As per your Notice of Violation letter for the above mentioned site dated March 1, 2012,
we are ptoviding this written response detailing the measures we have taken and are in
the process of tatting to ensure compliance with our NC DENR NPDES Stormwater
Permit.
We have engaged the help of a Environmental Consulting Firm (INENCO, Inc.)
experienced in stormwater permit compliance. They evaluated our facility and the permit
as it applies to our facility, and concluded with the help of Michael Parker from
NCDENR the applicability of the permit.
MNCO, Inc. has presented us with a proposal to prepare a Stormwater Pollution
Prevention Plan for our facility, assist in its implementation, and provide guidance to
complete the remaining requirements of the General Permit No. NCG080000. These
include the necessary site inspections, employee training, and stormwater sampling
activities. 'We are planning on having the Plan in place, employees trained, and a site
inspection, completed during the Month of April. Stormwater sampling is also planned
for that time frame, weather permitting.

Enclosed is a copy of the Compliance Evaluation Inspection (CEI) report for the inspection
conducted at the subject facility on February 22, 2012, by Mr. Michael L. Parker with this Office. Thank
you for your assistance and cooperation during the inspection.
The enclosed report should be self-explanatory. Please note the comments located in the
summary portion of the inspection report. As required by Part 11, Section A. of the subject permit, a'
Stormwater and Pollution Prevention Plan (SPPP) should have been developed and implemented
subsequent to the issuance of your permit. The SPPP also requires the implementation of qualitative
monitoring, which has not been performed at this facility. Such being the case, this inspection report is
being issued as a Notice of Violation for the failure to comply with the terms and conditions of the
subject General Permit. Please be advised that NCGS 143-215.6A (a)(2) provides for a civil penalty of
not more than $25,000 per day per violation, which may be assessed against any person who fails to act
in accordance with the terms, conditions and requirements of such Permit.

Inspection Summary:
At the time of the site inspection, the facility representative indicated that they did not have a Stormwater Pollution
Prevention Plan (SPPP) as required by the facilities NPDES Permit. A SPPP template from 1994 was available, but it had
never been modified to reflect the conditions found at the subject facility. Qualitative monitoring has not been conducted
at this facility since the permit was issued.
This facility has two SW outfalls, but one main outfall appears to be representative of the activiites at this site. This outfall
drains the majority of the fueling area and the fuel storage area, and also captures a significant amount of the SW water
that passes through the site. The fuel storage is separated from a SW conveyance channel by an earthen berm, which
acts as secondary containment. Installed in the berm is a pipe and valve that allows for the release of accumulated SW in
the secondary containment area, There was no indication of excessive fuel spillages inside the secondary containment
area nor evidence of oil staining in the adjacent SW conveyance channel.

preparing a SPPP can be downloaded.
