- however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):

o Collection, reporting, and recording of Qualitative Monitoring
o Collection, reporting, and recording of Vehicle Maintenance Monitoring (if applicable)
o Records -- Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample measurement, report, or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to the expiration date. Any permittee that has not requested
renewal at least 180 days prior to expiration, or any permittee that does not have a permit after
the expiration and has not requested renewal at least 180 days prior to expiration, will be
subject to enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water
Act. The Permit is NOT transferable.
o Name Change, Closure, or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes require you to complete a
Name/Ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

On February 17, 2010, Aliyah Owens from Charlotte -Mecklenburg Stormwater Services (CMSWS), conducted
a site inspection of the Charlotte Observer facility located at 1001 Pressley Road in Charlotte, Mecklenburg
County, North Carolina. The site drains to Irwin Creek, Class C waters located in the Catawba River Basin.
The site visit and file review revealed that the subject facility is covered by NPDES General Stormwater Permit
-- NCG080000.
This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and
the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part II Section H. The following observations were
noted during the Charlotte -Mecklenburg Stormwater Services inspection (piease see the attached addendum
for information about your permit):
1) Stormwater Pollution Prevention Plan (SPPP)
A Stormwater Pollution Prevention Plan (SPPP) has been developed, recorded, and properly implemented.

with your NPDFS permit.
However, as noted above and in the enclosed report, deficiencies were noted during the inspection and it is
requested that a written response be submitted to this Office by June 14, 2010, addressing these deficiencies.

Facility Description:
The Charlotte Observer facility located at 1001 Pressley Road is a delivery and distribution center for the Charlotte
Observer newspaper. The hours of operation for the facility's four fulltime employees are from 7 a.m. — 4 p.m., Monday —
Friday. Carriers have daily access to the facility from 7 p.m. — 6 a.m. for the purpose of transporting Charlotte Observer
newspapers.
Compliance History?
The permitteelfacility does net have any prior compliance issues with the NC Division of Water Quality or with
Charlotte -Mecklenburg Storm Water Services (CMSWS).

t Inspect the outfall on a clear day "it must not be raining" for the presence of water. This could possible be non
stonnwater run off from a source that should not be in the storm drain system.
Description of
The outfall was inspected today and a small amount of water was entering the outfall from a drain fine coming
from the South side of the outfall. This is normal for this drain and the water is clear and does not show evidents of
contamination.
We have had above averaqe rain fall for the last two to three months and the water table is higher than normal. This
could also be part of what we see

1.0 Site Views & Description
1.1 Arial Views:
Arial view 1 "page 8" shows The Charlotte Observer Transportation Site at the corner of
Pressley Road and Dwight Evans Road. The stormwater empties into the wetlands to the
West of the site and eventually reaches Irwin Creek, this is approximately 3,200 feet
from the site. Irwin Creek is part of the Catawba River Basin.
1.2 Additional Views & Descriptions:
Refer to anal view 1, the closest view of the site. The transportation building is where the news
papers are brought to and delivered from each day. This building is 375 feet long & 150 feet
wide and is located at 35'11'28.55"N & 80°53'42.99"W. When papers are packaged into
bundles each day at the printing operations up town Charlotte they are trucked to this site and
unloaded. The North side of the building is used for unloading newspapers from trucks, these
deliveries were made from our main office building in uptown Charlotte, NC. The South side of
the building is used for loading newspapers into individual trucks, vans and cars to be circulated
throughout the County.
The maintenance building is used for preventive maintenance and repairs to the trucks. This
building is 140 feet long & 60 feet wide and is located at 35'11'32.46"N & 80°53'46.05"W.
The trucks are brought inside to prevent a possible spill from reaching the grounds during
maintenance & repairs. The view also shows where the 25,000 gallon underground fuel storage
tank is located. It is located at 35'11'32.83"N & 80°53'46.51"W. The tank is double lined with
a catch basin for small spillage during filling, it also has overflow protection using a ball float
and has an electronic level/leak detection system.
The single outfall empties into the wet lands and is located at 35'11'32.7588"N &
80°53'46.9242"W "near pin 7".
Two additional arial views 2 & 3 "pages 9 & 10"; are wider views than arial view 1 and shows
the proximity to Irwin Creek and major highways. View 2 shows the proximity to Irwin Creek
and other businesses. View 3 shows the site's proximity to major highways 77, Billy Graham
Parkway and West Tyvola Road.
All three anal views show the property lines, a view of the wet lands and Irwin Creek. The
yellow pins identify property lines, the distance between pins are as follows.

2.0 Stormwater Management Plan
2.1 Feasibility Study:
After looking at all the procedures for the prevention of polluting stormwater at the site there
were few changes made. All loading and unloading at the transportation building is of paper and
protected from rain water due to the process being accomplished at loading docks. The unloading
of fuel into the UST is done at the maintenance building site on a concrete pad. The filler area is
enclosed with a locked lid and protected with a secondary containment basin. The UST also has
overfill protection using a ball float. The fueling of company trucks is done at a pumping station
under a carport type shelter at the West end of the maintenance building. The storage tank
capacity is monitored by an electronic leak detector that also serves as a fuel capacity gauge.
2.2 Spills:
There have not been any spills during the last five years. With the safe guards put in place during
filling of the storage tank "the driver and one TCO employee present", overfill protection,
overflow catch basin and a concrete pad, there is minimal risk of'a spill. The truck fueling area is
also under a shelter and on a concrete pad with electronic spill monitoring.
2.3 Certification of Outfalls:
The outfall located at 35"11'32.7588"N & 80°53'46.9242" W "near pin 7" has been tested by
PAR Laboratory here in Charlotte and meets the requirements found in Part 111, Standards
Conditions, Section B, Paragraph 5. Semi-annual Qualitative & Analytical Monitoring is
performed at the outfall. Annual inspections of the outfall are performed for non-stormwater
discharges.
2.4 Secondary Containment:
The UST is a double wall fiberglass tank. The piping is enclosed inside of additional piping
providing for secondary containment. The tank and piping is inspected annual by Precision 'Tank
Services out of Cornelius, NC. The inspection includes pressure testing the tank and piping for
leaks. The fuel dispensers are inspected and pressure tested and the piping cleared of any debris.
Both the new oil & used oil tanks are double wall above ground tanks.
2.5 Stormwater Testing:
The stormwater is tested twice each year by a local lab; PAR laboratories in Charlotte. The water
samples for testing are taken from the single outfall at 35°11'32.7588"N & 80°53'46.9242"W
"near pin 7". The tests are the standard stormwater discharge outfall "SDO" for qualitative &
analytical. Annual inspections are performed for non-stormwater discharges. Sample forms are
on pages 11, 12, 13, 14 and 15.
2.6 Training:
Annual stormwater training is conducted on site by the Facilities Manager. A copy of the training
guide is on page 16 and the training log on page 17.
2.7 Record Keeping - Records are kept at the transportation site for the following:
2.7.1 UST Permit
2.7.2 Annual tank & pipe pressure testing and inspection by Precision Tank Services
2.7.3 Level and inventory controls.
2.7.4 Annual level/leak inspections and calibration by Southern Pump & Tank.
2.7.5 Annual inspections of the oil/water separator by Cleaning Systems of the Carolinas.
2.7.6 Semi-annual stormwater test of outfall & annual inspection of non-stormwater discharge.

3.0 Spill Prevention & Response Plan:
All employees working in and around the maintenance building and/or fueling The Observer trucks
must be familiar with the site and the spill prevention & response plan. A copy of this plan must be
displayed in the maintenance building.
3.1 Site Plan:
On page 7 is a site plan of the Transportation Department. Transportation's primary function is
to receive, organize and distribute The Charlotte Observer's news papers. This is done from the
main building "transportation building".
3.2 The Truck Maintenance Building:
The truck maintenance building which is 245 feet North of the transportation building is where
all maintenance is performed on the trucks. Fueling of the trucks is also accomplished at this
building under a carport type shelter at the West end of the building.
3.3 The Underground Storage Tank:
The underground fuel storage tank is a few feet North of the maintenance building and covered
with a concrete pad. The tank is a 25,000 gallon double wall fiberglass tank with the piping
inside a secondary lining. The UST is inspected and pressure tested annually by Precision Tank
Service, Inc. out of Cornelius, NC. The tank is never tilled without the presence of an Observer
employee working with the tanker driver.
3.4 Oil/Water Separator:
The oillwater separator was replaced in 2008 and is located a few feet South of the maintenance
building. The new separator is a CSC -Alpha 3100D oil/water separator. The oil/water separator
is enclosed in a metal building. All floor drains in the maintenance building is piped to the
oil/water separator. Discharge from the separator is to the sanitary sewer system. Starting in 2010
the water from the separator will be tested in the same manor as the stormwater tests from the
outfall; even though the output from the separator is to the sanitary sewer and not to the storm
drain.
3.5 Spill Clean Up Material:
The spill clean up material is stored on site inside the maintenance building. It consists of a drum
for storing spent material, shovel for clean up of material, pigs for containing the spill and
absorbent material for clean up of the spill. All spent material must be put into the drum and
stored until disposed of by HAZ Mat Services.
3.6 Notification Procedures:
If a spill occurs, the following employees and Agencies must be notified: Assigned responsible

3.7 Clean Up:
If the spill is small and can be confined and cleaned up without soil, sewer or storm drain/water
contamination; clean up can be completed using on site clean up equipment. This consists of a
containment drum and absorbent material as explained in section 3.5 above. Disposal will be
done by HAZ-MAT Services.
4.0 Maintenance & Housekeeping:
4.1 Monthly Inspections:
Monthly inspections will be conducted by an on site Manager or the Facilities Manager. The
inspection checklist is on page 17 and consists of inspecting the grounds, catch basins, outfall,
maintenance shop, oil/water separator, fueling stations, underground storage tank area, spill
clean up equipment and documentation. An annual inspection of the outfall is performed for non-
stormwater discharge.
4.2 UST Maintenance Log:
A UST maintenance log is for scheduling and documenting completed maintenance requirements
by the State. It also has important vendor contacts for services. The log is on page 18.
4.3 Level/Leak Detector Printout:
A copy of the printout from the level/leak detector is on page 19. The most important function is
the test result of the fuel dispensing, "either pass or fail". A fail could possibly mean a leak has
been detected within the dispensing system to include the piping. A fail result must be check out
immediately.
4.4 Diesel Fuel Report:
A copy of the diesel fuel report is on page 20. It shows purchases and when the UST has been
filled. Fuel levels are shown before and after each fill. For accuracy and expansion, the tank must
not get below 5,000 gallons or over 20,000 gallons.
4.5 Maintenance Shop:
The maintenance shop should be clean and organized. It should be easy to locate supplies when
needed.
4.6 Spent Material:
Spent or contaminated equipment or supplies should be stored in proper containers. This refers to
used oil, oil filters, contaminated rags, batteries, etc. All oil filters must be drained before
disposal.
4.7 Liquid Waste:
Liquid waste of any type must not be poured down any drains, sewer lines, stormwater drains or
grounds. They must be stored in a proper container until disposed of by I-IAZ-MAT.
4.8 Clean Up Equipment:
Maintain proper clean up equipment & material on site and properly identified. This consists of
at least one drum, oil absorbent, shovel and absorbent pigs to contain a spill.

get below 5,000 gallons and should not be filled to over 20,000 gallons. Check weekly print outs

3.0 Spill Prevention & Response Plan:
All employees working in and around the maintenance building and/or fueling
The Observer trucks must be familiar with the site and the spill prevention & response plan.
A copy of this plan must be displayed in the maintenance building.
3.1 Site Plan:
On page 7 is a site plan of the Transportation Department. Transportation's primary function is to receive, organize
and distribute The Charlotte Observer's news papers. This is done from the main building "transportation building".
3.2 The Truck Maintenance Building:
The truck maintenance building which is 245 feet North of the transportation building is where all maintenance is
performed on the trucks. fueling of the trucks is also accomplished at this building under a carport type shelter at the
West end of the building.
3.3 The Underground Storage Tank:
The underground fuel storage tank is a few feet North of the maintenance building and covered with a concrete pad.
The tank is a 25,000 gallon double wall fiberglass tank with the piping inside a secondary lining. The UST is
inspected and pressure tested annually by Precision Tanks Services out of Cornelius, NC. The tank is never filled
without the presence of an Observer employee working with the tanker driver.
3.4 Oil/Water Separator:
The oil/water separator was replaced in 2008 and is located a few feet South of the maintenance building. The new
separator is a CSC -Alpha 310013 oil/water separator. The oil/water separator is enclosed in a metal building. All
floor drains in the maintenance building is piped to the oil/water separator. Discharge from the separator is to the
sanitary sewer system. Starting in 2010 the water from the separator will be tested in the same manor as the
stormwater tests from the outfall; even though the output from the separator is to the sanitary sewer and not to the
storm drain.
3.5 Spill Clean Up Material:
The spill clean up material is stored on site inside the maintenance building. It consists ofa drum for storing spent
material, shovel for clean up of material, pigs for containing the spill and absorbent material for clean up of the spill.
All spent material must be put into the drum and stored until disposed of by HAZ Mat Services.
3.6 Notification Procedures:
